Local trees: felling or other work

Prepare a report about the situation you observed.

We help you choose the institution and prepare the text. We do not send anything on your behalf.

Check your safety and choose the appropriate procedure

Is there an immediate danger to people or the environment now?

  • Yes
  • No
  • I cannot assess this

Has anyone been injured or directly threatened?

  • Yes
  • No

What do you want to achieve?

  • Checking and remedying the situation
  • Existing documents or information
  • Challenging a penalty or an act you have received
  • Reporting a possible criminal offence

Is the incident happening now?

  • Yes
  • No
  • First, get to safety and request the necessary intervention. If there is an immediate danger, call 112. Do not fill in the form instead of requesting intervention.
  • Move away from the source of risk. Do not touch suspicious waste or containers. Use the verified contact details for intervention; not every violation justifies a call to 112.
  • Request medical care or intervention, depending on the situation. The criminal procedure is separate from a petition for preventive measures. You can return to this petition once you are safe.
  • Open the FEW guide to accessing public information. Keep the request for documents separate from the request for intervention.
  • Do not automatically use a petition as a substitute for challenging an act or a penalty. Check the special procedure and the applicable time limit.
  • Follow the criminal procedure and check the formal requirements for submission. The time limit calculator for petitions made under Government Ordinance No. 27/2002 does not apply to the criminal procedure.
  • Report the situation using the verified contact details for intervention and, where useful, prepare the written report separately.
  • Continue by identifying the authority and preparing the text.

Who is responsible for what

Here you can find contact details for local or county institutions and, where applicable, for a national institution marked ‘National alternative’. Use the explanations in the guide to choose the right recipient for your problem. You send the report; the Foundation does not send anything on your behalf.

Within its local remit, the mayor’s office checks the administration and maintenance of green spaces. The National Environmental Guard (GNM) checks compliance with the rules protecting green spaces and the environment. You can choose between these recipients; the petition is not sent automatically.

  • Mayor’s office
  • National Environmental Guard

The legal regime governing the land and the institution responsible need to be clarified. The mayor’s office is not automatically responsible for maintaining privately owned trees, and Law No. 24/2007 does not automatically apply to the entire yard.

  • Mayor’s office
  • National Environmental Guard

The Forest Guard checks the legal regime governing the land and the forestry work; the National Environmental Guard (GNM) checks the environmental aspects. The administrator or forest district (ocol silvic) is identified separately for the work for which it is responsible.

  • National Forest Guard (GFN)
  • National Environmental Guard

You can report the situation to the local police within their remit, if a local police service has been established and its contact details are confirmed by official sources. If there is no local police service, you can contact the mayor’s office and the inspection authority.

  • Local police

You can ask for the applicable endorsement (aviz) to be checked. Checks cover whether the area is urban, whether the site is classified as a green space, whether the trees are healthy and whether there is a local administration decision; your answers do not prove that these conditions are met.

  • National Agency for Environment and Protected Areas (ANMAP) – responsible county environmental directorate

If the site falls within the scope of Law No. 24/2007, transplanting requires the agreement of the local administration and the territorial environmental authority. The mayor’s office is already selected as a recipient for matters concerning its agreement and remit.

  • National Agency for Environment and Protected Areas (ANMAP) – responsible county environmental directorate

The origin and movement of the timber, and compliance with the applicable rules, are checked within the institution’s remit. Transporting timber does not prove illegality and does not mean that the land it came from is part of the forest estate (fondul forestier).

  • National Forest Guard (GFN)

Mayor’s office

Check the competent institution’s contact details on its official page.

Identify the mayor’s office responsible for the location and subject of the report and use its registry address or official petition form. In București, check whether responsibility lies with the municipality or sector authorities. If you do not know the responsible institution or administrator, ask for the recipient to be identified and, where applicable, for the petition to be forwarded to the competent authority.

National alternative

National Agency for Environment and Protected Areas (ANMAP)

You can submit a report to the agency concerning the endorsement (aviz) for felling healthy trees, the agreement for transplanting or other documents within its remit, in the cases provided for by law. Use the contact details of the responsible territorial office or send the petition to the agency’s central address so that it can be assigned to the responsible office.

office@anmap.gov.ro

Official address for reports to the National Agency for Environment and Protected Areas (ANMAP). You can use it as a national alternative so that your petition concerning the endorsement (aviz) for felling healthy trees or the agreement for transplanting trees and shrubs, where required under Law No. 24/2007, can be assigned to the responsible environmental directorate.

Enter the petitioner’s identification details and the address for the response. The official page states that reports are registered under Government Ordinance No. 27/2002.

Official source (opens in a new tab)

Choose how to proceed: rapid response, a registered petition or both.

