Burning waste or vegetation

Prepare a report about the situation you observed.

We help you choose the institution and prepare the text. We do not send anything on your behalf.

Check your safety and choose the appropriate procedure

Is there an immediate danger to people or the environment now?

  • Yes
  • No
  • I cannot assess this

Has anyone been injured or directly threatened?

  • Yes
  • No

What do you want to achieve?

  • Checking and remedying the situation
  • Existing documents or information
  • Challenging a penalty or an act you have received
  • Reporting a possible criminal offence

Is the incident happening now?

  • Yes
  • No
  • First, get to safety and request the necessary intervention. If there is an immediate danger, call 112. Do not fill in the form instead of requesting intervention.
  • Move away from the source of risk. Do not touch suspicious waste or containers. Use the verified contact details for intervention; not every violation justifies a call to 112.
  • Request medical care or intervention, depending on the situation. The criminal procedure is separate from a petition for preventive measures. You can return to this petition once you are safe.
  • Open the FEW guide to accessing public information. Keep the request for documents separate from the request for intervention.
  • Do not automatically use a petition as a substitute for challenging an act or a penalty. Check the special procedure and the applicable time limit.
  • Follow the criminal procedure and check the formal requirements for submission. The time limit calculator for petitions made under Government Ordinance No. 27/2002 does not apply to the criminal procedure.
  • Report the situation using the verified contact details for intervention and, where useful, prepare the written report separately.
  • Continue by identifying the authority and preparing the text.
Read the guide to Law No. 544/2001

112 emergency service

Emergency telephone number. Do not use it as a registry for a petition submitted under Government Ordinance No. 27/2002.

112

The single emergency telephone number available in Romania. It is not intended for submitting an administrative petition.

Tell the operator the location, landmarks and nature of the emergency, and answer their questions. Do not fill in the petition form first.

At all times, 24 hours a day, 7 days a week.

Who is responsible for what

Here you can find contact details for local or county institutions and, where applicable, for a national institution marked ‘National alternative’. Use the explanations in the guide to choose the right recipient for your problem. You send the report; the Foundation does not send anything on your behalf.

The National Environmental Guard (GNM) checks the environmental issue; the Inspectorate for Emergency Situations (ISU) checks fire protection matters. In an emergency, call 112; do not send a petition instead of calling.

  • National Environmental Guard
  • Inspectorate for Emergency Situations (ISU)

You can report the situation to the mayor’s office for local preventive measures and matters within the mayor’s fire protection remit.

  • Mayor’s office

Include the Forest Guard among the recipients if the burning is taking place, or took place, in or near a forest. You do not need to know who owns the forest. Do not automatically assume that the forest is administered by a forestry directorate.

  • National Forest Guard (GFN)

You can also report the situation to the local police, if the locality has a local police force and the facts fall within its remit. If the page does not display contact details for the local police, contact the National Environmental Guard (GNM) and the mayor’s office.

  • Local police

Ask for the remaining materials to be checked, the people responsible to be identified and the legal conditions for bearing the costs to be verified. The fact that you do not know the waste producer or holder is not sufficient for the authority to consider them unknown within the meaning of Article 22(3) of Government Emergency Ordinance No. 92/2021.

  • Mayor’s office

The Romanian Police check road safety matters. If visibility is dangerously reduced or there is another immediate danger, call 112.

  • Romanian Police

Local police

Check the competent institution’s contact details on its official page.

Check whether there is a local police service in the locality or sector concerned, and identify its official page or the page of the mayor’s office. Romanian Police

Check the competent institution’s contact details on its official page.

Identify the Romanian Police unit responsible for the location and nature of the events, and use its verified official contact details. For an administrative petition, use the registry address or petition form; for a criminal complaint, follow the formal requirements and method of submission indicated in the guide. In an emergency, call 112.

Prepare the text without the recipient’s email address

Choose how to proceed: rapid response, a registered petition or both.

Rapid response

  • If you observe a fire, a fire spreading, people in danger, smoke dangerously reducing visibility on the road or another immediate danger, move away from the source of risk and call 112. Give the location and landmarks and describe what you observe. Do not wait until you have completed the petition before calling.
  • Do not approach the fire to take photographs. Do not enter properties or enclosed land, and do not confront the people involved. Do not touch containers, ash or burnt materials.
  • For an incident without immediate danger, use the displayed local contact details for the National Environmental Guard (GNM) or the Inspectorate for Emergency Situations (ISU). A telephone call can help you report the situation, but do not assume that the call has been registered as a petition.
  • If the burning is taking place, or took place, in or near a forest, also notify the responsible Forest Guard. Do not try to measure the distance to the edge of the forest if doing so would require you to approach the fire.
  • If smoke affects traffic, also report the situation to the Romanian Police. For an immediate danger to traffic, call 112.
  • Once you are safe, also send a written report when you need checks, preventive measures and a response. Mention the call or quick report you have already made.

