Dangerous potholes and uneven surfaces on the carriageway or pavement

Prepare a report about the situation you observed.

We help you choose the institution and prepare the text. We do not send anything on your behalf.

Check your safety and choose the appropriate procedure

Is there an immediate danger or a road traffic accident involving injuries?

  • Yes
  • No
  • I do not know

Has an incident already occurred because of the defect?

  • Yes, involving a vehicle; as far as I know, there was only property damage
  • Yes, a pedestrian fell or was injured, without a moving vehicle being involved
  • No
  • I do not know

What do you want to achieve?

  • Assessing the danger and repairing the defect
  • Existing documents or information
  • Reporting a possible criminal offence
  • Challenging an official record of an administrative offence (proces-verbal de contravenție) that I have received
  • Damages for loss or damage
  • I do not know
  • Call 112 and state the location and the danger. For a road traffic accident involving injuries, Article 77 of Government Emergency Ordinance No. 195/2002 requires the police to be notified immediately and 112 to be called under the conditions set out in that Article. Do not enter traffic to take photographs and do not alter the traces left by the accident. Follow the instructions of the call handler and the emergency crews. Prepare the petition separately, once the emergency has been dealt with.
  • Stay in a safe place and do not go closer to assess the defect. If there are signs of immediate danger, injured people or an ongoing collapse, call 112. If the damage does not amount to an emergency, report what you have observed to the administrator or the police and continue preparing the petition.
  • Do not use this petition as a substitute for the official recording of an accident. For drivers involved in a road traffic accident resulting only in property damage, Article 79(1)(b) of Government Emergency Ordinance No. 195/2002 requires them to report to the competent police unit no more than 24 hours after the event. Article 79(2) of Government Emergency Ordinance No. 195/2002 provides exceptions for an agreed accident statement (constatare amiabilă) under the conditions laid down by law and for a driver with voluntary motor damage insurance where only their own vehicle has been damaged. Do not assume that damage caused by a pothole can be dealt with through an agreed accident statement with the road administrator. Clarify the procedure immediately with the police or your insurer, as appropriate. To report the defect, prepare the petition below separately.
  • Seek medical care; in an emergency, call 112. A simple fall without a moving vehicle being involved does not, in itself, constitute a road traffic accident within the meaning of Article 75 of Government Emergency Ordinance No. 195/2002. Keep the relevant documents. The petition concerning pavement safety and the steps to seek any damages are separate.
  • If you cannot tell whether anyone has been injured, do not assume there has only been property damage. If there are signs of injury or immediate danger, call 112. If you were involved in the incident with a vehicle, promptly clarify with the police your obligations concerning the official recording of the accident, without waiting for the response to the petition. You can report the defect separately.
  • Continue with the questions about the location, administrator and defect. You will be able to prepare separate requests for an inspection and for remedial action.
  • Use the guide to accessing information of public interest. Make a separate request for existing documents, such as the works contract or a works acceptance record (proces-verbal de recepție). A request for documents does not replace reporting a current danger.
  • Submit a criminal complaint or a crime report (denunț) under Articles 289 and 290 of the Code of Criminal Procedure. You can make the complaint orally, for it to be recorded by the competent body, or in a signed document; electronic submission must meet the statutory signature requirements. The petition template here does not replace this procedure.
  • Do not use the petition to challenge the official record. Article 31 of Government Ordinance No. 2/2001 sets a time limit of 15 days from the date it is handed to you or served on you. Check the court procedure and the applicable special rules; do not wait for the response to a petition before checking the time limit.
  • Keep the evidence, documents recording the findings, estimates, invoices and relevant medical documents. Article 5(6) of Government Emergency Ordinance No. 195/2002 provides for liability under the conditions laid down by law, not automatic payment of damages. Check the insurance, the person responsible and the appropriate legal procedure separately. Use the petition separately to request hazard warnings and repair of the defect.
  • To have the situation checked and the defect repaired, continue with the petition. For existing documents, use the guide to accessing information of public interest. If you have received a penalty or have been involved in an incident, check the applicable procedure and time limit separately. Do not use a petition as a substitute for that procedure.

Who is responsible for what

Here you can find contact details for local or county institutions and, where applicable, for a national institution marked ‘National alternative’. Use the explanations in the guide to choose the right recipient for your problem. You send the report; the Foundation does not send anything on your behalf.