Rapid response

  • If a tree or branch is at immediate risk of falling on people, there are fallen electricity cables or another immediate danger, move away and call 112. Do not wait for a response to the petition.
  • For work in progress with no immediate danger, contact the mayor’s office, the local police if a local police service has been established, or the inspection authority indicated for your situation. Use contact details confirmed by official sources.
  • To have work on forest land or timber transport checked, notify the Forest Guard using contact details confirmed by official sources. Do not follow vehicles.
  • Stay outside the work area and the area where trees may fall. Do not approach machinery, try to stop the work through physical intervention or confront the people involved.
  • The petition does not automatically suspend the work. You can request prompt checks and lawful measures, with no guarantee that the work will be stopped.

Registered petition

  • Enter the petitioner’s identification details and the address for the response. Describe what you observed and separate direct observations from information received from others.
  • Use the ‘Local trees – checks and inspection’ template. Choose the recipient according to the matters you ask it to check; you do not need to send the same letter to all the institutions shown.
  • Ask for the legal regime governing the land to be established and for checks on whether the documents applicable to the work are required, whether they exist and whether their provisions are being complied with. You do not have to prove that an endorsement (aviz) is missing or that the tree is healthy.
  • For local administration decisions on felling healthy trees in green spaces in urban areas, ask for the endorsement (aviz) provided for in Article 12(6) of Law No. 24/2007 to be checked. It is issued through the territorial directorate within the National Agency for Environment and Protected Areas (ANMAP). The rule does not automatically extend to every tree or type of work.
  • For cuts to the crown, ask for the conditions and exceptions in Article 12(5) of Law No. 24/2007 to be checked. For transplanting, ask for separate checks on the agreements provided for in Article 9(2) of the same law, if the site falls within its scope.
  • For risk assessment, tree care and restoration of the area, use the ‘Local trees – safety and remedial action’ template. Ask for the responsible person or institution to be identified and for measures to be taken within the remit of the authority receiving the report; do not assume that the inspection authority carries out the work.
  • If you want copies of endorsements (avize), decisions, assessments or documents from the green spaces register, make a separate request under Law No. 544/2001. You can use a petition to request checks on legality and communication of the inspection findings.
  • A criminal complaint or a report of a criminal offence (denunț), and challenges to a sanction or an act received, follow separate procedures. The petition templates do not replace them.
  • Ask to be informed of the registration number and date, the findings of the checks and the measures ordered, with the legal basis for the outcome.

If necessary, report the situation using the verified contact details for intervention. Send the written report separately to document the problem and request a response. State in the report that you have already reported the situation.

Prepare the report

Prepare the text. Provide only the necessary details. Check and edit the resulting text.

First answer the safety questions and identify the responsibilities.

Letter templates

Local trees – checks and inspection

You can use the template as an individual. You can also use it on behalf of a legally constituted organisation, for the group that the organisation represents. Choose the authority responsible for the checks. The template concerns work observed or announced and is not a criminal complaint or a request for copies of documents.

Approximate number of trees
Give an estimate only if you can do so safely. An exact count is not necessary.
The site is described as a green space or a row of street trees. I request that its classification under Articles 1 and 3 of Law No. 24/2007 be established and that compliance with Article 5(c) of the same law be checked. For cuts to the crown, I request checks on the conditions concerning ornamental trees, locations and exceptions provided for in Article 12(5) of the same law. If the work consists of felling healthy trees in green spaces in urban areas following a local administration decision, I request that the endorsement (aviz) provided for in Article 12(6) of the same law be checked. For transplanting, I request that the agreements provided for in Article 9(2) of the same law be checked. Through this report, I do not determine the trees’ state of health or claim that there is an obligation to obtain an endorsement outside the conditions provided for by law.

I request an on-site check of the situation, the establishment of responsibilities and checks on whether the applicable documents are required, whether they exist and whether their provisions are being complied with, including whether the work actually carried out corresponds to the work permitted. If breaches are found, I request that lawful measures be taken within your remit, including to prevent the situation from worsening.

If the description also concerns the loading or transport of timber, I request that the responsible authority check matters concerning its origin and movement, taking account of Article 4(2) and Article 132(1)(b) and (c) of the Forestry Code, adopted by Law No. 331/2024. I do not infer from the transport of timber that the land is classified as part of the forest estate (fondul forestier).

Please inform me of the registration number and date, the findings of the checks and the measures ordered, with the legal basis for the outcome, under Articles 8 and 13 of Government Ordinance No. 27/2002. For matters outside your remit, I request that the petition be forwarded to the responsible authority under Article 6¹ of Government Ordinance No. 27/2002 and that I be notified of this forwarding.

Within your remit, I request measures for people’s safety, protection of the remaining trees, safe removal of debris that poses risks and restoration of the affected area.

