Pension calculated incorrectly or pension decision delayed

Find out how to ask for explanations, revision (revizuire) or recalculation of your pension, and how to challenge the decision or ask for your case to be determined when the decision is delayed.

We help you choose the institution and prepare the text. We do not send anything on your behalf.

Check your safety and choose the appropriate procedure

Is there a medical emergency or an immediate danger to anyone now?

  • Yes
  • No
  • I cannot assess this

What type of pension or document is involved?

  • Pension under the public system
  • Military pension
  • Private pension
  • Case involving other countries
  • Medical decision on capacity for work
  • I do not know

What do you want to achieve?

  • Challenging a decision I have received
  • Correcting a difference from the entitlements legally due
  • Taking additional documents, income or periods into account
  • Obtaining a decision on an application where the decision is delayed
  • Explanations about the pension calculation or my own case file
  • Information of public interest about the institution
  • Call 112 and ask for the assistance needed. Do not delay the call to answer questions or complete pension documents.
  • If someone needs emergency medical help or is in immediate danger, call 112. A calculation problem or administrative delay is not, in itself, an emergency for this service.
  • Military pensions have their own institutions and procedures. Check the document you have received and the instructions from the sectoral pension house (casă sectorială de pensii). Do not automatically apply the 45-day time limit and the template for the public system.
  • For a private pension, identify the administrator and the procedure applicable to your pension. The templates for territorial pension houses in the public system do not automatically apply.
  • The case must be checked in light of the applicable international rules and the institutions involved. Do not assume that the time limits under Romanian legislation used by this calculator apply to the entire procedure.
  • A medical decision on capacity for work has a separate challenge procedure. Check the document and the issuing institution immediately. Do not automatically use the procedure for challenging a pension decision, which has a 45-day time limit.
  • Check the document’s title and the issuing institution. If you cannot identify them, ask for guidance using official contact details, without publishing the document or your personal numeric code.
  • Keep proof of service. For a decision of a territorial pension house governed by Law No. 360/2023, submit the challenge directly to the tribunal within 45 days of service. A petition or a request for revision does not extend the time limit.
  • Describe the specific difference and the documents supporting the correction. A request for revision (revizuire) is governed by different rules from a request for recalculation. If you also want to challenge the decision you have received, continue to keep track of the 45-day time limit for bringing court proceedings.
  • Prepare the request for recalculation and the documents concerning income or periods not taken into account. For a contribution period (stagiu de cotizare) completed after retirement on an old-age pension, the request may be made only once in a calendar year.
  • Identify the type of application, the date of registration with the responsible pension house and any additional submissions or extensions of the time limit. You can ask about the progress of your case by submitting a petition. If the statutory time limit for determining the pension application or request for recalculation has been exceeded, you can prepare a separate court application to the tribunal.
  • Ask the responsible pension house to explain the data and calculation in your own case file. If you have received a decision you want to challenge, the time limit for challenging it continues to run even if you have asked for explanations.
  • For information about the institution, open the guide to requests for information of public interest under Law No. 544/2001. Request data and documents about your own pension through the procedure appropriate to your case.

112 emergency service

Emergency telephone number. Do not use it as a registry for a petition submitted under Government Ordinance No. 27/2002.

112

The single emergency telephone number available in Romania. It is not intended for submitting an administrative petition.

Tell the operator the location, landmarks and nature of the emergency, and answer their questions. Do not fill in the petition form first.

Who is responsible for what

Here you can find contact details for local or county institutions and, where applicable, for a national institution marked ‘National alternative’. Use the explanations in the guide to choose the right recipient for your problem. You send the report; the Foundation does not send anything on your behalf.

Address the petition to the pension house that handles the case or issued the decision, as it awards and pays pension benefits under Article 124(d) of Law No. 360/2023. Ask for specific explanations or information about the progress of your application. If you have received a decision, the petition does not extend the time limit for challenging it.

  • Territorial pension house

Ask the pension house to check the differences between pension benefits awarded or paid and those legally due, under Article 94(1) of Law No. 360/2023. If the differences are confirmed, the change is made through a revision decision. If the request is considered unfounded, the law provides for a response under Government Ordinance No. 27/2002. A request for revision does not extend the time limit for challenging the original decision.

  • Territorial pension house

Submit the request for recalculation to the territorial pension house administering your pension so that the elements specified in Article 94(5)–(6) of Law No. 360/2023 can be taken into account. The request template is set out in Annex No. 16 to the implementing rules for Law No. 360/2023 on the public pension system, approved by Government Decision No. 181/2024. Check the procedure for submitting the request and documents and whether the general petition form can be used for this purpose.

