Disability classification refused or downgraded: how to challenge an adult disability certificate
Find out how to challenge an adult certificate, what documents to submit and how to keep track of the time limits until the Higher Commission determines the challenge.
We help you choose the institution and prepare the text. We do not send anything on your behalf.
Check your safety and choose the appropriate procedure
Is there an immediate danger to life or health now?
- Yes
- No
- I cannot assess this
What document have you received, or what situation do you want to clarify?
- An adult certificate, including one issued on moving to adult assessment
- A certificate or decision for a child
- A decision of the Higher Commission
- An act concerning the suspension, termination or recovery of benefits
- A verbal refusal or a document I have not received
- I cannot identify the document
What do you want to achieve?
- Re-examination of the certificate received
- Information about a challenge already submitted
- A new assessment for a change that occurred after the certificate was issued
- General rules or other information of public interest
- Access to the documents in my own file
Who will make and sign the challenge?
- The certificate holder
- A representative who can prove their authority to act
- A representative, but the supporting document has not yet been attached
- Someone helping the certificate holder who has no authority to represent them
- I do not know
- First seek the help you need. If there is an immediate danger to life or health, call 112. Do not fill in the form instead of requesting intervention.
- If the person’s condition may require immediate intervention, seek help before continuing. In an emergency, call 112. Continue answering the questions only when you can do so without delaying the help needed.
- This template concerns certificates for adults. For a certificate or decision concerning a child, promptly ask the issuing institution’s secretariat for the complete document and information about how to challenge it and the applicable time limit. Do not use the challenge for adults.
- Check whether the decision determines your challenge or concerns a separate reassessment. Decisions of the Higher Commission may be challenged before the tribunal’s administrative and tax litigation division. Read the steps for bringing court proceedings and keep proof of service; do not submit another identical challenge.
- The document concerning benefits and the disability classification certificate deal with separate matters. Check the issuing authority, how to challenge it and the time limit stated in the document. Challenging the certificate does not automatically replace a challenge to the document concerning benefits.
- You can prepare a petition requesting service of the document and clarification of any previous service. Do not automatically calculate the 30-day time limit without identifying the certificate and the date on which it was served. The petition does not stop a time limit that is already running.
- Prepare the petition asking for information about the challenge. Follow up separately on registration of the challenge with the local commission and with the national authority. This petition does not replace the challenge or extend the time limits for bringing court proceedings.
- Ask the Comprehensive Assessment Service for Adults with Disabilities within the General Directorate for Social Assistance and Child Protection (DGASPC) for guidance on a new assessment following the subsequent change. When the challenge to the previous certificate is determined, the documents and information existing at the time of the assessment are examined.
- Open the Freies Europa Weltanschauung Foundation (FEW) guide to accessing information of public interest under Law No. 544/2001. Do not confuse a request for general information with a challenge to the certificate or a request for access to your own file.
- Contact the institution holding the file and ask about the procedure for accessing your documents. Provide proof of identity or authority to represent. Requesting the documents does not extend the time limit for challenging the certificate.
- Continue preparing the challenge under the special procedure. Check the time limit of 30 calendar days from service of the certificate and the requirements for submitting it to the issuing commission’s secretariat.
- Attach the document proving authority to represent. If the document is missing, the time limit for submitting it is 5 working days from service of the secretariat’s request; failure to submit it within the time limit may lead to the challenge being rejected as inadmissible. State only the capacity in which you are entitled to act.
- You can help the certificate holder fill in the challenge. They can make and sign it personally if the law allows them to act in this way. To act on their behalf, you must be able to prove your authority to represent them. Being related to them is not enough.

A petition is a request, complaint, report or proposal submitted in writing or by email – Article 2 of Government Ordinance No. 27/2002.
You may submit petitions on your own behalf; lawfully constituted organisations may submit petitions on behalf of the groups they represent – Article 1 of Government Ordinance No. 27/2002.
Provide the petitioner’s identification details and the address for the response. Anonymous petitions and petitions without identification details are closed without further action, subject to the specific exception for those concerning harassment on grounds of sex or psychological harassment (hărțuire morală) – Article 7 of Government Ordinance No. 27/2002.
An authority that is not responsible for handling the petition must forward it to the competent authority within 5 days of registration and notify you – Article 6¹ of Government Ordinance No. 27/2002.
The response must be communicated within 30 days of registration of the petition. After forwarding, the period runs from registration with the competent authority – Article 8 of Government Ordinance No. 27/2002.
