Animals mistreated or kept in dangerous conditions

Prepare a report about the situation you observed.

We help you choose the institution and prepare the text. We do not send anything on your behalf.

Check your safety and choose the appropriate procedure

Is there an immediate danger to people or the environment now?

  • Yes
  • No
  • I cannot assess this

Has anyone been injured or directly threatened?

  • Yes
  • No

Is the animal being subjected to violence now, or is it in a situation that requires immediate police intervention?

  • Yes
  • No
  • I do not know

What do you want to achieve?

  • Checking the situation and taking protective or care measures
  • Existing documents or information
  • Challenging a penalty or an act you have received
  • Reporting a possible criminal offence

Is the situation happening right now?

  • Yes
  • No
  • Get to safety and call 112 to report the immediate danger. Do not physically intervene between people and animals, and do not step into traffic or enter properties to obtain evidence. Do not fill in the petition instead of requesting intervention.
  • Move away from the source of danger. Do not approach the animal or confront the people involved. Describe the situation to the police using their verified contact details; if there are signs of immediate danger requiring intervention, call 112.
  • Seek medical care or intervention, depending on the situation. If there is an emergency or the danger continues, call 112. Criminal proceedings and any claims for compensation for harm are separate from a petition for administrative measures. You can return to the petition once you are safe.
  • Call 112 and describe the location, what is happening and the animal’s visible condition. Do not wait for a petition to be handled or delay the call to take photographs. Do not enter property without a right to do so or try to take the animal yourself.
  • Stay in a safe place and describe what you observed to the police using their verified contact details. You do not need to make a diagnosis. If there are signs that immediate intervention is needed, call 112. A suspicion about the conditions in which an animal is cared for does not automatically justify an emergency call.
  • Open the FEW guide to accessing information of public interest and make a separate request under Law No. 544/2001. A request for copies of existing documents is separate from a request for intervention.
  • Check the procedure and time limit for challenging the act you received or the sanction imposed. A petition asking for the situation to be checked does not automatically replace a challenge or change the time limit for challenging it.
  • Check whether your situation calls for a criminal complaint or a report of an offence (denunț), and comply with the requirements for the form and submission of reports to the criminal justice authorities set out in the Code of Criminal Procedure. You can submit a separate petition for administrative protective measures. The petition time limit calculator does not apply to criminal proceedings.
  • Use the competent authority’s verified contact details to report the situation while it is happening. Prepare a separate written petition if it is useful for following the progress of the checks and the implementation of measures.
  • Continue with the questions about the circumstances, identifying the authority and preparing the petition.
Read the guide to Law No. 544/2001

112 emergency service

Emergency telephone number. Do not use it as a registry for a petition submitted under Government Ordinance No. 27/2002.

112

The single emergency telephone number available in Romania. It is not intended for submitting an administrative petition.

Tell the operator the location, landmarks and nature of the emergency, and answer their questions. Do not fill in the petition form first.

At all times, 24 hours a day, 7 days a week.

Identify the location and responsibilities for the situation reported

Who is responsible for what

Here you can find contact details for local or county institutions and, where applicable, for a national institution marked ‘National alternative’. Use the explanations in the guide to choose the right recipient for your problem. You send the report; the Foundation does not send anything on your behalf.

The Romanian Police check matters relating to the animal’s protection and assess whether the conditions for applying legal measures are met. Choosing this recipient for an administrative petition does not turn the document into a criminal complaint.

  • Romanian Police

Specialist inspection of care and welfare conditions. Contact the veterinary directorate responsible for the location being checked; the contact details of the national veterinary authority are also available if needed.

  • National Sanitary Veterinary and Food Safety Authority

Problems with care after the animal has been taken into care justify a veterinary inspection, regardless of the original reason for the police intervention.

  • National Sanitary Veterinary and Food Safety Authority

In the directory, choose the county of the authority you have confirmed is responsible. The request concerns services relating to an existing order. If the shelter is in another county, prepare a separate petition for an inspection at that shelter.

  • County council

Responsibility for the services relating to the order lies with the General Council of the Municipality of București (CGMB). Do not replace this recipient with a sector council.

  • General Council of the Municipality of București (CGMB)

Ask the police unit that issued the order to identify the responsible authority and service provider. The veterinary authority remains among the recommended recipients for problems with care.