  • Territorial pension house

Submit the challenge to the tribunal for your place of domicile under Articles 127, 129 and 130 of Law No. 360/2023, against the pension house that issued the decision. The time limit is 45 days from service. The National Public Pension House (CNPP) and the issuing pension house are not alternative recipients of the court application.

  • Tribunal with jurisdiction over the pension dispute

For an application not determined within the time limit, the guidance to apply to the tribunal follows from reading Article 93 or 94 together with Article 124(d), Article 129(e) and Article 130 of Law No. 360/2023. You can ask for an order requiring the responsible pension house to determine the application and issue the decision. If no decision has been served, a 45-day time limit for bringing court proceedings does not automatically start when the administrative time limit expires.

For a decision you have received, check the institution named in the document. For a pending application, identify the institution with which it is registered and which handles your case. Use the official list of territorial pension houses on the National Public Pension House (CNPP) website; in București, also check the local office for the relevant sector. If you cannot identify the institution, you can ask for guidance using CNPP contact details confirmed from official sources. For requests under the special revision or recalculation procedures, check the submission method separately.

Tribunal with jurisdiction over the pension dispute

Check the competent institution’s contact details on its official page.

For an application against the pension house concerning your entitlements, identify the tribunal for your place of domicile and the social insurance division or panel. Check the contact details of the court registry or select the tribunal in the national Registratură ReJust service. The pension house is the defendant; submit the application to the tribunal. There is no national institution to which you can submit the application in place of the tribunal with jurisdiction.

Choose how to proceed

Rapid response

  • If there is a medical emergency or an immediate danger to anyone, call 112 before taking any administrative steps.
  • Keep the decision, all annexes and proof of service: the envelope, acknowledgement of receipt, electronic message or proof that you received the decision in person. The date printed on the decision is not necessarily the date of service.
  • If you want to challenge the decision, check the 45-day time limit from service immediately. Do not wait for the response to a petition or a request for revision.
  • Compare the data in the decision with your own documents. Distinguish the pension amount from the amount actually transferred after any deductions; a difference from another person’s pension does not, on its own, prove an error.
  • If determination of the application is delayed, identify the application’s registration number and date at the responsible pension house and any request for additional documents.

The written document

  • The guide concerns the public pension system administered by the National Public Pension House (CNPP) and territorial pension houses. Military pensions, private pensions, international cases and challenges to medical decisions require separate checks.
  • You can submit a petition to obtain explanations or information about the progress of your case. Ask for information about your own application or decision and identify exactly what is unclear. Request information of public interest about the institution separately, under Law No. 544/2001.
  • For differences between pension benefits awarded or paid and those legally due, request revision under Article 94(1) of Law No. 360/2023. If the institution considers the request unfounded, Article 94(2) provides for it to be handled under Government Ordinance No. 27/2002.
  • For income, contribution periods, periods treated as contribution periods (perioade asimilate stagiilor de cotizare) or documents not taken into account, prepare a request for recalculation. For a contribution period completed after retirement on an old-age pension, recalculation may be requested only once in a calendar year.
  • A request for recalculation must be determined within 45 days of registration, with a possible extension of 30 days where additional documents or processing steps are needed. The resulting benefits are awarded from the month following registration of the request; this does not guarantee that payment will actually be made that month.
  • To challenge the decision, submit the application directly to the tribunal for your place of domicile, against the issuing pension house. In this case, there is no requirement to first send an administrative challenge to the National Public Pension House (CNPP).
  • For a pension application or request for recalculation that has not been determined within the time limit, you can ask the tribunal to order the responsible pension house to determine the application and issue the decision. This possibility follows from reading the pension house’s obligations together with the tribunal’s jurisdiction over the rights and obligations provided for by law.
  • You can submit the court application yourself, without a lawyer. The dispute over pension entitlements is exempt from judicial stamp duty, but there may be other costs. You can apply for legal aid (ajutor public judiciar) under the conditions laid down by law.
  • Confirm with the territorial pension house how to submit requests under the special procedures and the attached documents, including whether you can use the general petition form for your request for revision or recalculation.

Prepare the document

Prepare the text. Provide only the necessary details. Check and edit the resulting text.

Do not enter your personal numeric code, the series and number of your identity document, other personal identification codes or numbers, or the IBAN of a bank account here, except in fields where the guide expressly asks for them. If they are required and there is no such field, add these codes or numbers to the copy you will send to the institution. Do not enter passwords or bank card details.