For more detailed enquiries, the head of the public authority or institution may extend the period by no more than 15 days or, in the energy and natural gas sector, by no more than 30 days, provided that you are notified in advance – Article 9 of Government Ordinance No. 27/2002.
Petitions from the same person about the same issue are dealt with together; a new petition with the same content received after the response has been sent is closed without further action as provided by law – Article 10 of Government Ordinance No. 27/2002.
The response must state the legal basis for the outcome – Article 13 of Government Ordinance No. 27/2002.

Who is responsible for what
Here you can find contact details for local or county institutions and, where applicable, for a national institution marked ‘National alternative’. Use the explanations in the guide to choose the right recipient for your problem. You send the report; the Foundation does not send anything on your behalf.
Submit the challenge to the secretariat of the commission that issued the certificate, even though it is determined by the Higher Commission. This is the procedure set out in Article 87(5) of Law No. 448/2006 and Article 10 of the Regulation on the organisation and functioning of the Higher Evaluation Commission for Adults with Disabilities, approved by Order No. 784/2026.
- Secretariat of the Evaluation Commission for Adults with Disabilities (CEPAH) that issued the certificate
The local commission’s secretariat can confirm registration and transmission of the challenge and the file. After receiving the Higher Commission’s decision, the local commission must serve it on you. A petition asking for information about documents does not alter the time limits for the challenge.
- Secretariat of the Evaluation Commission for Adults with Disabilities (CEPAH) that issued the certificate
To obtain the challenge’s registration number and date and find out the current status of the challenge, contact the National Authority for the Protection of the Rights of Persons with Disabilities (ANPDPD), for the attention of the Secretariat of the Higher Commission. Give the certificate details and details of submission to the local commission, without unnecessarily resending the entire medical file.
- Higher Evaluation Commission for Adults with Disabilities
Ask the secretariat to state which document has been issued and whether it has been served on you. A certificate confirms the granting or refusal of disability classification under Article 87(4) of Law No. 448/2006. A request for clarification does not replace the challenge if its time limit is already running.
- Secretariat of the Evaluation Commission for Adults with Disabilities (CEPAH) that issued the certificate
Decisions of the Higher Commission may be challenged before the tribunal’s administrative and tax litigation division. For an individual, the court for their place of domicile has jurisdiction. The procedure and the date from which the time limit for bringing court proceedings runs must be established according to the type of decision received.
- Tribunal – administrative and tax litigation division
Secretariat of the Evaluation Commission for Adults with Disabilities (CEPAH) that issued the certificate
Check the competent institution’s contact details on its official page.
Identify the commission’s name on the certificate. Look for the secretariat of the commission for adults on the official website of the General Directorate for Social Assistance and Child Protection (DGASPC) in the county or sector where the certificate was issued. Confirm the submission address, opening hours and whether you can send the documents electronically. If you cannot find the institution in the national list, look for it on the official website of the county council or the sector mayor’s office.

Rapid response
- If there is an immediate danger to life or health, seek the help needed and call 112. The form must not delay intervention.
- Keep the certificate, envelope, acknowledgement of receipt and any other proof of service. The certificate’s issue date may differ from the date of service.
- If the time limit for challenging the certificate is about to expire, prepare the challenge and immediately check how you can submit it to the issuing commission’s secretariat. A telephone call or a petition requesting information does not take the place of the challenge.
- For information about a challenge sent to the national authority, you can contact the Secretariat of the Higher Commission on 0314338090, pressing 2. The call does not replace submitting the documents.
- If the loss of entitlements has serious and immediate consequences for you, promptly seek legal guidance on the available measures, including a possible application for suspension. Submitting the challenge does not automatically reinstate benefits.
The written document
- This guide concerns certificates for adults, including the certificate issued on transition to assessment for adults. A different procedure applies to a challenge to a certificate or decision concerning a child.
- Check whether you have a certificate granting or refusing disability classification. A purely verbal refusal does not provide enough information to choose how to challenge it; ask for the written document and information about its service.
- Fill in the challenge using the template in Annex No. 2 to the Regulation on the organisation and functioning of the Higher Evaluation Commission for Adults with Disabilities, approved by Order No. 784/2026. The form must include the certificate holder’s details, details identifying the certificate, the grounds, the attached documents, the date and signature, and the representative’s details where applicable.