The Romanian Police check road safety. Select the recipient of the petition concerning road administration and repair of the defect separately.

  • Romanian Police

Contact the confirmed local administrator of the road section, including where a temporary transfer of administration is documented.

  • Mayor’s office

Contact the confirmed county administrator of the road section concerned.

  • County council

Contact the unit of the National Company for Road Infrastructure Administration (CNAIR) that administers the road section, according to the confirmed information.

  • National Company for Road Infrastructure Administration (CNAIR)

Keep the administrator identified in the official document as the recipient. Check its contact details separately and whether Government Ordinance No. 27/2002 regulating the handling of petitions applies to it.

  • Confirmed administrator of the road section

For sections of national road within a municipality’s built-up area (intravilan), Article 21(2) of Government Ordinance No. 43/1997 provides for administration by the local council. Check any special instruments applicable to the road section.

  • Mayor’s office

For national roads outside the built-up area (extravilan), start with the contact details shown for national roads and ask for confirmation of the administrator of the road section concerned.

  • National Company for Road Infrastructure Administration (CNAIR)

The exception under Article 21(2) of Government Ordinance No. 43/1997 concerns municipalities and does not automatically apply to towns or communes.

  • National Company for Road Infrastructure Administration (CNAIR)

Two recipient options are displayed to clarify who administers the road. Ask to be told who administers the road section; you are not required to send the petition to both recipients at the same time.

  • Mayor’s office
  • National Company for Road Infrastructure Administration (CNAIR)

To apply the exception to the rule on the administration of national roads, you need to know the type of administrative-territorial unit. Do not infer it from the locality’s name alone.

  • Mayor’s office
  • National Company for Road Infrastructure Administration (CNAIR)

For sections of county road within the built-up area (intravilan) of a town or municipality, Article 22 of Government Ordinance No. 43/1997 provides for administration by the local council.

  • Mayor’s office

For county roads outside the built-up area (extravilan), the rule is county administration, subject to the specific instruments concerning the road section.

  • County council

The exception for county roads within the built-up areas (intravilan) of urban localities does not apply simply because the road passes through a village.

  • County council

Ask for clarification of the built-up area (intravilan) boundary and of who administers the road. The two recipients shown can help you identify the administrator; listing them does not mean they have joint liability.

  • Mayor’s office
  • County council

Confirm whether the county road section is in a town, a municipality or a commune before applying the exception to the rule on administration.

  • Mayor’s office
  • County council

For roads of local interest, the rule is administration by the local council. The mayor’s office can identify the service or designated administrator.

  • Mayor’s office

Use the contact details shown for roads of national interest to identify the administrator of the motorway or expressway. Do not assume local administration simply because the road runs through a municipality’s territory.

  • National Company for Road Infrastructure Administration (CNAIR)

First contact the mayor’s office to identify the administrator using the address and landmarks. This recommendation does not mean that the mayor’s office is automatically responsible for the repair.

  • Mayor’s office

Also inform the identified works contractor. Local police appear among the recipients only if they exist; their duties do not replace checks by the traffic police.

  • Works contractor
  • Local police

Once you have identified the operator, you can also send it the technical information about the problem. Listing it as a recipient does not automatically mean that it owns the cover and does not replace a report to the road administrator.

  • Identified operator or holder of the inspection chamber or network

Romanian Police

Check the competent institution’s contact details on its official page.

Identify the Romanian Police unit responsible for the location and nature of the events, and use its verified official contact details. For an administrative petition, use the registry address or petition form; for a criminal complaint, follow the formal requirements and method of submission indicated in the guide. In an emergency, call 112.

Mayor’s office

Check the competent institution’s contact details on its official page.

Identify the mayor’s office responsible for the location and subject of the report and use its registry address or official petition form. In București, check whether responsibility lies with the municipality or sector authorities. If you do not know the responsible institution or administrator, ask for the recipient to be identified and, where applicable, for the petition to be forwarded to the competent authority.

Prepare the text without the recipient’s email address

County council

Check the competent institution’s contact details on its official page.

Identify the county where the reported location is situated and use the county council’s registry address or official petition form. Check the responsibility indicated in the guide; if you do not know the responsible institution or administrator, ask for the recipient to be identified and, where applicable, for the petition to be forwarded to the competent authority.