Registered petition

  • Use the petition to ask for checks and measures. You can write on your own behalf or through a legally constituted organisation, under Articles 1 and 2 of Government Ordinance No. 27/2002.
  • Provide the petitioner’s identification details and the address for the response. In these situations, an anonymous petition or one without identification details is closed without further action under Article 7(1) of Government Ordinance No. 27/2002. The exception concerning harassment on grounds of sex or psychological harassment (hărțuire morală) does not apply to these situations. The ordinance does not require you to provide your personal numeric code or submit a copy of your identity document in all cases.
  • Choose the checks and inspection template when you want the burning to be investigated. The National Environmental Guard (GNM) is the main recipient for the environmental aspect; the Inspectorate for Emergency Situations (ISU) checks matters within its remit. You do not need to send the same message automatically to all the institutions displayed.
  • Choose the template for measures after the burning has stopped when you want the remaining materials to be checked, responsibilities to be established and the situation to be prevented from recurring. Do not assume that the mayor’s office must clear every area of land affected by fire. The rule on costs borne by the administrative-territorial unit, set out in Article 22(3) of Government Emergency Ordinance No. 92/2021, concerns abandoned waste and situations where its producer or holder is unknown.
  • Describe the location, date, time period, materials observed and specific effects. Distinguish what you saw from what you assume. For repeated incidents, list the known dates separately.
  • Check the generated text and edit it before sending it. Send it from your own email address, through the official form or at the registry. The email button does not attach photographs; add them yourself and check the list of annexes.
  • You can submit the petition through the official form itself. Keep the submission confirmation. If the form asks for the name of the person you are reporting and you do not know it, do not invent a name; use email when the form does not allow you to describe the actual situation.
  • For a possible criminal offence, a criminal complaint by the injured person and a crime report (denunț) have their own requirements, set out in Articles 289 and 290 of the Code of Criminal Procedure. The petition templates here do not replace them. To submit a criminal complaint or a crime report electronically, you must comply with the legal signature requirements.
  • For copies of reports, permits or other existing documents, make a separate request for information and use the guide to accessing information of public interest, including the explanations about environmental information.
  • Do not use this petition to challenge an official record of an administrative offence (proces-verbal de contravenție) you have received. A complaint challenging an administrative offence record (plângere contravențională) follows its own procedure and has a time limit of 15 days from handover or service, under Article 31 of Government Ordinance No. 2/2001.

If necessary, report the situation using the verified contact details for intervention. Send the written report separately to document the problem and request a response. State in the report that you have already reported the situation.

Prepare the report

Prepare the text. Provide only the necessary details. Check and edit the resulting text.

First answer the safety questions and identify the responsibilities.

After the burning has stopped – checking the remaining materials and preventing the situation from recurring

Petition to the mayor’s office concerning the exercise of local powers, checks on responsibilities for the remaining materials and preventing the burning from recurring. Use this template after the emergency has ended. It does not automatically request the clearance of every area of land affected by fire at the expense of the administrative-territorial unit.

Recipient mayor’s office
Select the mayor’s office responsible for the incident location. Do not choose the locality of your domicile if the incident took place elsewhere.
Petitioner’s identification details
For an individual, give the surname and given name. For an organisation, give its name, registered office and representative’s details.
Locality
Give the locality and county, if you know them.
Location and main landmark
Write the address or main landmark on a single line. Do not enter the land to obtain further details.
Date you observed the situation after the burning
Distinguish the date you observed the remaining materials from the date of the burning, if they differ. Explain the difference in the description.
What remained at the site of the burning?
Describe only what you can observe safely: remaining materials, containers, affected land and continuing risks. Do not touch the materials.
Answers about the situation
Text filled in automatically based on the options selected. Check that it describes the situation after the burning.
Coordinates, optional
Include coordinates only if you choose to and only if they indicate the relevant location.
Evidence and annexes
List the photographs, previous reports and confirmations you are actually sending.
Address for the response
Give the email or postal address for the response.
Name of the person signing
Give the name of the petitioner or the organisation’s representative.
Date drafted
Check the date before sending it.
I have observed remaining materials that appear to be abandoned waste, but I do not know their producer or holder. I request checks on this situation and, if the conditions are met, the application of Article 22(3) and (4) of Government Emergency Ordinance No. 92/2021 on costs borne by the administrative-territorial unit and their recovery once the people responsible have been identified.