- Explain precisely what you are challenging and which document existing at the time of the assessment supports each ground. Describe the functional limitations recorded in the documents, not just the diagnosis. The guide does not determine the degree of disability.
- Check the criteria applicable to the situation assessed. The criteria are approved by Order No. 2.300/1.457/2025, in the version of 20 May 2026. Do not automatically use materials based on the 2007 order.
- In this challenge, the documents and information that existed at the time of the assessment being challenged are examined, including documents that you believe were submitted to the file but were not taken into account. Documents concerning a subsequent deterioration cannot form the basis for changing the disability classification in the same procedure; for a subsequent change in your situation, seek guidance on a separate assessment.
- If you act through a representative, attach proof of authority to represent. If the secretariat requests the missing document, the time limit for supplying it is 5 working days from service of the request. If you do not submit the document within the time limit, the challenge may be rejected as inadmissible.
- Submit the challenge addressed to the Higher Commission to the secretariat of the commission that issued the certificate within 30 calendar days of service. For electronic submission, check which address is accepted and which signature requirements apply. Before using the national form for administrative petitions, check whether it is accepted for submitting the challenge.
- Ask for the number and date of registration of the challenge with the local commission. The secretariat must transmit the challenge, proof of service of the certificate and the file within 5 working days. The assessment file is transmitted by the institution; you do not have to compile the whole file again.
- Separately obtain the number and date of registration with the National Authority for the Protection of the Rights of Persons with Disabilities (ANPDPD). The 60-working-day time limit for determining the challenge is calculated from this date.
- When your challenge is determined, the classification cannot be changed in a way that is less favourable to you. The Higher Commission may separately examine whether the legal conditions for reassessment are met; this protection does not rule out the separate reassessment procedure.
- If the challenge is allowed or rejected on its merits, the decision must be accompanied by Annex A setting out the reasons. The local commission must serve the decision on you within 5 working days of receipt. If the challenge is allowed, this takes effect from the date on which the challenged certificate was issued.
- If the outcome of the challenge remains unfavourable, you can bring proceedings before the tribunal for your place of domicile, in its administrative and tax litigation division. The application is exempt from judicial stamp duty. In this situation, the general time limit for bringing court proceedings is 6 months from service of the decision, under the provisions of Law No. 448/2006 and Law No. 554/2004.
- You can make the court application yourself, in accordance with the law. Prepare the certificate, the challenge, proof of submission and service, the decision and statement of reasons, the relevant documents and your specific requests. The defendants and the acts whose annulment you seek must be determined for your case.
- Do not automatically submit a second prior administrative complaint (plângere prealabilă) after the challenge under the special procedure has been determined. If the challenge has not been determined, in cases of reassessment on the institution’s own initiative (reevaluare din oficiu) or where there are separate acts concerning benefits, have the procedure and time limits applicable to each situation checked. A new petition requesting information does not postpone the time limit for bringing court proceedings.
- Exemption from judicial stamp duty does not exclude other legal costs. If you cannot afford the costs, you can apply for legal aid (ajutor public judiciar) under Government Emergency Ordinance No. 51/2008.
Prepare the document
Prepare the text. Provide only the necessary details. Check and edit the resulting text.
Do not enter your personal numeric code, the series and number of your identity document, other personal identification codes or numbers, or the IBAN of a bank account here, except in fields where the guide expressly asks for them. If they are required and there is no such field, add these codes or numbers to the copy you will send to the institution. Do not enter passwords or bank card details.
The document contains sensitive data. Include only the necessary information and send it directly to the competent institution.
You can ask someone you trust to help you fill in the form. Helping you fill it in does not automatically give them the right to sign or act on your behalf.

Challenge to an adult disability classification certificate
Challenge
For the holder of an adult disability classification certificate or the person representing them in accordance with the law. The template contains the elements of Annex No. 2 to the Regulation on the organisation and functioning of the Higher Evaluation Commission for Adults with Disabilities, approved by Order No. 784/2026. Fill in all applicable elements. If a detail does not exist or does not apply, state the situation without supplying guessed details. Do not use the template for a certificate for a child, a separate act concerning benefits or a challenge to a decision of the Higher Commission.
- Commission that issued the certificate
- Copy the full name and the county or sector from the certificate.
- Holder’s surname and given name
- Fill in the surname and given name of the person for whom the certificate was issued.
- Certificate holder’s domicile or residence
- Include the locality, county or sector, street, number, block, entrance, floor, flat and postcode. If an address element does not exist, write ‘Not applicable’.
