Parked vehicles blocking the pavement or cycle track

Prepare a report about the situation you observed.

We help you choose the institution and prepare the text. We do not send anything on your behalf.

Check your safety and choose the appropriate procedure

Is there an immediate danger to people or the environment now?

  • Yes
  • No
  • I cannot assess this

Has anyone been injured or directly threatened?

  • Yes
  • No

What do you want to achieve?

  • Checking and remedying the situation
  • Existing documents or information
  • Challenging a penalty or an act you have received
  • Reporting a possible criminal offence

Is the incident happening now?

  • Yes
  • No
  • First, get to safety and request the necessary intervention. If there is an immediate danger, call 112. Do not fill in the form instead of requesting intervention.
  • Move away from the source of risk. Do not touch suspicious waste or containers. Use the verified contact details for intervention; not every violation justifies a call to 112.
  • Request medical care or intervention, depending on the situation. The criminal procedure is separate from a petition for preventive measures. You can return to this petition once you are safe.
  • Open the FEW guide to accessing public information. Keep the request for documents separate from the request for intervention.
  • Do not automatically use a petition as a substitute for challenging an act or a penalty. Check the special procedure and the applicable time limit.
  • Follow the criminal procedure and check the formal requirements for submission. The time limit calculator for petitions made under Government Ordinance No. 27/2002 does not apply to the criminal procedure.
  • Report the situation using the verified contact details for intervention and, where useful, prepare the written report separately.
  • Continue by identifying the authority and preparing the text.
Read the guide to Law No. 544/2001

112 emergency service

Emergency telephone number. Do not use it as a registry for a petition submitted under Government Ordinance No. 27/2002.

112

The single emergency telephone number available in Romania. It is not intended for submitting an administrative petition.

Tell the operator the location, landmarks and nature of the emergency, and answer their questions. Do not fill in the petition form first.

At all times, 24 hours a day, 7 days a week.

Identify the location and responsibilities for the situation reported

Who is responsible for what

Here you can find contact details for local or county institutions and, where applicable, for a national institution marked ‘National alternative’. Use the explanations in the guide to choose the right recipient for your problem. You send the report; the Foundation does not send anything on your behalf.

Contact the local police responsible for the area for checks on stopping, waiting (staționare) or parking. Establishing the facts and ordering measures depend on the statutory conditions being met in the specific situation.

  • Local police

Address the petition to the territorial unit of the Romanian Police, for the attention of its traffic police department. The absence of an address in the register does not prove that the local police do not exist.

  • Romanian Police

Ask for clarification of the location’s legal status and the authority’s remit. Do not assume that the situation already constitutes a road traffic violation, and do not make submitting the petition conditional on obtaining the property documents yourself.

  • Romanian Police
  • Mayor’s office

The mayor’s office is listed only to clarify any administrative responsibility. For matters concerning management of the private premises, identify the owner or administrator separately. The time limits under Government Ordinance No. 27/2002 do not automatically apply to correspondence sent to a private recipient.

  • Mayor’s office

You can ask for the layout to be checked even after the first incident. For remedial action, contact the administrator you have identified; if you do not know who this is, the mayor’s office can identify the competent recipient. Do not assume that the mayor’s office is the administrator of every road. Showing several recipients does not mean that you have to send the same petition to all of them.

  • Mayor’s office
  • Administrator of the road section

Local police

Check the competent institution’s contact details on its official page.

Check whether there is a local police service in the locality or sector concerned, and identify its official page or the page of the mayor’s office. If there is no local police service or you do not have confirmed contact details, use the verified Romanian Police contact details for disturbances of the peace. Do not assume the service operates around the clock.

Prepare the text without the recipient’s email address

Romanian Police

Check the competent institution’s contact details on its official page.

Identify the Romanian Police unit responsible for the location and nature of the events, and use its verified official contact details. For an administrative petition, use the registry address or petition form; for a criminal complaint, follow the formal requirements and method of submission indicated in the guide. In an emergency, call 112.

Prepare the text without the recipient’s email address

Mayor’s office

Check the competent institution’s contact details on its official page.

Identify the mayor’s office responsible for the location and subject of the report and use its registry address or official petition form. In București, check whether responsibility lies with the municipality or sector authorities. If you do not know the responsible institution or administrator, ask for the recipient to be identified and, where applicable, for the petition to be forwarded to the competent authority.

Prepare the text without the recipient’s email address

Administrator of the road section

Check the competent institution’s contact details on its official page.

