Guide to accessing information of public interest

Learn how to formulate your request, follow up on the response and use the documents.

Prepare a request

Prepare a request for information of public interest. Fill in the fields, check the text and send the request to the institution by email, through its official form or by post. The data entered in the generator remain in your browser.

Write the requested details in Romanian where you can.

The generator does not send the request. For an electronic request, the absence of a handwritten signature does not justify a refusal to provide information: Article 15(5) of the implementing rules under H.G. No. 123/2002.

Key response dates

Indicative calculation based on the registration date, the clear-days rule in Article 16 of the implementing rules and the standard public holiday calendar. Check the actual registration date and any additional non-working days observed by the institution. This tool does not calculate the time limit for bringing court proceedings.

When calculating the time limit, do not count the day on which it starts or the day on which it expires. If the final day is a non-working day, the time limit is extended to the next working day. Standard calendar for 2024–2035, including movable Orthodox holidays; additional days off observed by the institution are not included. Refusal is calculated separately from receipt, in accordance with Article 7 of Law No. 544/2001. Calculation rule: Article 16 of the implementing rules; holidays: Article 139 of the Labour Code.

The request, the response and ways to challenge it

Anyone may request information concerning the activities of public authorities and institutions under Law No. 544/2001. The guide explains how to formulate a request, the response time limits and the available ways to challenge a response. The rules on environmental information and the re-use of documents are presented separately.

Response time limits

Time limits under Law No. 544/2001

10
days to disclose the information
30
days in total, with written notification within the first 10 days
5
days to communicate a reasoned refusal

For the response time limits under Law No. 544/2001, Article 16(2)–(3) of the implementing rules provides that neither the starting day nor the day on which the period expires is counted. If the last day is a non-working day, the deadline is extended to the next working day. The request must be registered immediately, under Article 20(4) of the implementing rules. Keep both proof of receipt and the registration date and number. The extended period for disclosure is no more than 30 days in total.

Section 1 Information requests and petitions

A request for information of public interest seeks data or documents concerning the activities of an authority or institution: contracts, decisions, permits, reports, official records, registers, statistics, payments or procedures. Describe the information so that the institution can identify it.

To seek an inspection, the adoption of a measure or an investigation into a situation, make a separate submission for that purpose. Requests, complaints, reports and proposals classified as petitions are handled under O.G. No. 27/2002. The subject of the message determines the applicable procedure.

  • Formulate the information request and the request for action separately.
  • In a combined message, set out the information request and the petition separately.
  • Identify the data or documents requested.
Information or measures

‘Provide the existing inspection reports’ is an information request. ‘Carry out an inspection’ is a request for action, which may be classified as a petition. For petitions, the general response time limit is 30 days from registration. Where a more detailed investigation is necessary, Article 9 of O.G. No. 27/2002 permits an extension of no more than 15 days, or no more than 30 days in the energy and natural gas sector. The petitioner must be notified in advance.

Section 2 Who can request information and to whom should the request be addressed?

Every natural or legal person, Romanian or foreign, has the right to request information of public interest. The exercise of the right under Law No. 544/2001 is not conditional on being a journalist, one’s profession or domicile.

Address the request to the authority or institution holding the information. For companies, community public utility service operators, political parties, sports federations and non-governmental organisations with public-benefit status, check whether they meet the conditions for inclusion under Article 2(a) of the law.

  • The institution’s exact name
  • Information and public relations department
  • Official address for sending the request
  • The institution holding the information
Identifying the information requested

The request must enable the information to be identified. You can explain any circumstances that help the institution find the document. Reasons for a personal interest are not among the required elements of a request listed in Article 6(3) of Law No. 544/2001.

Section 3 How to identify the information requested

Specify the document or data category, the issuer, the period, the project or procedure and your preferred format. The document number and date, even an approximate date, help identify it. Where the title of the document is unknown to you, describe its contents.