- Certificate holder’s identity document
- Specify the identity booklet (buletin) or identity card, the series and number. The statutory form does not ask for the issuer or the identity document’s issue date here.
- Holder’s personal numeric code
- It is required by the statutory form. Fill it in only in the document intended for the institution; do not publish it.
- Certificate holder’s telephone number
- Give a number on which the institution can safely contact the certificate holder. If the certificate holder does not have a telephone, state this.
- Certificate holder’s email address
- Give an address the certificate holder can use safely. If the certificate holder does not have an email address, state this and fill in the postal address correctly.
- Representative’s details or ‘Not applicable’
- If the holder makes the challenge personally, write ‘Not applicable’. If there is a representative, include their surname and given name and the full address of their domicile or residence. For their personal numeric code and the series and number of their identity document, write ‘[Enter the personal numeric code and the series and number of the identity document on the copy sent to the institution]’ in the generator and add these details only to that copy.
- Document proving authority to represent
- If the certificate holder makes the challenge personally, write ‘Not applicable’. Otherwise, identify the document under which you are acting and attach it. State only the authority you have.
- Number of the certificate being challenged
- Copy the number from the certificate.
- Certificate issue date
- Copy the date from the certificate. This does not replace the date of service.
- Date and method of service of the certificate
- State the date of service and the proof available. If you cannot establish the date, explain the situation and ask for it to be checked. Without this date, the calculator cannot determine when the time limit starts.
- Grounds for the challenge
- State what you are challenging, which documents existing at the time of the assessment you rely on and which aspects are wrong or have been omitted. Documents about a subsequent change cannot form the basis for changing the classification in this procedure.
- Your request concerning the certificate
- State specifically what you want to be re-examined. Do not assume that the diagnosis automatically requires a particular degree of disability to be assigned; base your request on the applicable criteria and the functional limitations recorded in the documents.
- Documents attached
- List the documents actually attached. For the assessment documents, follow the note in the statutory form: documents you consider were submitted to the file but were not taken into account. Add proof of authority to represent and proof of service, where applicable.
- Name of the person signing
- The certificate holder or the representative acting in accordance with the law.
- Date drafted
- The date the document is completed; it does not replace the submission date.
I make and sign the challenge personally, as the certificate holder.

Action against the decision on the challenge to an adult disability classification certificate
Statement of claim
You can use this template if you are the adult certificate holder and are asking the court to review the decision by which the Higher Commission determined your challenge. You may make the claim yourself or through a representative who proves their authority to represent you. Choose your requests according to the reason for rejection: a procedural issue or an examination of the disability classification on the merits. Identify precisely the acts and the parts of them that you challenge. Do not use this template for a separate reassessment decision, a child’s certificate, a separate act concerning benefits or the lack of a response to the challenge.
- Court
- Claimant’s surname and given name
- Domicile
- Personal numeric code or assigned identification number
- Other applicable and known identifying details
- Address for communications
- Details for correspondence
- Representation
- Higher Commission’s registered office for service
- Defendant that issued the certificate
- Decision number
- Decision date
- Number of the certificate being challenged
- Certificate issue date
- Commission that issued the certificate
- Outcome and reasons given in the decision
- Specific requests
- Grounds for the court’s jurisdiction
- Date of the challenge
- Registration and proof of submission of the challenge
- Date of service of the act
- Method of service
- Proof of service
- Chronology of the assessment and challenge
- Grounds for the challenge
- Provisions and assessment criteria relied on
- Evidence and the facts supported by each item
- I request an award of costs
- Documents attached
- Date drafted
- Name of the person signing
- Extent of annulment of the decision
- Extent of annulment of the certificate
- Issuing commission’s registered office for service
- Representative’s name
- Representative’s capacity
- Representative’s address
- Document proving authority to represent
Enter your personal details and prepare the annexes only in your own copy of the document. To work without entering personal details on the website, copy the blank template from the page into a document you keep yourself and complete it there, without using the online form. Do not upload identity documents, medical documents, tax documents or other evidence to the website. Give your full name, domicile and the address at which you wish to receive documents served by the court. If you choose another person’s address for service, also name the person responsible for receiving the documents. If you live abroad, also give your elected domicile (domiciliu ales) in Romania for service of documents in the proceedings, under Article 194(a) of the Code of Civil Procedure. The address chosen for service does not, on its own, determine which court has jurisdiction. If you are domiciled abroad, check separately which court has jurisdiction before using the template. Enter the identifiers required by law, if they have been assigned to you, and any other known identifying details. Enter your telephone number and email address if you are providing them for communications. For each person or institution you are bringing proceedings against, use the correct name and address. Do not invent details you do not know. If certain information can only be obtained with the court’s assistance, explain what is missing, which documents you have checked and what check you are asking the court to carry out. Describe the facts in order, with the relevant dates. For each ground of challenge, identify the document or other evidence you rely on. If you propose witnesses, give their names and addresses, where known, and the facts about which they can give evidence. If you request an expert assessment (expertiză), specify which matters need to be clarified. Before signing, check all the requests, amounts, dates and annexes. Remove fields that do not apply. Complete all the fields needed for your situation. Do not file the claim with completion instructions left in place of the details or with statements that do not match your situation.
