Abandoned vehicles on public domain land

Prepare a report about the situation you observed.

We help you choose the institution and prepare the text. We do not send anything on your behalf.

Check your safety and choose the appropriate procedure

Is there an immediate danger to people or the environment now?

  • Yes
  • No
  • I cannot assess this

Has anyone been injured or directly threatened?

  • Yes
  • No

What do you want to achieve?

  • Checking and remedying the situation
  • Existing documents or information
  • Challenging a penalty or an act you have received
  • Reporting a possible criminal offence

Is the incident happening now?

  • Yes
  • No
  • First, get to safety and request the necessary intervention. If there is an immediate danger, call 112. Do not fill in the form instead of requesting intervention.
  • Move away from the source of risk. Do not touch suspicious waste or containers. Use the verified contact details for intervention; not every violation justifies a call to 112.
  • Request medical care or intervention, depending on the situation. The criminal procedure is separate from a petition for preventive measures. You can return to this petition once you are safe.
  • Open the FEW guide to accessing public information. Keep the request for documents separate from the request for intervention.
  • Do not automatically use a petition as a substitute for challenging an act or a penalty. Check the special procedure and the applicable time limit.
  • Follow the criminal procedure and check the formal requirements for submission. The time limit calculator for petitions made under Government Ordinance No. 27/2002 does not apply to the criminal procedure.
  • Report the situation using the verified contact details for intervention and, where useful, prepare the written report separately.
  • Continue by identifying the authority and preparing the text.
Read the guide to Law No. 544/2001

112 emergency service

Emergency telephone number. Do not use it as a registry for a petition submitted under Government Ordinance No. 27/2002.

112

The single emergency telephone number available in Romania. It is not intended for submitting an administrative petition.

Tell the operator the location, landmarks and nature of the emergency, and answer their questions. Do not fill in the petition form first.

At all times, 24 hours a day, 7 days a week.

Identify the location and responsibilities for the situation reported

Who is responsible for what

Here you can find contact details for local or county institutions and, where applicable, for a national institution marked ‘National alternative’. Use the explanations in the guide to choose the right recipient for your problem. You send the report; the Foundation does not send anything on your behalf.

You can contact the mayor through the mayor’s office to have the situation checked or to clarify the legal status of the land and which authority is responsible. This recommendation does not mean that the vehicle will be removed automatically and does not replace the recommendations for specific situations.

  • Mayor’s office

The local police apply the procedure within their statutory powers, where a local police force has been established. If no contact details have been confirmed from official sources, address the report to the mayor, who can identify the responsible officers.

  • Local police

An obstruction on a pavement, cycle track or public road is checked separately under road traffic rules, without waiting for the conditions for classifying the vehicle as abandoned to be met. If there is no local police force, use traffic police contact details confirmed from official sources; the mayor’s office can identify the responsible police unit.

  • Local police

You can report possible environmental effects regardless of the vehicle’s classification. In the event of immediate danger, first follow the steps for emergency assistance.

  • National Environmental Guard

Mayor’s office

Check the competent institution’s contact details on its official page.

Identify the mayor’s office responsible for the location and subject of the report and use its registry address or official petition form. In București, check whether responsibility lies with the municipality or sector authorities. If you do not know the responsible institution or administrator, ask for the recipient to be identified and, where applicable, for the petition to be forwarded to the competent authority.

Prepare the text without the recipient’s email address

Local police

Check the competent institution’s contact details on its official page.

Check whether there is a local police service in the locality or sector concerned, and identify its official page or the page of the mayor’s office. If there is no local police service or you do not have confirmed contact details, use the verified Romanian Police contact details for disturbances of the peace. Do not assume the service operates around the clock.

Prepare the text without the recipient’s email address

National Environmental Guard

Check the competent institution’s contact details on its official page.

National alternative

National Environmental Guard

Environmental inspection of the documented matters. Identify the responsible territorial office (comisariat teritorial) separately.

gardamediu@gnm.ro

An official general email address that you can use as a national alternative for environmental reports.

Official report form. The field labels refer to complaints about an operator’s activities.

The form includes the field ‘Numele reclamatului’ (Name of the party complained about). If you do not know who did it, do not invent a name. If the form does not allow submission without this name, send the report by email to gardamediu@gnm.ro.