For a large volume of information, you can first ask for a list of documents, define periods or specify an order of priority. Also request disclosure of the parts to which access is permitted, after exempt information has been separated out.

  • The period concerned
  • Document types or data categories
  • The project, contract, site or procedure
  • Preferred electronic format (editable, where applicable)
An example of precise wording

Instead of ‘all documents about pollution’, specify the type of inspection, the period and the site. State that you are requesting the inspection reports and the documents ordering measures.

Section 4 Required elements of the request and the applicant’s details

Under Article 6(3) of Law No. 544/2001, a written request must contain the name of the recipient authority or institution, the information requested, the applicant’s surname, given name and signature, and the address for receiving the response. For electronically submitted requests, Article 15(5) of the implementing rules provides that the absence of a handwritten signature is not grounds for refusing disclosure.

Provide the details required by law and the address at which you wish to receive the response. If the institution requests additional identification data, ask it to specify the legal basis and explain why the data are necessary to process the request.

  • Recipient authority or institution
  • Information described clearly enough to be identified
  • The applicant’s surname and given name
  • Address for receiving the response
  • Signature (for a paper request) or surname and given name at the end of the electronic message
Details needed for identification

A copy of an identity document and the personal numeric code are not among the required elements of a request listed in Article 6(3). State your surname, given name and address for the response.

Section 5 Sending and registering the request

You can send the request to the institution’s official email address, through its electronic registry or using its form. You can also submit it at the registry or send it by post with proof of receipt. Keep the request, the annexes, the sent message and the acknowledgements received.

The institution must register the request immediately and communicate the registration date and number under Article 20(4)–(5) of the implementing rules. For a request sent by post, expressly ask for the registration number.

If the information is published on the institution’s website, the response must provide the page address as an active link or editable text. On express request, proactively disclosed information must also be sent in writing, electronically or on paper. If the request is forwarded, keep the notification and follow up on its registration with the competent institution.

  • Copy of the request and annexes
  • Proof of dispatch and receipt
  • Registration date and number
  • Notifications and responses received
Keep a record of correspondence

Save the files received separately, in their original form. Use dates in YYYY-MM-DD format in file names to make the order of correspondence easy to follow.

Section 6 Response time limits: 5, 10 and 30 days

The standard time limit for disclosure of information is 10 days from registration of the request. Depending on the difficulty, complexity and volume of the documentary work, and the urgency of the request, the response may be provided within no more than 30 days from registration. If more than 10 days are needed, the institution must notify the applicant in writing within the first 10 days.

Article 7(2) of Law No. 544/2001 provides that reasons for refusal must be given and communicated within 5 days of receipt of the request. The implementing rules calculate the time limits from registration, and the request must be registered immediately. Keep both dates, receipt and registration, to check compliance with the time limit.

  • Date of receipt and date of registration of the request
  • Written notification sent within the first 10 days
  • Date on which the response or refusal was communicated
  • Reasons for refusal
  • Separate calculation of the time limits for challenges
At most 30 days in total

The extension concerns the total period for processing the request. The maximum period of 30 days runs from registration of the request, under the calculation rules explained in the guide.

Section 7 Document formats, costs and re-use

Access to information of public interest is free of charge. Where paper copies are necessary, the applicant bears the copying costs under Article 9 of Law No. 544/2001 and Article 18 of the implementing rules. Ask to be informed in advance of the number of pages, the total cost and the payment method.

Specify your preferred format, for example PDF, and state whether you need the document to be editable. Under Article 15(4) of the implementing rules, information available in an editable format must be provided in that format on request. For tabular data, you can request the existing CSV or XLSX file.

An access request seeks to obtain information. A re-use request concerns the use of documents under Law No. 179/2022, which regulates formats, licences, fees and challenges. Documents must be used in compliance with the rules on personal data protection and third-party rights in the material they contain.

Under Article 4(2) of Law No. 179/2022, a re-use request contains the applicant’s identification details, correspondence address, the documents concerned and the purpose of use. An access request uses the elements specified in Article 6(3) of Law No. 544/2001.