Set out separately what you challenge in the Higher Commission’s decision and, if you also seek annulment of the certificate, what you challenge in the certificate. Do not seek annulment of favourable provisions that you are not dissatisfied with. Link each ground of challenge to the situation assessed and the relevant documents. A subsequent change in your medical condition does not, on its own, prove that the outcome concerning your earlier situation was wrong. Attach the certificate, the challenge under the special procedure and proof of submission, the contested decision with the statement of reasons received, proof of service and the relevant documents. If a document has not been served on you, state this and request its production in the proceedings. If you are represented, attach proof of your representative’s authority in the form required by Articles 85 and 151 of the Code of Civil Procedure. If you authorise someone who is not a lawyer, a simple document signed between you is not sufficient: the authority to represent you must be proved by an authentic instrument (înscris autentic), usually a notarised power of attorney, or granted orally before the court and entered in the court order recording the hearing (încheiere de ședință). Being related does not replace authorisation. Under Article 83, a person you authorise who is not a lawyer may make submissions on procedural objections and the merits only through a lawyer; the exception concerns a spouse or relative up to and including the second degree, provided they hold a law degree. Statutory representation and representation by a lawyer must be proved by the documents required by law for each situation. The usual time limit for this action is six months from service of the decision determining the challenge under the special procedure. Do not calculate it as 180 days or confuse it with the 30 days for challenging the certificate. A new petition does not extend this time limit. If the time limit has expired or service is unclear, your situation must be assessed individually. File the claim with the tribunal within whose territorial jurisdiction you are domiciled, in its administrative and tax litigation division (secția de contencios administrativ și fiscal), not with the commission’s secretariat. If the claim is made through a representative, it is the certificate holder’s domicile that matters, not the representative’s domicile.

Signature:Sign the statement of claim before filing it. For filing on paper, use a handwritten signature. For submission by email, you can send a legible scan of the signed claim to the court’s official address, under Article 199 of the Code of Civil Procedure, or an electronic document drawn up and signed in accordance with the law. A typed name does not replace a signature. If you cannot sign, contact the court to complete the procedure under Article 148(5) of the same code. For filing on paper, prepare one copy for the court and the copies needed for service on the other parties, with the corresponding annexes, under Articles 149–150 of the Code of Civil Procedure. On the paper copies, write ‘Conform cu originalul’ (‘True copy of the original’) and sign. For electronic copies, you can use an electronic signature under Article 150(2). If you attach documents in a foreign language, include a notarised translation by an authorised translator; if there is no authorised translator for that language, check the exception under Article 150(4). Keep the originals. You can file the claim at the court registry or send it by a method permitted by law. Check the official address and the technical requirements. If you send the claim by email, check that the court has received it: proof of filing within the time limit depends on the date and time certified by the court’s computer, not just the time when you pressed the send button. If you use the post, send it by registered letter and keep the receipt. If you use an express courier or a specialised document delivery service, keep proof of handing it over within the time limit, under Article 183 of the Code of Civil Procedure. Do not assume that every contact form serves as a court registry for case filings. Monitor communications from the court and the time limit it gives you to complete or supplement your claim. Exemption from judicial stamp duty does not rule out other costs or the possibility of being ordered to pay the other party’s costs, in accordance with the law. The generator does not sign or file the claim.
Evidence and photographs
- The certificate being challenged, including the pages with information on how to challenge it.
- Proof of service: an acknowledgement of receipt, envelope, message or other document showing the date and method of service.
- A list of the documents in the assessment file and an explanation of the point each one supports.