Confirmed administrator of the road section

Check the competent institution’s contact details on its official page.

Use the name of the entity stated in the instrument governing administration or on the official page for the road section, and its official contact details. If you cannot confirm the recipient, ask the mayor’s office, county council or National Company for Road Infrastructure Administration (CNAIR), depending on the road category, to identify the administrator. For a private entity, do not assume that the time limits set out in Government Ordinance No. 27/2002 regulating the handling of petitions apply automatically.

Prepare the text without the recipient’s email address

Works contractor

Check the competent institution’s contact details on its official page.

Identify the contractor from the details on the works information board, only if you can read them safely, or from information published by the client for the works. Ask the road administrator to identify the company when the details are missing. Do not enter the construction site. Informing a private contractor does not replace a petition to the competent authority.

Prepare the text without the recipient’s email address

Local police

Check the competent institution’s contact details on its official page.

Check whether there is a local police service in the locality or sector concerned, and identify its official page or the page of the mayor’s office. If there is no local police service or you do not have confirmed contact details, use the verified Romanian Police contact details for disturbances of the peace. Do not assume the service operates around the clock.

Prepare the text without the recipient’s email address

Identified operator or holder of the inspection chamber or network

Check the competent institution’s contact details on its official page.

Use only markings that are already visible and that you can read safely, and details confirmed on the operator’s official page. Do not lift a cover or climb down into an inspection chamber to identify the operator. If the operator is unknown, ask the road administrator or mayor’s office to identify it. Do not assume that every cover belongs to the water supply and sewerage service operator.

Prepare the text without the recipient’s email address

Choose how to proceed: rapid response, a registered petition or both.

Rapid response

  • If there is an immediate danger, an ongoing collapse or a road traffic accident involving injuries, call 112. Do not fill in the petition instead of requesting an emergency response.
  • Do not go onto the carriageway to take photographs or measurements. Do not stop on a motorway or expressway to document a pothole. Use only observations and images obtained safely.
  • Report the defect by telephone or through the form provided by the administrator or the Romanian Police, using contact details confirmed from official sources. For national roads, the information centre for road conditions of the National Company for Road Infrastructure Administration (CNAIR) can provide information about the road’s condition; a telephone call does not replace a written petition.
  • For an inspection chamber without a cover, a damaged grating or an excavation, also notify the identified operator or works contractor. Do not touch the installations, climb down into the inspection chamber or enter the work area.
  • Do not put up signs or improvised obstacles on the road yourself. Ask the people responsible to mark and protect the location.
  • If an incident has already occurred, first follow the recommendation shown after the safety questions. A report about the pothole does not replace the official recording of an accident, medical care or the steps to seek damages.
  • After the quick notification, send a separate petition if you are seeking checks, remedial action and a written response.

Registered petition

  • This guide concerns roads open to public traffic and their associated pavements. For a private path closed to public traffic, do not automatically apply the road traffic rules set out here; identify the owner or administrator and the appropriate procedure.
  • The petition may be submitted in writing or by email, on your own behalf or through a legally constituted organisation, under Articles 1 and 2 of Government Ordinance No. 27/2002. Enter the petitioner’s identification details and the address for the response; do not automatically add the personal numeric code (CNP) or a copy of the identity document.
  • Look for the national (DN), county (DJ) or communal (DC) road designation only if you can see it safely. If you only know the street name but do not know its category, choose ‘I don’t know’. A street name does not rule out the presence of a national or county road section.
  • Distinguish the built-up area (intravilan) from the entire territory of the administrative-territorial unit. The rule for national roads concerns municipalities’ built-up areas; the rule for county roads concerns the built-up areas of towns and municipalities. The fact that a village belongs to a municipality does not, in itself, prove that the road section is within the built-up area.
  • Select a confirmed administrator only if a document or an official webpage identifies the administrator of the road section concerned. Check any temporary transfer of administration against the documents, under Article 22¹ of Government Ordinance No. 43/1997. Do not replace this check with an assumption based on the road designation.
  • To send a report to the Romanian Police, use the template for checks and inspection. You can also send a report to the local police about matters within their remit concerning hazard warnings and compliance with the authorisation to carry out the works; they do not replace the traffic police in all their duties.
  • For a petition to the public administrator or to an entity to which Government Ordinance No. 27/2002 applies, use the template for remedial action. For a private works contractor or operator, the contact details shown also allow you to inform it about technical matters. Do not assume that a notification sent to it is subject to the response time limit for a petition to an authority.
  • Make separate requests for the danger to be checked and the location to be marked and protected, and for the defect to be repaired and its recurrence prevented. Article 5(2) of Government Emergency Ordinance No. 195/2002 requires dangerous obstacles or works to be marked as soon as possible and measures to be taken to remove them. Do not wait until the response time limit for the petition expires before reporting a current risk.
  • Check the text, copy it or open your email application, and add the evidence separately. The petition can also be submitted through the official form; if the form does not give you the registration number, ask for it separately.
  • For contracts, works acceptance records, reports or other existing documents, make a separate request for information. For a possible criminal offence, to challenge a penalty or to seek damages, use the separate procedure indicated in the recommendation shown after the safety questions.