Identify the administrator of the road section and of the road feature that your report concerns, such as the pavement, cycle track or pedestrian crossing, using official sources from the mayor’s office, county council or the National Company for Road Infrastructure Administration (CNAIR), according to the road’s category and location. If you do not know who the administrator is, ask the institution indicated in the guide to identify it and forward the petition to the competent authority. Use the verified name and contact details. If the authority you are contacting also administers the road, you do not need to send a separate petition to the same authority about the same problem. At junctions, check the responsibilities for each road and item of equipment.

Prepare the text without the recipient’s email address

Choose how to proceed: rapid response, a registered petition or both.

Rapid response

  • If people are in immediate danger or an emergency response needed at that moment is being obstructed, move to safety and call 112. Simply observing a parking violation does not automatically justify an emergency call.
  • If the vehicle is still there and the location is open to public traffic, use the contact details confirmed by official sources for the responsible local police or traffic police. State the location, what access is blocked and when you observed the situation.
  • If you do not know whether the vehicle is still there, give the date and time when you last saw it. You do not need to return to the scene to check whether it is still there.
  • Do not wait for five minutes to pass before reporting the obstruction. The authority determines how the vehicle’s remaining stationary should be classified and which rule applies, based on the circumstances.
  • Do not confront the driver, touch the vehicle or move it. Do not enter the carriageway to take photographs. Do not try to demonstrate the obstruction through a risky manoeuvre.
  • If the vehicle is on premises closed to public traffic, identify the person responsible for those premises. The address you use to send petitions to the mayor’s office is not used to coordinate action to clear a private property.

Registered petition

  • Use the ‘Vehicle blocking traffic – checks and inspection’ template for situations at a location open to public traffic. Describe the vehicle, its position, the periods when you observed it and the effect on pedestrians or cyclists.
  • On a pavement, leaving a clear space one metre wide is not sufficient to consider stopping or waiting (staționare) permitted. The authority checks the layout, the signs, signals and markings, and the pedestrian passage required by the applicable rules, which may be wider than the minimum of one metre.
  • Voluntary stopping is prohibited on a cycle track; waiting (staționare) is prohibited wherever stopping is prohibited. If you do not know the classification of the road feature, describe the signs, markings and configuration you observed.
  • Ask for the situation to be checked and for lawful measures to clear the obstruction to traffic. You can ask for consideration of removing the vehicle if the applicable conditions are met and the applicable procedure is followed; reporting the situation does not guarantee removal or a penalty.
  • To have the layout checked and prevent obstruction, you can use the ‘Blocked pavement or cycle track – layout and preventing the situation from recurring’ template, including after the first incident. Address the petition prepared using this template to the administrator you have identified; if you do not know who this is, ask the mayor’s office to identify them.
  • If the location’s legal status is unclear, use the ‘Blocked access – clarification of the location’s legal status and the authority’s remit’ template. For premises known to be closed to public traffic, use it only to clarify a specific administrative issue.
  • Ask to be given the registration number and date, the results of the checks, the measures ordered and the legal basis for the outcome. Ask for the petition to be forwarded to the competent authority for matters outside the recipient’s remit.
  • For copies of existing approvals, plans or decisions concerning parking, use the guide to requests under Law No. 544/2001 separately. To challenge a penalty you have received or to make a criminal complaint, follow the appropriate procedure.

If necessary, report the situation using the verified contact details for intervention. Send the written report separately to document the problem and request a response. State in the report that you have already reported the situation.

Prepare the report

Prepare the text. Provide only the necessary details. Check and edit the resulting text.

First answer the safety questions and identify the responsibilities.

The situation described concerns the occupation of the pavement. I request checks on compliance with Article 72(7) of Government Emergency Ordinance No. 195/2002 and Article 142(n), Article 143(a) and Article 144(2)–(3) of the Regulation approved by Government Decision No. 1.391/2006.

109 alin. (1) din O.U.G. nr. 195/2002 și, pentru poliția locală, de art. 7 lit. h) din Legea nr. 155/2010. Eventuala ridicare se analizează potrivit art. 64 din O.U.G. nr. 195/2002 și procedurii aplicabile.