- Copies of documents that you consider were submitted for the assessment but were not taken into account, as indicated in the statutory form.
- The document proving authority to represent, if you submit the challenge through a representative.
- The copy of the challenge actually submitted and proof of submission.
- The local registration number and date, the date and confirmation of the file’s transmission to the national authority, and the registration number and date at that authority.
- The Higher Commission’s decision, Annex A containing the statement of reasons where required, and proof of service.
Keep the originals in a safe place. Send only relevant images with your report. For publication, create copies with unnecessary data and identifying features removed.
A copy from which you have removed the photograph’s technical data, such as the date and location recorded by the device, does not replace the original. Nor do these data, taken alone, provide conclusive proof of when or where the photograph was taken.
Include faces, vehicle registration numbers and witnesses’ identities only when they are relevant to the recipient and the purpose of sending the material. Publication on a website serves a different purpose from private submission to an authority.
Mistakes to avoid
- Counting the 30 days from the date the certificate was issued without checking when it was served.
- Sending a general petition instead of a challenge under the special procedure.
- Assuming that you can validly submit the challenge to any email address of the county directorate.
- Counting the 60 working days solely from the date of local submission.
- Applying the procedure for adults when challenging a certificate for a child.
- Confusing the disability classification certificate with a separate act concerning the suspension, termination or recovery of benefits.
- Relying solely on a subsequent deterioration to change the outcome of the earlier assessment through this challenge.
- Assuming that a family relationship automatically gives you authority to represent someone.
- Interpreting the prohibition on changing your classification to your disadvantage when deciding your challenge as a prohibition on any separate reassessment.
- Waiting for a response to a petition to follow up on documents until the time limit for bringing court proceedings expires.
- Publishing the certificate, personal numeric code or medical documents.
Keep proof and track the time limit
Keep the text actually sent, the evidence actually attached, confirmation of dispatch, confirmation of receipt or registration and any notification of forwarding or extension.
Sending the email, receiving the registration number and receiving the response are three separate events.
Indicative response dates
Indicative dates. Check the registration date with the competent authority and the advance notification of any extension. The calculator does not determine time limits for court or criminal proceedings.
When calculating a time limit in days, do not count the day it starts or the day on which it expires. If the final day is a non-working day, the time limit is extended to the next working day. The calendar covers 2024–2035 and includes Orthodox holidays with variable dates; check any additional days off observed by the institution separately.
- Response: 30 days from registration
- Possible extension: 45 days in total from the same registration – does not apply automatically
- Forwarding: 5 days – a separate time limit
Time limits for your submission
If you do not know the date needed for the calculation, ask for confirmation. The date drafted does not replace service or registration.
Submitting the challenge to the certificate for an adult
30 calendar days
Service of the certificate being challenged.
Articles 2.551, 2.553 and 2.554 of the Civil Code: the day of service and the day on which the time limit expires are not counted; if the expiry date is a non-working day, the time limit is extended until the end of the next working day. For submission at an office, closing time must be taken into account; Article 2.556 applies to submission by post.
The time limit is not calculated from the date the certificate was issued. If you do not know the date of service, the calculator shows you the rule and asks you to clarify the date. The time limit concerns submission of the challenge to the secretariat of the issuing commission; do not assume that sending a message to any institution meets this time limit.
Submitting the document proving authority to represent
5 working days
Service of the secretariat’s request to submit the document proving authority to represent.
Articles 2.551, 2.553 and 2.554 of the Civil Code, with the period expressed in working days under Article 10(3) of the Regulation approved by Order No. 784/2026. Exclude the day of service and the day on which the time limit expires and count only the intervening working days.
Failure to submit the document proving authority to represent within the time limit may result in the challenge being rejected as inadmissible. The calculation uses the working calendar applicable to the institution, taking account of public holidays and any additional days off designated for public sector employees.
Forwarding of the challenge and case file by the local secretariat
5 working days
Registration of the challenge with the secretariat of the commission that issued the certificate.
Articles 2.551, 2.553 and 2.554 of the Civil Code, with the period in working days specified in Article 11(1) of the Regulation approved by Order No. 784/2026; exclude the day of registration and the day on which the time limit expires.
The time limit applies to the institution and concerns forwarding the challenge, proof of service of the certificate and the assessment file. It is not the time limit for determining the challenge. Do not confuse the date of submission to the local commission with the date of registration with the national authority.
