Abandoned waste in a forest or on a bank or shore

Prepare a report about the situation you observed.

We help you choose the institution and prepare the text. We do not send anything on your behalf.

Check your safety and choose the appropriate procedure

Is there an immediate danger to people or the environment now?

  • Yes
  • No
  • I cannot assess this

Has anyone been injured or directly threatened?

  • Yes
  • No

What do you want to achieve?

  • Checking and remedying the situation
  • Existing documents or information
  • Challenging a penalty or an act you have received
  • Reporting a possible criminal offence

Is the incident happening now?

  • Yes
  • No
  • First, get to safety and request the necessary intervention. If there is an immediate danger, call 112. Do not fill in the form instead of requesting intervention.
  • Move away from the source of risk. Do not touch suspicious waste or containers. Use the verified contact details for intervention; not every violation justifies a call to 112.
  • Request medical care or intervention, depending on the situation. The criminal procedure is separate from a petition for preventive measures. You can return to this petition once you are safe.
  • Open the FEW guide to accessing public information. Keep the request for documents separate from the request for intervention.
  • Do not automatically use a petition as a substitute for challenging an act or a penalty. Check the special procedure and the applicable time limit.
  • Follow the criminal procedure and check the formal requirements for submission. The time limit calculator for petitions made under Government Ordinance No. 27/2002 does not apply to the criminal procedure.
  • Report the situation using the verified contact details for intervention and, where useful, prepare the written report separately.
  • Continue by identifying the authority and preparing the text.

Who is responsible for what

Here you can find contact details for local or county institutions and, where applicable, for a national institution marked ‘National alternative’. Use the explanations in the guide to choose the right recipient for your problem. You send the report; the Foundation does not send anything on your behalf.

You can report the abandoned waste at the site concerned to the National Environmental Guard (GNM) for checks on compliance with the law, as it has powers to inspect and impose penalties in relation to waste under Article 61 and Article 62(2) of Government Emergency Ordinance No. 92/2021.

  • National Environmental Guard

If the land is forest land, or you are unsure whether it is, you can ask the National Forest Guard (GFN) to check the situation and compliance with forest guarding obligations. The guarding regulations must include an obligation for forestry staff with guarding duties to take measures to prevent and combat the depositing of waste on land within the national forest estate (fondul forestier național), under Article 94(2)(d) of Law No. 331/2024 – the Forestry Code.

  • National Forest Guard (GFN)

You can notify the forest administrator or forest district (ocol silvic) of the waste observed, as administration and forestry services are provided through authorised forest districts under Article 12 of Law No. 331/2024 – the Forestry Code. If you contact a private administrator or forest district, do not assume that the response time limits for petitions to public institutions automatically apply to it.

  • Forest administrator or forest district (ocol silvic)

You can also report the matter to the ‘Apele Române’ National Administration (ANAR) when the waste is in the bed of a watercourse, in a lake or pond, or on their banks or shores, including where these places are in a private forest. The law prohibits throwing or depositing waste in these places, and the administration’s authorised staff can establish that administrative offences (contravenții) have been committed and impose the corresponding penalties under Article 16(1)(c) and Article 90 of Water Law No. 107/1996.

  • ‘Apele Române’ National Administration (ANAR)

You can also report the matter to the mayor’s office to have the situation checked: when the waste producer or holder is unknown, the commune, town or municipality bears the costs of cleaning up the site and managing the waste under Article 22(3)–(4) of Government Emergency Ordinance No. 92/2021. In this situation, the obligation also applies if the landowner is unknown; the waste producer or holder identified subsequently must bear the costs.

Mayor’s office

Check the competent institution’s contact details on its official page.

Identify the mayor’s office responsible for the location and subject of the report and use its registry address or official petition form. In București, check whether responsibility lies with the municipality or sector authorities. If you do not know the responsible institution or administrator, ask for the recipient to be identified and, where applicable, for the petition to be forwarded to the competent authority.

Prepare the text without the recipient’s email address

Choose how to proceed: rapid response, a registered petition or both.

Rapid response

  • In the event of a fire or immediate danger, follow the steps for an emergency response.
  • Notify the administrator using only verified contact details.
  • If you are observing effects on a watercourse, lake or pond right now, use the verified contact details for response services in that area.

Registered petition

  • Choose a main recipient to carry out checks.
  • Also choose a water management authority as a recipient only if the waste is in the bed of a watercourse, in a lake or pond, or on their banks or shores.
  • Keep the notification to the private owner separate from the petition to the authority.

If necessary, report the situation using the verified contact details for intervention. Send the written report separately to document the problem and request a response. State in the report that you have already reported the situation.

Prepare the report

Prepare the text. Provide only the necessary details. Check and edit the resulting text.

Evidence and photographs

  • An overview image and a landmark for access.
  • The position of the waste in relation to the watercourse, lake or pond: in the bed, on the bank or shore, or at a distance from them.
  • A description of visible effects, without conclusions about chemical composition.
  • Optional coordinates and their accuracy, if available.

Keep the originals in a safe place. Send only relevant images with your report. For publication, create copies with unnecessary data and identifying features removed.

A copy from which you have removed the photograph’s technical data, such as the date and location recorded by the device, does not replace the original. Nor do these data, taken alone, provide conclusive proof of when or where the photograph was taken.

Include faces, vehicle registration numbers and witnesses’ identities only when they are relevant to the recipient and the purpose of sending the material. Publication on a website serves a different purpose from private submission to an authority.

Mistakes to avoid

  • Confusing the owner with the inspection authority.
  • Identifying the competent water management authority solely on the basis of the county.
  • Presenting pollution as proven without checks.
  • Touching containers or climbing down unstable banks.

Keep proof and track the time limit

Keep the text actually sent, the evidence actually attached, confirmation of dispatch, confirmation of receipt or registration and any notification of forwarding or extension.

Sending the email, receiving the registration number and receiving the response are three separate events.

Indicative response dates

Indicative dates. Check the registration date with the competent authority and the advance notification of any extension. The calculator does not determine time limits for court or criminal proceedings.

When calculating a time limit in days, do not count the day it starts or the day on which it expires. If the final day is a non-working day, the time limit is extended to the next working day. The calendar covers 2024–2035 and includes Orthodox holidays with variable dates; check any additional days off observed by the institution separately.

Response: 30 days from registration
Possible extension: 45 days in total from the same registration – does not apply automatically
Forwarding: 5 days – a separate time limit

Next steps

  • Keep the acknowledgements separately for each recipient.
  • Follow up on any forwarding.
  • Do not calculate a statutory response time limit for a private recipient without checking whether the procedure in question applies to it.
  • Continue with the guide ‘I have not received a response to my petition’, where applicable.