The request may contain data about your identity, income and health. Read the page’s privacy information before entering personal data. If you use a shared device, avoid keeping the document or data in places accessible to other people.

Fill in the details needed for your chosen request. For a petition seeking explanations, start with your name, address for the response and case details. The recalculation form and the court application have their own identification requirements. Do not publish your personal numeric code, identity document or full pension decision online.

First answer the safety questions and identify the responsibilities.

Chronology and delay beyond the time limit
Set out the submission of the application, any supplementary submissions, known extensions, responses and the calculation of the applicable time limit. State whether you were insured in the month when you applied for your pension. Do not assume that the time limit was not extended simply because you did not receive a notification.

Other identification details: [Identification details for the court]
Details for correspondence: [Details for correspondence]

Defendant:
[Pension house being sued]

Statement of claim

I request an order requiring the defendant to determine the application identified below and to issue and serve the decision required by law.

The administrative application and its registration with the competent institution:
[Application not yet determined]

Chronology of the submission, supplementary submissions, any extension and the steps taken:
[Chronology and delay beyond the time limit]

The application concerns recalculation under Article 94(5) or (6) of Law No. 360/2023. I rely on the duty to determine the application by decision within the time limit provided for in Article 94(7)–(8) of Law No. 360/2023. In the chronology above, I explain how the time limit has been exceeded, taking account of any extension.

The tribunal’s jurisdiction follows from reading the statutory duty to determine the application together with Article 124(d), Article 129(e) and Article 130(1) of Law No. 360/2023. I submit this claim under Article 194 of the Code of Civil Procedure and request application of the exemption from judicial stamp duty provided for in Article 132 of Law No. 360/2023.

I request permission to adduce the following evidence:
[Evidence and annexes]

I request that the defendant submit the administrative case file, the registration record, requests for supplementary material and documents concerning any extension of the time limit.

I request an order requiring the defendant to pay the costs that I shall substantiate, as provided by law.

I submit this claim and copies of the documents under Articles 149, 150 and 195 of the Code of Civil Procedure.

Date: [Date drafted]
[Claimant’s surname and given name]

You can submit the application yourself, without a lawyer, after checking the situation and the applicable time limit for determination. Sign the application and comply with the rules on copies of the application, copies of documents and proof of filing. If you receive a decision in the meantime, check separately what application you need to file to challenge it and within what time limit; do not assume that this action automatically also challenges the decision.

Evidence and photographs

  • The decision being challenged or needing to be checked, its annexes and the calculation documents received.
  • Proof of service of the decision. Note the date of service and the date of issue separately.
  • The pension application, request for revision or request for recalculation and proof of registration at the competent institution, showing the registration number and date.
  • Documents concerning periods worked, income, contribution periods, periods treated as contribution periods and relevant working conditions.
  • Proof that a document relied on to correct the error was submitted previously, if this is the case.
  • Requests to supplement the case file, responses sent and proof of submission of the additional documents.
  • Pension payment slips and proof of the relevant payments, distinguishing the amount awarded from any deductions.
  • A structured explanation: what the decision says, what you consider needs correcting, which document supports the correction and which period is affected.

Keep the originals in a safe place. Send only relevant images with your report. For publication, create copies with unnecessary data and identifying features removed.

A copy from which you have removed the photograph’s technical data, such as the date and location recorded by the device, does not replace the original. Nor do these data, taken alone, provide conclusive proof of when or where the photograph was taken.

Include faces, vehicle registration numbers and witnesses’ identities only when they are relevant to the recipient and the purpose of sending the material. Publication on a website serves a different purpose from private submission to an authority.

Mistakes to avoid

  • Waiting for the response to a petition until the time limit for challenging the decision expires.
  • Calculating the time limit for a challenge from the date of issue instead of the date of service.
  • Confusing revision with recalculation and automatically applying the same time limit to all requests.
  • Sending the court challenge only to the pension house or the National Public Pension House (CNPP).
  • Requesting administrative annulment of the decision granting the application when you only want to correct the calculation; annulment at the pensioner’s request is a different procedure.
  • Assuming that any response to a request for revision constitutes a new decision that restarts the time limit for challenging the original decision.
  • Automatically applying a three-year limit to all differences resulting from revision, without checking the exception for certain clerical or calculation errors.
  • Treating all pensions awarded before September 2024 as outside the scope of the guide. The application, the decision and the relevant transitional provisions must be checked.
  • Sending medical documents or data about other people when the information sent is unrelated to the calculation problem.