Use the file attachment field and check which file types and sizes the form accepts. If you cannot attach the evidence, send the report and the files to the official email address for reports.

Check the official form to see which fields are mandatory and which file types and sizes you can attach.

Choose how to proceed: rapid response, a registered petition or both.

Rapid response

  • If there is a fire, an immediate risk to people or another emergency, move away and call 112. Do not open the vehicle, touch any liquids that have leaked or step onto the carriageway.
  • If the vehicle blocks the pavement, cycle track or traffic, report the obstruction separately using local contact details confirmed from official sources. You do not have to wait 6 months to report possible illegal parking.
  • You can also report the situation to the mayor or police unit verbally, at their offices or using the official telephone numbers displayed. Article 4 of the implementing rules approved by Government Decision No. 152/2023 provides for verbal reports to be recorded in a special register.
  • To follow up on the response, you can also submit a written report, mentioning any earlier call you made. Ask for the registration number and date, without assuming that these will be provided automatically.
  • For leaks that pose no immediate danger, report them to the National Environmental Guard (GNM) and describe the effects you have observed; a mere suspicion that the vehicle has been abandoned does not justify a call to 112.

Registered petition

  • Use the ‘Abandoned vehicle – checks and inspection’ template, addressed to the mayor through the mayor’s office registry, or to the local police where a local police force has been established. You can also report the situation to the responsible Romanian Police unit, under Article 4 of the implementing rules approved by Government Decision No. 152/2023.
  • Describe the location, the vehicle’s visible condition and the dates on which you observed it. You can report the situation without photographs, without knowing the owner and without having personally observed the vehicle for 6 months.
  • Under Article 2(b) of Law No. 421/2002, classification in the ‘vehicul abandonat’ (abandoned vehicle) category requires the vehicle to have been on land covered by the law for at least 6 months, the owner or lawful holder to be known, and strong indications that the vehicle does not meet the statutory conditions for use on public roads. The authority checks whether all these conditions are met.
  • Classification in the ‘vehicul fără stăpân’ (ownerless vehicle) category is subject to separate conditions under Article 2(a) of Law No. 421/2002, including the owner or lawful holder being unknown. Missing registration plates, registration abroad or the fact that you do not know the owner are not, taken separately, sufficient for this classification.
  • Request an on-site check and, if the statutory conditions are met, application of the procedure for establishing the facts, identification, serving formal notices and issuing the mayor’s orders. Do not ask for the vehicle to be declared abandoned automatically.
  • To remedy the effects on public space, make the situation safe and request any applicable administrative measures for vehicle removal, use the ‘Abandoned vehicle – measures and remedial action’ template. The authority determines the responsibilities and the procedure.
  • If the pavement or cycle track is blocked, also see the guide ‘Parked vehicles blocking the pavement or cycle track’. The removal of an illegally parked vehicle follows a different procedure from that for vehicles with no known owner or abandoned vehicles.
  • Ask to be informed of the results of the checks, the measures ordered and the registration number and date, and for the legal basis for the outcome to be specified. Do not ask for the owner’s personal data to be disclosed automatically.
  • For copies of existing orders or documents, make a separate request under Law No. 544/2001. A criminal complaint, a report of a criminal offence (denunț), and a challenge to a sanction or an order you have received follow their own separate procedures.

If necessary, report the situation using the verified contact details for intervention. Send the written report separately to document the problem and request a response. State in the report that you have already reported the situation.

Prepare the report

Prepare the text. Provide only the necessary details. Check and edit the resulting text.

First answer the safety questions and identify the responsibilities.

Letter templates

Abandoned vehicle – checks and inspection

You can use the template as a natural person. You can also use it on behalf of a legally constituted organisation, for the group that the organisation represents. Address it to the mayor, the local police where a local police force has been established, or the responsible police unit. The template is an administrative report; it does not establish that the vehicle is abandoned and does not replace a criminal complaint or a challenge to an act.