Determination of the challenge by the Higher Commission
60 working days
Registration of the challenge at the registry of the National Authority for the Protection of the Rights of Persons with Disabilities (ANPDPD).
Articles 2.551, 2.553 and 2.554 of the Civil Code, with the period in working days specified in Article 90²(5) of Law No. 448/2006. Exclude the day of registration and the day on which the time limit expires and count only the intervening working days.
Find out separately when the challenge was registered with the national authority. Do not automatically add 60 calendar days or calculate the time limit from the date the challenge was drafted or submitted to the local commission. Exceeding the time limit does not mean that the challenge is allowed.
Service of the decision by the local commission
5 working days
Receipt of the Higher Commission’s decision by the local commission that issued the certificate.
Articles 2.551, 2.553 and 2.554 of the Civil Code, with the period in working days specified in Article 14(13) of the Regulation approved by Order No. 784/2026; exclude the day of receipt and the day on which the time limit expires.
The calculator can show the deadline only if you know when the local commission received the decision. The date of receipt by the local commission is not necessarily the same as the date the decision was issued.
Court proceedings against the outcome of the challenge
6 months
Service of the decision determining the challenge under the special procedure.
Articles 2.552 and 2.554 of the Civil Code: the time limit expires on the corresponding day of the sixth month; if there is no corresponding day, it expires on the last day of that month; the extension for a non-working day applies. Articles 181–183 of the Code of Civil Procedure must also be taken into account when submitting the document to the court.
Article 90²(4) of Law No. 448/2006 applies together with Article 11(1)(a) of Law No. 554/2004 to determine the time limit. Do not convert it into 180 days. It does not automatically apply to a decision on a reassessment on the institution’s own initiative (reevaluare din oficiu) or to a separate act concerning benefits. Any exceptional cases in which the time limit is exceeded must be assessed individually.
Court proceedings for failure to determine the challenge within the time limit
6 months
Expiry of the statutory time limit for determining the challenge, if the proceedings concern failure to determine it.
Articles 2.552 and 2.554 of the Civil Code; for submission to the court, Articles 181–183 of the Code of Civil Procedure.
Legal basis: Article 11(1)(c) of Law No. 554/2004. This time limit is shown separately from the one calculated from service of a decision. Check the date from which the time limit runs, the subject of your claim and the institutions against which you are bringing proceedings in your case. A petition to follow up on documents does not automatically start a new time limit.
Forwarding the petition to follow up on documents to the competent institution
5 calendar days
Registration of the petition to follow up on documents with an institution that is not competent to handle it.
Articles 2.551, 2.553 and 2.554 of the Civil Code.
This applies only to the administrative petition to follow up on documents. It is not the rule for submitting a challenge under the special procedure.
Response to the petition to follow up on documents
30 calendar days
Registration of the petition to follow up on documents with the competent institution.
Articles 2.551, 2.553 and 2.554 of the Civil Code: exclude the first and last days and apply the extension for a non-working day.
This applies only to the petition to follow up on documents submitted under Government Ordinance No. 27/2002. It does not replace the time limit of 60 working days for determining the challenge.
Extension of the response time limit for the petition to follow up on documents
15 calendar days
End of the initial response period, only if the extension has been ordered and notified in advance.
Article 9 of Government Ordinance No. 27/2002, together with Articles 2.551, 2.553 and 2.554 of the Civil Code. Calculate the total period of 30 days plus the extension actually ordered, of no more than 15 days, from the same registration date, without excluding the first and last days twice.
Do not automatically add 15 days. The calculator asks you to specify whether you have received notification of an extension and how long the extension is. The extension does not change the time limit for challenging the certificate or for bringing court proceedings.
Use this time limit as a guide and check whether it applies to your situation.
Next steps
- Check that the proof of submission shows the institution, date and document sent.
- Follow up separately on local registration and registration with the national authority.
- Respond immediately to requests to complete your submission and keep proof of your response.
- If the case file has not been forwarded or you do not know the number and date of registration of the challenge with the national authority, use the template for following up on documents.
- If the special time limit for determining the challenge has expired, ask for the current status of the challenge and check separately whether you can bring court proceedings. Do not treat the petition requesting this information as an additional mandatory step.
- After receiving the decision, check the statement of reasons and note the date of service before deciding what to do next.
- If the challenge is allowed, keep the decision and check that it is implemented by the institutions granting the relevant entitlements.
- If there are documents or changes in your health that postdate the assessment, ask for guidance on the appropriate separate procedure.