  • Romanian Police

Romanian Police

Check the competent institution’s contact details on its official page.

Identify the Romanian Police unit responsible for the location and nature of the events, and use its verified official contact details. For an administrative petition, use the registry address or petition form; for a criminal complaint, follow the formal requirements and method of submission indicated in the guide. In an emergency, call 112.

Prepare the text without the recipient’s email address

National Sanitary Veterinary and Food Safety Authority

Check the competent institution’s contact details on its official page.

National alternative

National Sanitary Veterinary and Food Safety Authority

You can use the national contact details for veterinary health matters and for checks on the application of Government Emergency Ordinance No. 155/2001 approving the stray dog management programme. The authority carries out these checks through the veterinary and food safety directorates (DSVSA) in the counties and the municipality of București.

Choose the form under the heading ‘Formularea unei petiții’ (Submitting a petition), not the first form on the page, which is intended for requests made under Law No. 544/2001.

The fields for surname and given name and for email address are marked as required.

You can attach files with the extensions .pdf, .doc, .docx, .jpg or .png. If a file does not upload, check the form’s requirements or send the report and annexes to the official email address for petitions.

Check the official form to see which fields are mandatory and which file types and sizes you can attach.

County council

Check the competent institution’s contact details on its official page.

Identify the county where the reported location is situated and use the county council’s registry address or official petition form. Check the responsibility indicated in the guide; if you do not know the responsible institution or administrator, ask for the recipient to be identified and, where applicable, for the petition to be forwarded to the competent authority.

Prepare the text without the recipient’s email address

General Council of the Municipality of București (CGMB)

Check the competent institution’s contact details on its official page.

On the official website of the Mayor’s Office of the Municipality of București (PMB), find the registry that receives petitions addressed to the General Council of the Municipality of București (CGMB) and information about services for animals subject to orders for placement in a shelter. Check the recipient and address before sending. Do not automatically use the contact details of a sector mayor’s office.

Prepare the text without the recipient’s email address

Choose how to proceed: rapid response, a registered petition or both.

Rapid response

  • If there is an immediate danger to people, get to safety and call 112.
  • If the animal is being subjected to violence now or is in an urgent situation requiring immediate police intervention, call 112. Do not delay the call to fill in the petition or obtain photographs.
  • For situations that do not require immediate intervention, use the competent police inspectorate’s verified contact details and state that the report concerns animal protection. For care conditions, use the competent veterinary directorate’s contact details.
  • Keep your distance from the people involved and the animal. Do not enter property without a right to do so, try to take the animal or give it medication.
  • If you know that a shelter placement order has not been enforced, inform the police unit that issued it and the responsible service identified from official sources. The order must be enforced immediately under the conditions laid down by law; the response time limit for a petition is not a waiting period for intervention.

Registered petition

  • Use the ‘Animals – checks and inspection’ template to request checks on the facts and care conditions and an assessment of the protective measures needed. Choose the version for the appropriate recipient: the Romanian Police or the veterinary authority.
  • For the Romanian Police, select the police option in the directory and address the petition to the unit responsible for animal protection in the area. A shelter placement order for an animal is issued by officers of the Romanian Police under Article 24¹ of Law No. 205/2004; the local police do not have this power.
  • Ask for checks on whether the legal conditions for applying the measures under Article 24¹ of Law No. 205/2004 are met. The 45 days provided for placement in a shelter are the duration of the measure, not the time limit for intervention or for responding to a petition. The law also provides for situations in which the order is not issued.
  • Use the ‘Animals – enforcement of the order and provision of care’ template only if the existence of the order is confirmed and you are reporting a problem with enforcement or the related services. You can give verifiable information received from the police even if you do not have a copy of the order.
  • For services relating to the order, check which county council is responsible or whether the General Council of the Municipality of București (CGMB) is responsible. If the shelter is in another county, prepare the petition for an inspection of the shelter separately from the petition about the services the responsible authority must provide.
  • For a possible criminal offence, keep the administrative petition separate from the report to the criminal justice authorities. A criminal complaint concerns harm caused to you by an offence; a report of an offence (denunț) provides information about the commission of an offence. Check which document is appropriate for your situation.
  • To make a report to the criminal justice authorities, you can contact the competent judicial authority by submitting a signed document or making an oral statement that is recorded. An electronic submission must meet the legal requirements for an electronic signature. Do not assume that an ordinary email or a petition form automatically meets these requirements.
  • If you want copies of existing documents, make a separate request under Law No. 544/2001. Challenging a sanction or an order you have received involves a separate procedure; the petition does not replace that procedure.
  • The mere presence of an animal roaming free does not prove that it has been mistreated or abandoned. If the problem is a dog that attacks or puts people at risk, also consult the guide ‘Dogs that attack or put people at risk along a path’.
  • Choose the recipients according to your specific requests. For each petition, ask for the registration number and date, the results of the checks and the measures ordered, with the legal basis for the outcome. Displaying several recipients does not mean that the message is automatically sent to them all.