Recipient
Enter the name of the responsible authority. If you are addressing the mayor, you can state the mayor’s office through whose registry you submit the report.
Petitioner’s identification details
For an individual, enter the surname and given name. For an organisation, enter its name, registered office, the representative’s name and the capacity in which they act. Do not automatically attach a copy of the identity document.
Locality
Enter the locality and county if you know them. If not, describe landmarks in the ‘Exact location and landmarks’ field.
Exact location and landmarks
Describe the location precisely enough for it to be found. Coordinates are optional; do not enter properties or dangerous areas to establish the exact location.
Date and time of the most recent observation
State the date or approximate period you know. Do not assume that the vehicle remained there continuously between observations.
Facts observed
Describe the facts specifically and separate direct observations from information received from others. Do not state that a person is guilty without basing this on information you know.
List of evidence and annexes
List only what you are actually sending. Photographs are not compulsory. Send only data relevant to the checks.
Email or postal address for the response
Give an address at which you can receive the response. For post, enter the full address.
Name of the person signing
Enter the surname and given name. For an organisation, sign in the capacity stated in the ‘Petitioner’s identification details’ field.
Date drafted
Enter the date on which you finalise the document; this does not replace the date of registration with the authority.
Vehicle description
State the type, colour and make, if you know them. Enter the registration number only if it is visible from a safe place; you do not have to identify the owner, chassis number or engine number.
Duration and history of observations
State the date of the first observation, any other known observation dates and any movements of the vehicle. If you do not know how long it has been there, say so. You do not have to have personally observed the vehicle’s situation for 6 months to submit a report.
Based on the information I hold, the land may belong to the public domain (domeniul public) or private domain (domeniul privat) of the state or the administrative-territorial unit. I request confirmation of the land’s legal status and a check on whether the conditions in Articles 1 and 2 of Law No. 421/2002 are met. The information about how long the vehicle has been present and its condition is provided for verification; this description does not declare the vehicle abandoned or ownerless.

Abandoned vehicle – measures and remedial action

You can use the template as a natural person or on behalf of a legally constituted organisation to request that the applicable procedure be followed, measures for traffic safety be taken or environmental effects be remedied, within a public authority’s remit. For land privately owned by a person, limit the request to measures within the public authorities’ remit in relation to the specific effects described. The fact that a private owner is the letter’s recipient does not automatically impose obligations on them under Government Ordinance No. 27/2002.

If it is confirmed that the conditions in Law No. 421/2002 are met, I request that the procedure be followed and that measures for taking an inventory, removal, transport and storage be ordered under Articles 3 and 4 of the same law, in compliance with the requirements concerning formal notices and completion of the other applicable stages. I do not request that these conditions be disregarded and do not regard the date of the petition as automatically marking the start of all the special time limits.

I request that responsibilities and measures to remedy the effects described be established. If the vehicle affects traffic on a public road, pavement or cycle track, I request a separate check on compliance with the rules on stopping, waiting and parking and the taking of measures provided for by law, under Article 7(h) of Law No. 155/2010 and Article 64 of Government Emergency Ordinance No. 195/2002, according to the respective powers. Checking this matter must not be confused with classifying the vehicle as abandoned.

If leaks or other effects on the soil, surface water or groundwater are described, I request checks by the competent environmental protection authority and the establishment of measures to limit and remedy the effects described, under Article 7(3) and Article 94(1)(g), (i) and (l) of Government Emergency Ordinance No. 195/2005, in accordance with the responsibilities established.

Please specify the applicable procedure, the measures ordered, the person or institution responsible and the time limits for carrying them out, if these have been set. I do not regard the time limit for responding to this petition as automatically being the time limit for removing the vehicle.

Please inform me of the registration number and date, the results of the checks and the measures ordered, specifying the legal basis for the outcome, under Article 8 and Article 13 of Government Ordinance No. 27/2002. Evidence and photographs

  • The address, the vehicle’s location and landmarks that allow the place to be identified; coordinates are optional.
  • The dates on which you observed the vehicle and any changes in its position or condition. Specify the periods for which you have no information about the vehicle.
  • The type of vehicle, colour and make, if you recognise it. State the registration number only if you can read it from a safe place.
  • A description of the damage or apparently missing components, without opening or touching the vehicle. You do not have to identify the chassis or engine number.
  • Photographs showing the overall scene, taken safely, with the observation date stated in the description. You do not have to make the findings or take the photographs that are the officers’ responsibility.
  • Describe any obstructions or leaks specifically, and the effects you have observed on the soil, a watercourse, lake or pond, or their banks or shores. Do not take samples or touch unknown substances.
  • The registration number and date of an earlier report or visible information about a formal notice (somație), if you already have them. Do not peel off or damage displayed documents.
  • Send the authority only the relevant identification details; do not publish the registration number or information about people unnecessarily.