For requests to which Article 4 of Law No. 179/2022 applies, the time limit is 30 working days from receipt. It may be extended by 20 working days, with written notification within the first 15 working days. A reasoned refusal must be communicated within 15 working days. Article 4(10) exempts the public undertakings, educational establishments and research bodies listed in that paragraph from this procedure.

To challenge the handling of a re-use request, Article 5 of Law No. 179/2022 provides for a prior administrative complaint to the Authority for the Digitalisation of Romania. The time limit is 30 days from receipt of the response or expiry of the statutory response time limit. Court proceedings are brought under Article 5(7) and Article 7 of the same law, which refers to the litigation procedure under Law No. 554/2004. A complaint concerning non-compliance with Law No. 179/2022 is exempt from the judicial stamp duty.

  • Preferred electronic format
  • The editable format in which the data are available
  • Cost communicated before paper copies are made
  • Purpose of use, for a re-use request
The access procedure and the re-use procedure

A request for an editable file as part of an access request is handled under Law No. 544/2001. A re-use request is subject to the separate rules and time limits under Law No. 179/2022.

Section 8 Exemptions and partial access to documents

Article 12 of Law No. 544/2001 lists the categories of information exempt from access. A refusal must give reasons relating to the specific information and the legal basis applied. Article 13 classifies information that facilitates or conceals a breach of the law by a public authority or institution as information of public interest and prohibits its classification.

For documents containing both accessible and exempt information, request disclosure of the accessible parts after the protected information has been separated out or anonymised. Article 22(2¹) of the implementing rules provides for this operation. Disclosure of personal data are assessed under the applicable rules, taking into account the nature of the data, the necessity of disclosure and the rights of the data subjects.

Environmental information is subject to the special regime under H.G. No. 878/2005. Whether information falls within it is determined by the definition in Article 2, point 1. Information must be disclosed as soon as possible, and no later than one month from receipt of the request. If the volume and complexity justify an extension, the period may reach two months from receipt, with a reasoned notification to the applicant before the first month expires.

Under this regime, partial access and refusal are assessed under Articles 11–15 of H.G. No. 878/2005. A refusal must state the reasons, explain how the public interest in disclosure was taken into account and provide information on the procedure for challenging it.

  • Information to which access was refused
  • The legal basis and specific reason for refusal
  • Separating out accessible information
  • Anonymising protected data
  • Determining whether the special environmental information regime applies
Personal data in the requested documents

A name, signature and contact details may enable a natural person to be identified. The institution must examine what information can be disclosed and what data must be protected. For data relating to the exercise of public office, the applicability of Article 14 of Law No. 544/2001 must also be checked.

Section 9 How to challenge a refusal or the absence of a complete response

Under Article 21(2) of Law No. 544/2001, you can submit an administrative complaint to the head of the authority or institution within 30 days of becoming aware of an express or tacit refusal. Under Article 34(1) of the implementing rules, a reasoned response to the complaint must be communicated within 15 days of registration, regardless of the outcome. If the complaint is well founded, the response includes the information originally requested and, where applicable, the measures provided for in Article 34(2).

Article 22(1) of Law No. 544/2001 provides for a complaint to the administrative litigation division of the tribunal within whose territorial jurisdiction you are domiciled or the authority or institution has its registered office. The time limit is 30 days from expiry of the period specified in Article 7. The complaint and the appeal on points of law are heard as a matter of urgency and are exempt from the judicial stamp duty.

Calculate the time limit for the administrative complaint separately from that for the complaint to the tribunal, because the law sets different starting points. Keep the request, proof of receipt, registration details and response so that each time limit can be determined.

  • The request and proof of receipt
  • The response received or the date on which the response time limit expired
  • Information not yet disclosed
  • Reasons and legal grounds for refusal
  • The separately calculated time limit for bringing court proceedings
Challenging decisions on environmental information

For environmental information, Articles 16–17 of H.G. No. 878/2005 provide for a prior administrative complaint to the head of the authority and proceedings before the competent administrative court, read in conjunction with Law No. 554/2004. Time limits and jurisdiction are determined under this special regime.