If necessary, report the situation using the verified contact details for intervention. Send the written report separately to document the problem and request a response. State in the report that you have already reported the situation.

Animals – enforcement of the order and provision of care

Use the template for the responsible county council or the General Council of the Municipality of București (CGMB) only if the existence of the shelter placement order is confirmed. The template concerns enforcement and the services relating to the order; to challenge the order, check the separate procedure.

Authority responsible for the services relating to the order
Specify the county council you have confirmed is responsible or the General Council of the Municipality of București (CGMB). The shelter’s location alone does not determine this responsibility.
Petitioner’s identification details
For an individual, enter the surname and given name. For an organisation, enter its name, registered office address, representative’s name and the capacity in which they act.
Relevant locality
Give the locality relevant to identifying the case. Explain in the location field if the animal has been transported to another locality.
Animals concerned
Describe the animals in enough detail to identify the case, using the information you know.
The order and confirmation of its existence
Give the police unit, date, order number and source of confirmation to the extent that you know them. You can describe the confirmation received from the police without having a copy of the order. Do not use the template solely on the assumption that an order should have been issued.
Location of the events and the animal’s current location
Distinguish the location of the intervention, the collection location and the current shelter if they are different. Do not enter an assumed address.
Date of observation or receipt of the information
State when you observed the problem or when you received the information and from whom, as applicable.
Problem with enforcement or care
Describe specifically what has not been done or what inadequate conditions you observed. Separate direct observations from information received.
List of evidence and annexes
List only the documents and materials you are actually sending and that you hold lawfully.
Email or postal address for the response
Enter an address where you can receive the response and notifications.
Name of the person signing
For an organisation, enter the name of the representative submitting the petition.

Report – enforcement of the shelter placement order and care of the animal – locality unconfirmed

To: [Authority responsible for the services relating to the order]

[Petitioner’s identification details]

I am reporting a problem with the services relating to an order to place an animal in a shelter.

Animals concerned:
[Animals concerned]

Known details of the order and the source of confirmation of its existence:
[The order and confirmation of its existence]

The relevant location and, if different, the animal’s current location:
[Location of the events and the animal’s current location]

On [Date of observation or receipt of the information], I observed the following or learnt of it from the source indicated:
[Problem with enforcement or care]

The problem reported concerns the services provided after the animal was taken into care under the order. I request checks on and provision of the necessary care, including the relevant veterinary services, under Article 24³(3) of Law No. 205/2004, according to the situation established.

I request checks on the situation, identification of the responsible service provider and provision of the necessary services under Articles 24³(1)–(4) and 24⁴(1) of Law No. 205/2004. Please carry out the necessary coordination with the issuing police unit and the service provider, within your statutory remit, and inform me of the measures taken to resolve the problem described.

I submit this petition under Articles 1–2 of Government Ordinance No. 27/2002. I request that you communicate the registration number and date, the results of the checks and the measures ordered, stating the legal basis for the outcome, under Article 13 of Government Ordinance No. 27/2002.

If you are not the authority responsible for the services relating to this order, please forward the petition to the competent authority under Article 6¹ of Government Ordinance No. 27/2002 and notify me of the forwarding.

