Abandoned waste beside a public road

Prepare a report about the situation you observed.

We help you choose the institution and prepare the text. We do not send anything on your behalf.

Check your safety and choose the appropriate procedure

Is there an immediate danger to people or the environment now?

  • Yes
  • No
  • I cannot assess this

Has anyone been injured or directly threatened?

  • Yes
  • No

What do you want to achieve?

  • Checking and remedying the situation
  • Existing documents or information
  • Challenging a penalty or an act you have received
  • Reporting a possible criminal offence

Is the incident happening now?

  • Yes
  • No
  • First, get to safety and request the necessary intervention. If there is an immediate danger, call 112. Do not fill in the form instead of requesting intervention.
  • Move away from the source of risk. Do not touch suspicious waste or containers. Use the verified contact details for intervention; not every violation justifies a call to 112.
  • Request medical care or intervention, depending on the situation. The criminal procedure is separate from a petition for preventive measures. You can return to this petition once you are safe.
  • Open the FEW guide to accessing public information. Keep the request for documents separate from the request for intervention.
  • Do not automatically use a petition as a substitute for challenging an act or a penalty. Check the special procedure and the applicable time limit.
  • Follow the criminal procedure and check the formal requirements for submission. The time limit calculator for petitions made under Government Ordinance No. 27/2002 does not apply to the criminal procedure.
  • Report the situation using the verified contact details for intervention and, where useful, prepare the written report separately.
  • Continue by identifying the authority and preparing the text.
Read the guide to Law No. 544/2001

Who is responsible for what

Here you can find contact details for local or county institutions and, where applicable, for a national institution marked ‘National alternative’. Use the explanations in the guide to choose the right recipient for your problem. You send the report; the Foundation does not send anything on your behalf.

You can report abandoned waste to the National Environmental Guard (GNM) for checks on compliance with the law, as it has powers to inspect and impose penalties under Article 61 and Article 62(2) of Government Emergency Ordinance No. 92/2021. Use contact details confirmed by official sources for the county where the reported site is located; if they are not displayed, you can use the address marked ‘National alternative’.

  • National Environmental Guard

Contact the mayor’s office to have the situation checked: when the waste producer or holder is unknown, the commune, town or municipality bears the costs of cleaning up the site and managing the waste under Article 22(3)–(4) of Government Emergency Ordinance No. 92/2021. The fact that a person owns the land does not automatically mean they are liable for these costs; the waste producer or holder identified subsequently must bear them.

  • Mayor’s office

For a national road section within a municipality’s built-up area (intravilan), contact the mayor’s office: Article 21(1)–(2) of Government Ordinance No. 43/1997 provides for administration by the local council. Ask for confirmation of who administers the reported road section, as specific legal instruments governing its administration may exist.

  • Mayor’s office

You can contact the National Company for Road Infrastructure Administration (CNAIR), which generally administers national roads in communes and towns that do not have municipality status under Article 21(1)–(2) of Government Ordinance No. 43/1997. Ask for confirmation of who administers the reported road section, as specific legal instruments governing its administration may exist.

  • National Company for Road Infrastructure Administration (CNAIR)

You can contact the National Company for Road Infrastructure Administration (CNAIR), which generally administers national roads outside municipalities’ built-up areas (intravilan) under Article 21(1)–(2) of Government Ordinance No. 43/1997. Ask for confirmation of who administers the reported road section, as specific legal instruments governing its administration may exist.

  • National Company for Road Infrastructure Administration (CNAIR)

Contact the mayor’s office for a county road section within the built-up area (intravilan) of a town or municipality, as Article 22 of Government Ordinance No. 43/1997 provides that these sections are administered by local councils.

  • Mayor’s office

Contact the county council, as it administers the county road within the commune’s territory, including sections passing through villages, under Article 22 of Government Ordinance No. 43/1997.

  • County council

Contact the county council: it administers the county road section outside the built-up area (intravilan) of the town or municipality under Article 22 of Government Ordinance No. 43/1997.

  • County council

Contact the mayor’s office, as communal roads and streets are administered by the local council under Article 22 of Government Ordinance No. 43/1997. If the waste is on adjoining private land, proximity to the road alone does not mean that the road administrator is also responsible for that land.

  • Mayor’s office

If you cannot determine the road category, ask the mayor’s office to identify the administrator of the section where you observed the waste. If the matter falls within another institution’s remit, the mayor’s office must forward the report to it within 5 days of the report’s registration with the mayor’s office and notify you that it has been forwarded. The standard response time limit of 30 days starts from the date on which the report is registered with the competent institution under Article 6¹ and Article 8(2) of Government Ordinance No. 27/2002.