If necessary, report the situation using the verified contact details for intervention. Send the written report separately to document the problem and request a response. State in the report that you have already reported the situation.

Letter templates

Dangerous pothole or uneven surface – safety check

Petition to the Romanian Police concerning road safety on a road open to public traffic or its associated pavement. It does not replace the official recording of an accident, a criminal complaint, a complaint challenging an administrative offence record (plângere contravențională) or a claim for damages.

Recipient police unit
Select the police unit responsible for the location of the defect, as shown in the form. Using this template does not replace reporting to the police for the official recording of an accident.
Petitioner’s identification details
For an individual, state the surname and given name. For an organisation, state its name, registered office, the representative’s name and the capacity in which they act. Do not assume that simply filling in these details is sufficient for a criminal complaint.
Locality
State the locality and county. If you cannot confirm them, say so and provide sufficient landmarks.
Location and main landmark
On a single line, enter the street or road, the landmark and, if you know it, the kilometre point. State the direction of travel and the side of the road in the description.
Date and time of observation
State the time or approximate period. Do not confuse it with the date drafted.
Defect and risks observed
Describe the defect, the hazard warnings observed and the effects on movement. Do not take measurements in traffic or assume the technical cause.
Answers about the road and works
Text filled in automatically based on the options selected. Check in particular the information about whether the location is within the built-up area (intravilan) and about the administrator specified.
Coordinates, optional
Add only coordinates relevant to the location of the defect, if you choose.
Evidence and annexes
List only the documents and files you will actually send. Keep the documents needed for the official recording of an accident or for claiming damages separately.
Address for the response
Give the email or postal address for the response.
Name of the person signing
Give the name of the petitioner or the organisation’s representative.
Date drafted
Check the date of the document before sending it.
The problem concerns the carriageway. I request an assessment of the risk in relation to the location of the defect, the existing traffic and the hazard warnings observed, without determining the technical solution myself.

I do not request that liability be automatically attributed to a person, and I do not confuse the time limit for providing a response with the time limit for taking measures to address a current hazard.

I submit this petition under Government Ordinance No. 27/2002. Please inform me of the registration number and date of the petition, provide the response and state the legal basis for the outcome. If the administration of the road section or the handling of some of the requests falls to another authority, I request that the petition be forwarded to the competent authority under Article 6¹ of Government Ordinance No. 27/2002 and that I be notified.

Evidence and photographs

  • Specify the exact location, locality, road, kilometre point if known, direction of travel and a landmark. For a pavement, state the side of the street and the nearby building or junction.
  • Describe the type of defect, its approximate extent and how it affects pedestrians, cyclists or vehicles. Do not put yourself at risk to take exact measurements.
  • If possible, photograph the location as a whole and the defect from a safe distance. Do not enter traffic, the excavation or the construction site.
  • Note the hazard warnings and protective measures you observed. Say ‘I did not observe any hazard warnings’ if you cannot check the entire site.
  • For works, note only the details on the site board that you can read safely or those published by the client for the works. Do not assume that a company whose name appears on a machine is the road administrator.
  • For an inspection chamber or cover, mention any inscriptions you can see without putting yourself in danger. Do not try to identify the network by lifting the cover.
  • Coordinates are optional. Check that the position indicated corresponds to the location of the defect, rather than a location you reached later.
  • If you have suffered damage, keep the photographs, documents recording the findings, invoices, estimates and relevant medical documents separately. Do not delay the official recording of the accident to collect all the documents.
  • Keep the original evidence and acknowledgements of previous reports. Avoid unnecessarily including faces and vehicle registration numbers in photographs intended for the report.