Keep the originals in a safe place. Send only relevant images with your report. For publication, create copies with unnecessary data and identifying features removed.

A copy from which you have removed the photograph’s technical data, such as the date and location recorded by the device, does not replace the original. Nor do these data, taken alone, provide conclusive proof of when or where the photograph was taken.

Include faces, vehicle registration numbers and witnesses’ identities only when they are relevant to the recipient and the purpose of sending the material. Publication on a website serves a different purpose from private submission to an authority.

Mistakes to avoid

  • Declaring the vehicle abandoned simply because it is old, dirty, rusty or has been stationary for a long time.
  • Treating the 6 months as a mandatory waiting period before making any report or as sufficient proof of abandonment.
  • Confusing the private domain (domeniul privat) of the state or the administrative-territorial unit with the private property of another natural or legal person.
  • Assuming that the owner is unknown to the authorities because you do not know who they are.
  • Automatically inferring from the vehicle’s appearance that it has no compulsory insurance or that the validity period of its periodic roadworthiness test (inspecție tehnică periodică) has expired; checking these matters is the authority’s responsibility.
  • Waiting for the abandoned vehicle procedure to be applied before separately reporting illegal parking, an obstruction or a leak.
  • Pushing, towing, opening or dismantling the vehicle, or entering properties to check it.
  • Confusing the time limit for responding to the petition with the time limit for removing the vehicle.

Keep proof and track the time limit

Keep the text actually sent, the evidence actually attached, confirmation of dispatch, confirmation of receipt or registration and any notification of forwarding or extension.

Sending the email, receiving the registration number and receiving the response are three separate events.

Indicative response dates

Indicative dates. Check the registration date with the competent authority and the advance notification of any extension. The calculator does not determine time limits for court or criminal proceedings.

When calculating a time limit in days, do not count the day it starts or the day on which it expires. If the final day is a non-working day, the time limit is extended to the next working day. The calendar covers 2024–2035 and includes Orthodox holidays with variable dates; check any additional days off observed by the institution separately.

Response: 30 days from registration
Possible extension: 45 days in total from the same registration – does not apply automatically
Forwarding: 5 days – a separate time limit

Next steps

  • Keep the report, annexes, confirmation of sending and the registration number and date. Written reports are registered immediately after receipt, under Article 4(5) of the implementing rules approved by Government Decision No. 152/2023.
  • If the petition is sent to the wrong authority, that authority forwards it to the competent authority within 5 days of registration and notifies you, under Article 6¹ of Government Ordinance No. 27/2002. After it has been forwarded, check its registration with the competent authority and note the registration number and date.
  • The response to the petition is communicated within 30 days of its registration date. If the petition has been forwarded, the time limit runs from its registration with the competent public authority or institution. For more detailed enquiries and investigation, the head of the public authority or institution may extend the time limit by no more than 15 days, provided that you are notified of the extension in advance, under Articles 8 and 9 of Government Ordinance No. 27/2002. These provisions do not require the vehicle to be removed within 30 days.
  • The 10-day time limit in the formal notice affixed to the vehicle’s bodywork concerns a separate stage under Article 3(2) of Law No. 421/2002. This time limit does not start when the petition is submitted. The checks, other formal notices and issuing of the mayor’s orders have their own conditions and starting points.
  • Use the calculator for the time limits for responding to a petition. Under Article 2.553 of the Civil Code, the first and last days are not counted, and Article 2.554 of the Civil Code applies if the last day is a non-working day. Do not add up the time limits in the special procedure to infer a guaranteed date for the vehicle’s removal.
  • If the response states that the procedure has begun, follow its progress from the stage indicated in the response and ask for clarification about the measures that still need to be taken. If new facts arise, send them with a reference to the registration number and date of the earlier petition.
  • If you send several petitions about the same issue to the same public authority or institution, they are joined and you receive a single response covering all of them. After the response is sent, a new petition with the same content, received from you or from a public authority or institution contacted in error, is closed without further action, under Article 10 of Government Ordinance No. 27/2002.
  • If you do not receive a response within the statutory time limit, continue with the ‘I have not received a response to my petition’ guide. If you have yourself received a sanction or an order concerning the vehicle, check the special procedure and the time limit for challenging it immediately.
I have not received a response to my petition