  • Mayor’s office

Ask the mayor’s office to confirm whether the reported site is within the territory of a commune, town or municipality and who administers the road; indicate the location on a map and any known landmarks. If the matter falls within another institution’s remit, the report must be forwarded to it, and the response time limit starts from the date on which the report is registered with the competent institution under Article 6¹ and Article 8(2) of Government Ordinance No. 27/2002.

  • Mayor’s office

Ask the mayor’s office to check whether the road section is within the built-up area (intravilan) and who administers it; the name of the town or municipality is not sufficient to establish the administrator. If the matter falls within another institution’s remit, the report must be forwarded to it, and the response time limit starts from the date on which the report is registered with the competent institution under Article 6¹ and Article 8(2) of Government Ordinance No. 27/2002.

County council

Check the competent institution’s contact details on its official page.

Identify the county where the reported location is situated and use the county council’s registry address or official petition form. Check the responsibility indicated in the guide; if you do not know the responsible institution or administrator, ask for the recipient to be identified and, where applicable, for the petition to be forwarded to the competent authority.

Prepare the text without the recipient’s email address

Choose how to proceed: rapid response, a registered petition or both.

Rapid response

  • In the event of immediate danger, follow the steps for an emergency response.
  • For an obstruction on the road, use the verified contact details for road incident response.
  • If waste is being unloaded now, notify the inspection authority using its verified contact details. Do not confront the people involved.

Registered petition

  • Send the report to the competent inspection authority.
  • Send the administrator a separate report, only for matters within its responsibilities.
  • Request the registration number, the necessary measures and information about forwarding.

If necessary, report the situation using the verified contact details for intervention. Send the written report separately to document the problem and request a response. State in the report that you have already reported the situation.

Prepare the report

Prepare the text. Provide only the necessary details. Check and edit the resulting text.

First answer the safety questions and identify the responsibilities.

I request that the situation be investigated, the responsibilities for administration identified and, within your remit, measures taken to remove the waste, restore the site and prevent the situation from recurring. If road safety is affected, I request the necessary warning measures and measures to make the area safe.

I submit this petition under Government Ordinance No. 27/2002 and request examination of the relevant obligations under Government Emergency Ordinance No. 92/2021 and Government Ordinance No. 43/1997, according to the specific legal regime governing the site.

Please communicate the registration number, the findings of the checks and the measures ordered, stating the legal basis for the outcome. For matters outside your remit, I request that the petition be forwarded under Article 6¹ of Government Ordinance No. 27/2002 and that I be notified of this forwarding.

Evidence and photographs

  • An overview photograph taken from a safe place.
  • A landmark, the road designation or, optionally, the site coordinates.
  • The observation date and a description of the approximate extent of the area containing waste.
  • Observed effects on traffic or rainwater drainage, such as blocked ditches or roadside drains.

Keep the originals in a safe place. Send only relevant images with your report. For publication, create copies with unnecessary data and identifying features removed.

A copy from which you have removed the photograph’s technical data, such as the date and location recorded by the device, does not replace the original. Nor do these data, taken alone, provide conclusive proof of when or where the photograph was taken.

Include faces, vehicle registration numbers and witnesses’ identities only when they are relevant to the recipient and the purpose of sending the material. Publication on a website serves a different purpose from private submission to an authority.

Mistakes to avoid

  • Assuming that the road designation ‘DN’ is sufficient to identify the administrator.
  • Entering the carriageway to take photographs.
  • Attributing the abandonment of waste to a person without direct observations.
  • Assuming that the inspection authority will carry out the clean-up itself.

Keep proof and track the time limit

Keep the text actually sent, the evidence actually attached, confirmation of dispatch, confirmation of receipt or registration and any notification of forwarding or extension.

Sending the email, receiving the registration number and receiving the response are three separate events.

Indicative response dates

Indicative dates. Check the registration date with the competent authority and the advance notification of any extension. The calculator does not determine time limits for court or criminal proceedings.

When calculating a time limit in days, do not count the day it starts or the day on which it expires. If the final day is a non-working day, the time limit is extended to the next working day. The calendar covers 2024–2035 and includes Orthodox holidays with variable dates; check any additional days off observed by the institution separately.

Response: 30 days from registration
Possible extension: 45 days in total from the same registration – does not apply automatically
Forwarding: 5 days – a separate time limit

Next steps

  • Keep the text and evidence actually sent.
  • Note the registration number and date for each authority.
  • Use the time limit calculator after checking the applicable calculation rule and the date from which the time limit starts to run.
  • If you do not receive a response, continue with the guide ‘I have not received a response to my petition’.