Keep the originals in a safe place. Send only relevant images with your report. For publication, create copies with unnecessary data and identifying features removed.

A copy from which you have removed the photograph’s technical data, such as the date and location recorded by the device, does not replace the original. Nor do these data, taken alone, provide conclusive proof of when or where the photograph was taken.

Include faces, vehicle registration numbers and witnesses’ identities only when they are relevant to the recipient and the purpose of sending the material. Publication on a website serves a different purpose from private submission to an authority.

Mistakes to avoid

  • Entering traffic or stopping on a high-speed road just to take photographs.
  • Confusing the built-up area (intravilan) with the entire administrative territory of the commune, town or municipality.
  • Automatically sending a report about any national road to the National Company for Road Infrastructure Administration (CNAIR), or a report about any county road to the county council, without taking account of the statutory exceptions and any transfers of administration.
  • Assuming that every pavement is administered by the mayor’s office or that every cover belongs to the water supply and sewerage service operator.
  • Asking only the police for repairs, without reporting the problem to the administrator or the person with technical responsibility.
  • Applying the 30-day time limit to a simple notification to a private works contractor without checking the legal rules applicable to the recipient.
  • Confusing the response time limit with the time limit for marking a hazard or with a single statutory time limit for every repair.
  • Sending a petition instead of attending for the official recording of an accident involving property damage when the law requires such attendance.
  • Assuming that damage to a vehicle caused by a pothole automatically proves the administrator’s fault and the right to a particular amount of damages.
  • Using the form to challenge a fine you have received or to submit a criminal complaint without meeting the requirements of the relevant procedure.

Keep proof and track the time limit

Keep the text actually sent, the evidence actually attached, confirmation of dispatch, confirmation of receipt or registration and any notification of forwarding or extension.

Sending the email, receiving the registration number and receiving the response are three separate events.

Indicative response dates

Indicative dates. Check the registration date with the competent authority and the advance notification of any extension. The calculator does not determine time limits for court or criminal proceedings.

When calculating a time limit in days, do not count the day it starts or the day on which it expires. If the final day is a non-working day, the time limit is extended to the next working day. The calendar covers 2024–2035 and includes Orthodox holidays with variable dates; check any additional days off observed by the institution separately.

Response: 30 days from registration
Possible extension: 45 days in total from the same registration – does not apply automatically
Forwarding: 5 days – a separate time limit

Next steps

  • Keep the text sent, annexes, proof of dispatch and acknowledgements. Note the registration number and date at each authority separately.
  • Under Article 6¹ of Government Ordinance No. 27/2002, a misdirected petition must be forwarded to the competent public authority or institution within 5 days of registration, and you must be notified. The response time limit runs from registration of the petition with the competent public authority or institution, under Article 8(2). Do not automatically add the 5 days to every response time limit.
  • The response is normally provided within 30 days of registration. The time limit may be extended by no more than 15 days for a more detailed investigation, provided you are notified in advance. After forwarding, the time limit is calculated from registration of the petition with the competent authority.
  • Calculate the response time limit expressed in days under Articles 2.553 and 2.554 of the Civil Code: do not include the first or last day; if the last day of the period is a non-working day, the time limit expires at the end of the next working day. The petition time limit calculator does not calculate the time limit of no more than 24 hours from the accident for attending the competent police unit in the cases provided for in Article 79 of Government Emergency Ordinance No. 195/2002.
  • Check whether the response specifies the administrator, temporary measures, planned repair, person responsible and time limits set for carrying out the work. The presence of signs does not prove that the repair has been completed.
  • If the hazard worsens, report the change again using the appropriate contact details. For a new emergency, call 112.
  • If you have not received a response or the response does not address your requests, follow the guide ‘I have not received a response to my petition’. A follow-up does not automatically restart the original time limit.
  • For damages, keep the evidence file and seek a separate legal assessment. Article 5(6) of Government Emergency Ordinance No. 195/2002 provides for liability under the conditions laid down by law, rather than automatic damages for every instance of damage.
I have not received a response to my petition