Section 10 Checking the request before sending it

Reread the request to check that the information can be identified and that the details for the response are complete. Save the version sent and the documents proving dispatch, receipt and registration.

  • I have specified the institution and the information requested.
  • I have specified the relevant period.
  • I have separated the information request from any petition.
  • I have included the details needed for identification and a response.
  • I have specified my preferred electronic format and stated whether I am requesting an editable file.
  • I have requested disclosure of the accessible parts.
  • I have specified the environmental information regime where it applies.
  • I have requested the registration date and number.
  • I have kept a copy of the request and proof of sending it.
  • I have noted the relevant time limits.
A clear and precise message

Describe the information requested and the relevant documents in neutral terms. Precise wording helps the institution identify them and enables you to check whether the response covers each point of the request.

Frequently asked questions

Answers to frequently asked questions

Do I have to explain why I am requesting the information?

An access request contains the elements specified in Article 6(3) of Law No. 544/2001, which do not include reasons for a personal interest. You can add explanations that help the institution identify the information.

What identification details must I include in the request?

Article 6(3) of Law No. 544/2001 requires the request to include the applicant’s surname, given name and signature, and an address for the response. For an electronic request, the rule on the absence of a handwritten signature in Article 15(5) of the implementing rules applies.

Can I send the request by email?

Yes. The request may be sent electronically, and the absence of a handwritten signature does not justify refusal to disclose the information, under Article 15(1)–(5) of the implementing rules. Keep the message and request the registration date and number.

Is it necessary to mention Law No. 544/2001?

Mentioning the law clarifies the subject of the request. Under Article 15(6) of the implementing rules, the institution must disclose the information within the statutory time limits even where the applicant has not expressly invoked Law No. 544/2001.

Under what conditions may the response time limit be extended to 30 days?

The need for an extension is assessed according to the difficulty, complexity and volume of the documentary work and the urgency of the request. The institution must notify the applicant in writing within the first 10 days. The maximum period is 30 days in total from registration.

How do I request a document that also contains personal data?

Request disclosure of the accessible information after the protected information has been separated out or anonymised. For a document containing both categories, Article 22(2¹) of the implementing rules provides for disclosure of public information after exempt information has been anonymised.

Can I request a file in XLSX or CSV format?

Yes. If the information is available in an editable format, Article 15(4) of the implementing rules provides for its supply in that format on request. Specify your preferred format and the data you are requesting.

How do I request information about an institution’s compliance with the law?

Request the existing inspection reports, decisions, procedures and analyses concerning the situation. Specify the period and activity concerned. A request for checks or measures should be made separately from the information request.

What should I do if the response only gives the website’s home page?

Request the address of the page or document containing the information. Article 21(4) of the implementing rules provides for the page address to be given as an active link or editable text. You can also request that the information be sent in writing, under paragraph (5).

What should I do if the response is incomplete?

Compare the response with each point of the request and identify the information not disclosed. You can submit an administrative complaint and bring proceedings before the tribunal under Articles 21–22 of Law No. 544/2001. Calculate the time limits for the two steps separately.

What are the time limits for environmental information?

Under Article 4 of H.G. No. 878/2005, information must be disclosed as soon as possible, and no later than one month from receipt of the request. If the volume and complexity justify an extension, the period may reach two months from receipt, with a reasoned notification to the applicant before the first month expires.

What role does being a journalist or a non-governmental organisation play?

The right under Law No. 544/2001 belongs to everyone. Journalistic or civic activity can explain why the information is relevant to informing the public. In cases concerning access to information, the European Court of Human Rights decides whether the right to freedom of expression applies by considering the purpose of your request, the public interest in the information, your contribution to informing the public, and whether the information exists and is available.