Evidence and photographs

  • The locality, street, number of a nearby building, junction, direction of travel or side of the road and other landmarks that allow the location to be found.
  • The date and time of each observation. State whether you observed the situation at a single point in time or over a period; do not infer the duration of the stop from a single photograph.
  • An overview photograph taken from a safe place, showing the vehicle’s position and the space left for traffic.
  • The signs, markings, access from the carriageway, pedestrian crossing or affected ramp, if you can observe them safely.
  • A description of the specific effect: inability to pass, narrowing of the passage or blocked access for a person using a wheelchair, a person with a pushchair or a cyclist. Do not recreate a dangerous situation to document it.
  • The registration number or other vehicle identification details, only if you observed them safely and they are relevant to the report sent to the authority. You do not need to identify the driver.
  • If you estimate the width of the space left, state that it is an estimate. Do not take measurements between vehicles or in traffic.
  • For a recurring problem, the dates of separate observations, previous petitions and responses received.
  • Photographs support the checks but do not automatically prove all the elements of an administrative offence (contravenție). Keep the originals and avoid unnecessary publication of personal data.

Keep the originals in a safe place. Send only relevant images with your report. For publication, create copies with unnecessary data and identifying features removed.

A copy from which you have removed the photograph’s technical data, such as the date and location recorded by the device, does not replace the original. Nor do these data, taken alone, provide conclusive proof of when or where the photograph was taken.

Include faces, vehicle registration numbers and witnesses’ identities only when they are relevant to the recipient and the purpose of sending the material. Publication on a website serves a different purpose from private submission to an authority.

Mistakes to avoid

  • Assuming that leaving a clear space one metre wide permits any stopping or waiting (staționare) on the pavement.
  • Assuming that the driver’s presence or the use of hazard warning lights proves that the vehicle is allowed to remain stationary.
  • Waiting at the scene or monitoring the vehicle unsafely to demonstrate that it has remained stationary for a particular period.
  • Confusing private property open to public traffic with premises closed to public traffic.
  • Answering the question about public traffic based on the status of the yard whose access is blocked, even though the vehicle is on the street in front of it.
  • Assuming that a local police service exists without confirmation, or treating the lack of an address as proof that the institution does not exist.
  • Requesting a fine or removal of the vehicle as an automatic result of a photograph.
  • Unnecessarily publishing the registration number, images showing people’s faces or other personal data.
  • Moving the vehicle, confronting the driver or installing obstacles on the pavement or cycle track yourself.
  • Confusing a report seeking checks on a possible administrative offence (contravenție) with a complaint against an official record imposing a penalty (proces-verbal de sancționare).

Keep proof and track the time limit

Keep the text actually sent, the evidence actually attached, confirmation of dispatch, confirmation of receipt or registration and any notification of forwarding or extension.

Sending the email, receiving the registration number and receiving the response are three separate events.

Indicative response dates

Indicative dates. Check the registration date with the competent authority and the advance notification of any extension. The calculator does not determine time limits for court or criminal proceedings.

When calculating a time limit in days, do not count the day it starts or the day on which it expires. If the final day is a non-working day, the time limit is extended to the next working day. The calendar covers 2024–2035 and includes Orthodox holidays with variable dates; check any additional days off observed by the institution separately.

Response: 30 days from registration
Possible extension: 45 days in total from the same registration – does not apply automatically
Forwarding: 5 days – a separate time limit

Next steps

  • Keep the petition, annexes and proof of sending it. Note the registration number and date; a telephone call is not automatically a registered petition.
  • If the petition was sent to the wrong authority, the authority forwards it to the competent authority within 5 days of registration and notifies you. Follow up on the registration number and date at the competent authority.
  • The response is provided within 30 days of registration; after forwarding, the period runs from registration with the competent authority. For more detailed investigations, the head of the authority may extend the time limit by no more than 15 days, provided that you are notified in advance.
  • Calculate time limits expressed in days by excluding the first and last day, in accordance with Article 2.553 of the Civil Code. If the last day of the time limit is a non-working day, the time limit expires at the end of the next working day, in accordance with Article 2.554 of the Civil Code. The response time limit is not a time limit for a response team to arrive or for the vehicle to be removed.
  • If the situation recurs, give the new dates and facts and refer to the previous report. Do not assume that repeating the same text requires the authority to carry out the same investigation again once it has responded.
  • If the response identifies a layout problem, follow up separately on the administrator’s measures and ask for information on progress in implementing them. Do not install posts, chains or other obstacles yourself.
  • If you do not receive a response within the statutory time limit, continue with the guide ‘I have not received a response to my petition’.
  • If you want to challenge a penalty imposed on you or an order you have received, check the special procedure and the applicable time limit. This petition does not replace the special procedure and does not justify delaying your challenge.
I have not received a response to my petition