Time limits for your submission

The calculator cannot determine on its own whether recovery of a difference in pension payments is time-barred, whether the exception for a clerical error (eroare materială) applies or what amount you are entitled to. In such cases, the documents and circumstances must be checked individually. The responsible institution or court decides on the award of entitlements and the outcome of a challenge.

Issuing the decision on the pension application

45 calendar days

Registration of the pension application with the competent territorial pension house.

Article 58(5) and Article 60 of the implementing rules approved by Government Decision No. 181/2024: the day of registration and the day on which the time limit expires are not counted. If the final day is a non-working day or the service is suspended because of a day off granted by the Government, the time limit expires at the end of the next working day.

This concerns the issue of the decision granting or rejecting the application. Service of the decision has a separate time limit. This does not automatically apply to international cases or applications for which the transitional provisions must be checked.

Issuing the pension decision after a statutory extension

75 calendar days

Registration of the pension application with the competent territorial pension house.

Article 93(3) of Law No. 360/2023 and Article 58(5) and Article 60 of the implementing rules approved by Government Decision No. 181/2024. A single total period of 75 days is calculated, excluding the day of registration and the day on which the time limit expires, and applying the rule for a non-working final day.

An extension of 30 days is possible if you are an insured person in the month in which you apply for a pension or if additional documents or processing steps are required. Do not assume that the extension applies automatically. Ask the pension house to specify the reason for the extension and its duration. Article 93(3) of Law No. 360/2023 does not expressly include the requirement for prior notification found in the general petitions procedure.

Service of the decision on the pension application

10 calendar days

Date of issue of the decision provided for in Article 93 of Law No. 360/2023.

Article 93(6) of Law No. 360/2023 and Articles 2.551, 2.553–2.554 of the Civil Code: the day of issue and the day on which the time limit expires are not counted; if the final day is a non-working day, the time limit is extended to the next working day.

This time limit is separate from the time limit for issuing the decision. For a challenge, the date that matters is the date of actual service, established on the basis of the evidence, rather than the date on which service should have taken place. Do not automatically apply this time limit of 10 days to every response to a request for revision or every recalculation decision.

Determining the request for recalculation

45 calendar days

Registration of the request for recalculation with the competent territorial pension house.

Article 94(7) of Law No. 360/2023 and Articles 2.551, 2.553–2.554 of the Civil Code: the day of registration and the day on which the time limit expires are not counted; if the final day is a non-working day, the time limit expires at the end of the next working day.

This applies to requests for recalculation under Article 94(5)–(6) of Law No. 360/2023, not to every request for revision. The resulting benefits are awarded from the month following registration of the request; this rule does not guarantee actual payment in that month. For a contribution period completed after retirement on an old-age pension, you may request recalculation only once in a calendar year; there is no requirement for an interval of 12 months between requests.

Determining the request for recalculation after a statutory extension

75 calendar days

Registration of the request for recalculation with the competent territorial pension house.

Article 94(8) of Law No. 360/2023 and Articles 2.551, 2.553–2.554 of the Civil Code. A single total period of 75 days is calculated, excluding the day of registration and the day on which the time limit expires, and applying the rule for a non-working final day.

An extension of 30 days is possible if additional documents or processing steps are required. It does not apply automatically. The 45 days and the extension of 30 days are not calculated as two separate time limits that would add extra days.

Challenging the territorial pension house’s decision

45 calendar days

Actual service of the decision you are challenging.

Article 127 and Article 131(3) of Law No. 360/2023, Article 181(1), point 2, and paragraph (2), and Articles 182–183 of the Code of Civil Procedure. The day of service and the day on which the time limit expires are not counted; a non-working final day moves the expiry to the next working day. The filing cut-off time and proof of filing must be checked according to the method used.

The challenge is filed directly with the tribunal. A petition, a request for revision and a request for recalculation do not replace the challenge and do not extend the time limit for challenging the original decision. A separate time limit runs for challenging a new decision; a simple response to a petition does not restart the time limit for challenging the original decision. If the date of service is uncertain, a reliable deadline cannot be given: ask for the date of service to be checked immediately, without waiting for the response to the petition. For filing by email, keep proof of the date and time of receipt by the court; the mere presence of the message in the ‘Sent’ folder does not confirm receipt.

Forwarding the petition to the competent institution

5 calendar days

Registration of the petition with the institution to which it was initially submitted, which is not competent to handle it.

Article 6¹ of Government Ordinance No. 27/2002 and Articles 2.551, 2.553–2.554 of the Civil Code: the day of registration and the day on which the time limit expires are not counted; if the final day is a non-working day, the time limit is extended to the next working day.