Evidence and photographs

  • The exact location, landmarks and, optionally, coordinates. State whether the animal has been moved and distinguish where the events occurred from where it is now.
  • The date and time of the observation or the approximate period; for a repeated situation, describe observations made on different days separately.
  • The species, approximate number of animals and visible features that allow them to be identified, without approaching to check.
  • A specific description of the facts: blows observed, visible wounds, an apparent lack of water or shelter, restricted movement or other circumstances. State how long you observed the situation and what you cannot confirm.
  • Photographs, recordings or messages obtained without intrusion or exposure to danger. Keep the originals and state whether the materials come from another person or from material published online.
  • Details of the keeper and witnesses, only to the extent that you know them and they are relevant to the authority. Separate direct observations from other people’s accounts.
  • For a confirmed order, give the issuing unit, date, number and source of the information if you know them. Do not invent missing details.
  • A veterinary document may be useful if you hold it lawfully. You do not need to obtain a diagnosis yourself before reporting the facts you observed.
  • Keep the text and annexes actually sent. Send only personal data and images relevant to the recipient and the purpose of sending them.

Keep the originals in a safe place. Send only relevant images with your report. For publication, create copies with unnecessary data and identifying features removed.

A copy from which you have removed the photograph’s technical data, such as the date and location recorded by the device, does not replace the original. Nor do these data, taken alone, provide conclusive proof of when or where the photograph was taken.

Include faces, vehicle registration numbers and witnesses’ identities only when they are relevant to the recipient and the purpose of sending the material. Publication on a website serves a different purpose from private submission to an authority.

Mistakes to avoid

  • Entering a yard, home, farm or shelter without a right to do so in order to gather evidence.
  • Confronting the people involved or trying to take the animal yourself.
  • Making a veterinary diagnosis or attributing an intention to injure solely on the basis of an assumption.
  • Presenting a brief observation as conclusive evidence that the animal never receives food or water.
  • Confusing any breach of care obligations with a criminal offence that has already been proved.
  • Asking the veterinary directorate or the local police to issue a shelter placement order, which is a power of the Romanian Police.
  • Automatically sending every report to the mayor’s office or assuming that every shelter in a county is administered by that county council.
  • Using an administrative template as an automatic substitute for a criminal complaint, a report of an offence (denunț) or a challenge to an act.
  • Waiting for the petition response time limit to expire when immediate intervention is needed.

Keep proof and track the time limit

Keep the text actually sent, the evidence actually attached, confirmation of dispatch, confirmation of receipt or registration and any notification of forwarding or extension.

Sending the email, receiving the registration number and receiving the response are three separate events.

Indicative response dates

Indicative dates. Check the registration date with the competent authority and the advance notification of any extension. The calculator does not determine time limits for court or criminal proceedings.

When calculating a time limit in days, do not count the day it starts or the day on which it expires. If the final day is a non-working day, the time limit is extended to the next working day. The calendar covers 2024–2035 and includes Orthodox holidays with variable dates; check any additional days off observed by the institution separately.

Response: 30 days from registration
Possible extension: 45 days in total from the same registration – does not apply automatically
Forwarding: 5 days – a separate time limit

Next steps

  • Keep administrative petitions, any reports to the criminal justice authorities, proof of sending them and responses separately.
  • Note the registration number and date at each authority. If the petition is forwarded, find out the date of registration with the competent authority.
  • A petition sent to the wrong authority must be forwarded to the competent authority within 5 days of registration, and the forwarding authority must notify you of the forwarding, under Article 6¹ of Government Ordinance No. 27/2002.
  • The response to a petition must be communicated within 30 days of registration; after forwarding, the time limit runs from registration with the competent authority. For more detailed investigations, the time limit may be extended by no more than 15 days, provided that you are notified of the extension in advance, under Articles 8–9 of Government Ordinance No. 27/2002.
  • When calculating the petition response time limit, the first and last days are not counted, under Article 2.553 of the Civil Code. If the last day is a non-working day, the time limit expires at the end of the next working day, under Article 2.554 of the Civil Code.
  • The petition response time limit is separate from urgent intervention, immediate enforcement of the order and the duration of placement in a shelter. The petition calculator does not apply to criminal proceedings.
  • If new facts emerge, describe them and state the dates on which the events concerned took place, then give the registration number and date of the previous petition. If you send several petitions about the same problem to the same public authority or institution, they are combined and you receive a single response covering them all. After the response has been sent, a new petition with the same content, received from you or from a public authority or institution contacted in error, is closed without further action under Article 10 of Government Ordinance No. 27/2002.
  • If you do not receive a response within the time limit, continue with the guide ‘I have not received a response to my petition’. If an immediate danger arises, follow the emergency intervention steps again.
I have not received a response to my petition