Evidence and photographs

  • Note the date, time or approximate time period and the place from which you observed the situation.
  • Give the address, a landmark to help locate the access point and the locality. Coordinates are optional and are added in the browser only at your request.
  • Take photographs only from a safe place: an overall view and a landmark may be enough. Do not move closer to identify the materials.
  • Describe the materials you could see, the apparent direction of the smoke and the effects observed on homes, the road or vegetation. Do not attribute a chemical composition to the smoke without the results of specialist analyses.
  • If the situation recurs, keep a short log of the dates and time periods when you observed it. Do not claim that the same person is responsible for all the incidents if you do not know this.
  • Keep the original photographs and recordings. For sending or publication, use copies from which you have removed unnecessary data and identifying details, without destroying the originals.
  • Mention witnesses and their contact details only if this information is relevant and you have justification for sharing it. Do not unnecessarily publish faces, personal addresses or vehicle registration numbers.
  • You can report the situation without photographs. Do not collect evidence if doing so puts you in danger.

Keep the originals in a safe place. Send only relevant images with your report. For publication, create copies with unnecessary data and identifying features removed.

A copy from which you have removed the photograph’s technical data, such as the date and location recorded by the device, does not replace the original. Nor do these data, taken alone, provide conclusive proof of when or where the photograph was taken.

Include faces, vehicle registration numbers and witnesses’ identities only when they are relevant to the recipient and the purpose of sending the material. Publication on a website serves a different purpose from private submission to an authority.

Mistakes to avoid

  • Completing the form instead of calling 112 for a fire or immediate danger.
  • Approaching the fire, touching burnt remains or entering properties to obtain evidence.
  • Confusing the burning of vegetation on land with any use of fuel in an installation. Describe the specific situation and ask for the applicable rules to be checked.
  • Assuming that a hot work permit (permis de lucru cu focul) or a claim about an approval overrides environmental prohibitions. The existence and effects of the document relied on must be checked; do not assume that it provides for an exemption you do not know about.
  • Claiming that any burning automatically constitutes a criminal offence or, conversely, that a small quantity always rules out criminal liability. Applying Article 66 of Government Emergency Ordinance No. 92/2021 requires checks on the conditions it sets out.
  • Requesting that a fine must be imposed or a particular legal classification established before the facts have been checked.
  • Sending all requests for inspections solely to the mayor’s office, without distinguishing between environmental, fire prevention and forestry responsibilities.
  • Assuming that any ash remaining must be collected immediately by the petitioner or the mayor’s office. The remaining materials and any traces must be assessed by the competent persons.
  • Repeating the same report after receiving a response, without identifying new facts or matters that remain unresolved.

Keep proof and track the time limit

Keep the text actually sent, the evidence actually attached, confirmation of dispatch, confirmation of receipt or registration and any notification of forwarding or extension.

Sending the email, receiving the registration number and receiving the response are three separate events.

Indicative response dates

Indicative dates. Check the registration date with the competent authority and the advance notification of any extension. The calculator does not determine time limits for court or criminal proceedings.

When calculating a time limit in days, do not count the day it starts or the day on which it expires. If the final day is a non-working day, the time limit is extended to the next working day. The calendar covers 2024–2035 and includes Orthodox holidays with variable dates; check any additional days off observed by the institution separately.

Response: 30 days from registration
Possible extension: 45 days in total from the same registration – does not apply automatically
Forwarding: 5 days – a separate time limit

Next steps

  • Keep the text you actually sent, the annexes, proof of dispatch and the confirmations received. Ask for the registration number and date; do not confuse them with a simple automated acknowledgement of receipt.
  • If the authority you contacted is not competent, Article 6¹ of Government Ordinance No. 27/2002 provides for the petition to be forwarded to the competent authority within 5 days of registration and for you to be notified. To calculate the response time limit, track the registration number and date at the competent authority.
  • The general response time limit is 30 days from registration. For more detailed investigations, the head of the public authority or institution may order an extension of no more than 15 days, provided you are notified in advance. Do not assume that the time limit has been extended.
  • Use the time limit calculator for petitions. Under Article 2.553 of the Civil Code, the first and last days are not counted. Under Article 2.554 of the Civil Code, if the last day is a non-working day, the time limit expires on the next working day. Do not count 30 working days and do not automatically add 5 days for forwarding.
  • The response time limit is not a time limit that applies in all cases for completing the clearance or restoration of the land. Check the specific measures, who is responsible for implementing them and the time limit for implementation that has been communicated.
  • If you observe a new fire or a new immediate danger, follow the steps for emergency intervention again. A petition already submitted does not replace reporting a new event.
  • For a new incident that is not an emergency, send additional information with the date and new facts, quoting the previous report’s number. A follow-up does not automatically restart the original time limit.
  • If you do not receive a response or it does not address your requests, follow the ‘I have not received a response to my petition’ guide. For criminal complaints, challenges to a penalty or damages, check the applicable procedure separately.