The institution must notify you that the petition has been forwarded. The time limit for forwarding a petition does not guarantee compliance with the time limit for a challenge if you send the challenge to the pension house. The court application must be filed under the applicable procedural rules.

Response to the petition or to a request for revision considered unfounded

30 calendar days

Registration with the competent institution of the petition or the request for revision to which Article 94(2) of Law No. 360/2023 applies.

Article 8 of Government Ordinance No. 27/2002 and Articles 2.551, 2.553–2.554 of the Civil Code. The day of registration and the day on which the time limit expires are not counted; if the final day is a non-working day, the time limit expires on the next working day. After forwarding, the registration with the competent institution is used.

This time limit applies to a request for revision which the institution considers unfounded, under Article 94(2) of Law No. 360/2023. The time limit does not start running only once the institution considers the request unfounded. It is not a general time limit for issuing any revision decision. The response to a petition about the progress of the case does not replace the decision on the pension application or the request for recalculation.

Maximum response time limit under Government Ordinance No. 27/2002, after an extension

45 calendar days

Registration with the competent institution of the petition or the request for revision to which Article 94(2) of Law No. 360/2023 applies; the standard response time limit also runs from this registration.

Article 9 of Government Ordinance No. 27/2002 and Articles 2.551, 2.553–2.554 of the Civil Code. A single total period of at most 45 days is calculated, excluding the day of registration and the day on which the time limit expires, and applying the rule for a non-working final day.

An extension of at most 15 days is possible where more detailed enquiries are needed, provided that the institution notifies you of the extension in advance. If the notified extension is shorter, its actual duration is used. The extended time limit is not the time limit for issuing a recalculation decision and does not extend the time limit for filing a challenge with the tribunal.

Limitation period for sums resulting from revision – individual assessment

3 years

The date on which the differences are identified, determined under Article 94(3) of Law No. 360/2023; this reference point concerns the rules governing sums resulting from revision.

Article 94(3)–(4) of Law No. 360/2023 and Articles 2.517, 2.552 and 2.554 of the Civil Code. The general limitation period is three years, but its application to the sums and the applicability of the statutory exception require an individual assessment of the situation.

This explanation does not provide an automatic calculation of a deadline or of recoverable sums. It does not mean that you automatically have three years from identification of the differences for any request for revision, nor does it allow all differences to be automatically limited to the last three years. For the clerical or calculation errors covered by Article 94(4) of Law No. 360/2023, the general limitation period does not limit the beneficiary’s recovery of unpaid sums. The classification of the error and the period for which the differences are payable are determined in the individual case.

Use this time limit as a guide and check whether it applies to your situation.

Appeal against the tribunal’s judgment

30 calendar days

Service of the tribunal’s judgment, subject to checking the special situations provided for by law.

Article 131(1) and (3) of Law No. 360/2023, Article 468(1)–(3), Article 181(1), point 2, and paragraph (2), and Articles 182–183 of the Code of Civil Procedure. The day of service and the day on which the time limit expires are not counted; if the final day is a non-working day, the time limit is extended to the next working day.

The appeal is filed with the tribunal that delivered the judgment, under Article 471(1) of the Code of Civil Procedure, even though it is heard by the court of appeal. Do not use the time limit of 10 days applicable to employment disputes. If you file an appeal before service, the judgment is deemed served on the date the appeal is filed. If you have applied for legal aid for the appeal, check the effects of Article 13 of Government Emergency Ordinance No. 51/2008 on the time limit, on the basis of the relevant application, documents and communications. This rule does not automatically extend to the 45 days for the initial challenge to the pension house’s decision.

Next steps

  • Keep a record of each request, the documents sent and the registration number and date.
  • Track the time limit for challenging the decision separately, even if you have also submitted an administrative request.
  • If you receive a new revision or recalculation decision, check the time limit of 45 days from service for challenging it. A simple response to a petition must be assessed according to its content, without assuming that the same rules apply to it.
  • If a request for revision is rejected in a response under Government Ordinance No. 27/2002, seek help to identify the appropriate action; do not assume that the time limit for challenging the original decision has restarted.
  • If you do not receive a response to the petition, you can consult the guide ‘I have not received a response to my petition’. For the issue of the pension decision, continue to check the special procedure in this guide.
  • If the decision is issued late, check the date from which the entitlements are granted and the sums actually paid. The delay does not automatically mean that the entitlements for the period stated in the decision are lost.
  • After the tribunal’s judgment, check whether an appeal is available and the applicable time limit. The general time limit for an appeal is 30 days from service of the judgment; do not use the time limit of 10 days specific to employment disputes.