Evidence and annexes:
I am not enclosing evidence; I describe the known facts.

Please send your response to [Email or postal address for the response].

Date drafted: [Date drafted]

Evidence and photographs

  • The exact location, street, a landmark and, optionally, coordinates if you already have them.
  • The date and time of observation or the approximate period; for announced work, state the source and date of the announcement.
  • The approximate number of affected trees and a description of the work on the crown, trunk or roots. State the species only if you know it.
  • Overview and detailed photographs taken from a safe place, including earlier images you already hold. Photographs are not compulsory.
  • The effects observed: detached branches, exposed roots, trees left unstable or impaired access. Do not approach to test stability.
  • Information visible on a notice, a board or a vehicle, only if you can observe it safely. Do not unnecessarily publish vehicle registration numbers, images of people’s faces or other personal data.
  • Keep the original images; send only evidence relevant to the recipient and the purpose of sending it. Do not enter properties to obtain it.

Keep the originals in a safe place. Send only relevant images with your report. For publication, create copies with unnecessary data and identifying features removed.

A copy from which you have removed the photograph’s technical data, such as the date and location recorded by the device, does not replace the original. Nor do these data, taken alone, provide conclusive proof of when or where the photograph was taken.

Include faces, vehicle registration numbers and witnesses’ identities only when they are relevant to the recipient and the purpose of sending the material. Publication on a website serves a different purpose from private submission to an authority.

Mistakes to avoid

  • Declaring any felling illegal simply because you have not seen an endorsement (aviz).
  • Assuming any crown reduction is permitted because it is called ‘toaletare’ (pruning).
  • Determining a tree’s state of health solely from a photograph or the presence of leaves.
  • Automatically applying the forestry regime (regim silvic) to all trees in the town or ruling out any forestry authority’s remit over timber from urban trees.
  • Considering felling illegal simply because you have not seen a forestry mark (marcă silvică) on the tree; the marking regime must be checked in the specific case.
  • Assuming that the mayor’s office administers every yard, row of trees or plot of land with trees.
  • Requesting felling or a fixed number of compensatory plantings without assessing the situation and the applicable obligations.
  • Entering the work area, touching cables, approaching unstable trees or confronting the contractors.

Keep proof and track the time limit

Keep the text actually sent, the evidence actually attached, confirmation of dispatch, confirmation of receipt or registration and any notification of forwarding or extension.

Sending the email, receiving the registration number and receiving the response are three separate events.

Indicative response dates

Indicative dates. Check the registration date with the competent authority and the advance notification of any extension. The calculator does not determine time limits for court or criminal proceedings.

When calculating a time limit in days, do not count the day it starts or the day on which it expires. If the final day is a non-working day, the time limit is extended to the next working day. The calendar covers 2024–2035 and includes Orthodox holidays with variable dates; check any additional days off observed by the institution separately.

Response: 30 days from registration
Possible extension: 45 days in total from the same registration – does not apply automatically
Forwarding: 5 days – a separate time limit

Next steps

  • Keep the text and evidence actually sent, the confirmations of sending, and the registration number and date.
  • If the petition is sent to the wrong authority, that authority must forward it to the responsible authority within 5 days of registration and notify you, under Article 6¹ of Government Ordinance No. 27/2002. Note the date of registration with the responsible authority.
  • The standard time limit for communicating the response is 30 days from the date of registration of the petition. If the petition has been forwarded, the time limit runs from its registration with the responsible public authority or institution. For more detailed enquiries and investigation, the head of the public authority or institution may extend the time limit by no more than 15 days, provided that you are notified of the extension in advance, under Articles 8 and 9 of Government Ordinance No. 27/2002. This is the time limit for communicating the response, not for completing the work.
  • Use the time limit calculator once you know the date of registration of the petition. If the petition has been forwarded, use the date of registration with the responsible public authority or institution. When calculating a time limit in days, the first and last days are not counted, under Article 2.553 of the Civil Code. If the last day of the period is a non-working day, the time limit expires at the end of the next working day, under Article 2.554 of the Civil Code.
  • Check whether the response clarifies the legal regime governing the land and identifies the applicable documents, the responsible person or institution and the measures ordered. For existing documents, use the guide to accessing information of public interest separately.
  • If new facts emerge, describe them and state the registration number and date of the previous petition. If you send the same public authority or institution several petitions about the same issue, they are combined and you receive a single response covering all of them. After the response has been sent, a new petition with the same content, received from you or from a public authority or institution contacted in error, is closed without further action under Article 10 of Government Ordinance No. 27/2002.
  • If you do not receive a response within the statutory time limit, continue with the guide ‘I have not received a response to my petition’.
