Excessive or repeated noise

Prepare a report about the situation you observed.

We help you choose the institution and prepare the text. We do not send anything on your behalf.

Check your safety and choose the appropriate procedure

Is there an immediate danger to people or the environment now?

  • Yes
  • No
  • I cannot assess this

Has anyone been injured or directly threatened?

  • Yes
  • No

What do you want to achieve?

  • Checking and remedying the situation
  • Existing documents or information
  • Challenging a penalty or an act you have received
  • Reporting a possible criminal offence

Is the incident happening now?

  • Yes
  • No
  • First, get to safety and request the necessary intervention. If there is an immediate danger, call 112. Do not fill in the form instead of requesting intervention.
  • Move away from the source of risk. Do not touch suspicious waste or containers. Use the verified contact details for intervention; not every violation justifies a call to 112.
  • Request medical care or intervention, depending on the situation. The criminal procedure is separate from a petition for preventive measures. You can return to this petition once you are safe.
  • Open the FEW guide to accessing public information. Keep the request for documents separate from the request for intervention.
  • Do not automatically use a petition as a substitute for challenging an act or a penalty. Check the special procedure and the applicable time limit.
  • Follow the criminal procedure and check the formal requirements for submission. The time limit calculator for petitions made under Government Ordinance No. 27/2002 does not apply to the criminal procedure.
  • Report the situation using the verified contact details for intervention and, where useful, prepare the written report separately.
  • Continue by identifying the authority and preparing the text.
Read the guide to Law No. 544/2001

112 emergency service

Emergency telephone number. Do not use it as a registry for a petition submitted under Government Ordinance No. 27/2002.

112

The single emergency telephone number available in Romania. It is not intended for submitting an administrative petition.

Tell the operator the location, landmarks and nature of the emergency, and answer their questions. Do not fill in the petition form first.

At all times, 24 hours a day, 7 days a week.

Identify the location and responsibilities for the situation reported

Who is responsible for what

Here you can find contact details for local or county institutions and, where applicable, for a national institution marked ‘National alternative’. Use the explanations in the guide to choose the right recipient for your problem. You send the report; the Foundation does not send anything on your behalf.

Checks concerning disturbance of the public peace; a noise measurement in decibels is not required to submit a petition.

  • Romanian Police

Alternative recipient for local responsibilities for public order and peace; do not automatically send the same petition to both the Romanian Police and the local police.

  • Local police

Checks on compliance with environmental obligations and the conditions laid down in the regulatory approvals applicable to the activity.

  • National Environmental Guard

Ask for checks on compliance with the applicable health standards and for a determination of whether an acoustic assessment is needed; do not assume that the public health directorate (DSP) carries out all measurements directly.

  • Public health directorate (DSP)

Identifying the recipient for the source described and forwarding the petition where necessary.

  • Mayor’s office

Romanian Police

Check the competent institution’s contact details on its official page.

Identify the Romanian Police unit responsible for the location and nature of the events, and use its verified official contact details. For an administrative petition, use the registry address or petition form; for a criminal complaint, follow the formal requirements and method of submission indicated in the guide. In an emergency, call 112.

Prepare the text without the recipient’s email address

Local police

Check the competent institution’s contact details on its official page.

Check whether there is a local police service in the locality or sector concerned, and identify its official page or the page of the mayor’s office. If there is no local police service or you do not have confirmed contact details, use the verified Romanian Police contact details for disturbances of the peace. Do not assume the service operates around the clock.

Prepare the text without the recipient’s email address

National Environmental Guard

Check the competent institution’s contact details on its official page.

National alternative

National Environmental Guard

Environmental inspection of the documented matters. Identify the responsible territorial office (comisariat teritorial) separately.

gardamediu@gnm.ro

An official general email address that you can use as a national alternative for environmental reports.

Official source (opens in a new tab)
https://www.gnm.ro/sesizare/ (opens in a new tab)

Official report form. The field labels refer to complaints about an operator’s activities.

The form includes the field ‘Numele reclamatului’ (Name of the party complained about). If you do not know who did it, do not invent a name. If the form does not allow submission without this name, send the report by email to gardamediu@gnm.ro.

Use the file attachment field and check which file types and sizes the form accepts. If you cannot attach the evidence, send the report and the files to the official email address for reports.

Check the official form to see which fields are mandatory and which file types and sizes you can attach.

Official source (opens in a new tab)
021.326.89.70

Public relations telephone number. It is not presented as an emergency dispatch centre operating around the clock.

Official source (opens in a new tab)

Public health directorate (DSP)

Check the competent institution’s contact details on its official page.

Identify the public health directorate (DSP) for the county where the affected homes are located, or the Public Health Directorate of the Municipality of București. Look on its official page for the petition form or the registry’s contact details, and ask for compliance with health standards to be checked. Do not assume that the institution directly carries out every noise measurement.

Prepare the text without the recipient’s email address

Mayor’s office

Check the competent institution’s contact details on its official page.

Identify the mayor’s office responsible for the location and subject of the report and use its registry address or official petition form. In București, check whether responsibility lies with the municipality or sector authorities. If you do not know the responsible institution or administrator, ask for the recipient to be identified and, where applicable, for the petition to be forwarded to the competent authority.

Prepare the text without the recipient’s email address

Choose how to proceed: rapid response, a registered petition or both.

Rapid response

  • If violence, direct threats or another immediate danger arise, get to safety and follow the steps for an emergency response. Call 112 for a real emergency; noise alone does not establish that there is one.
  • For a disturbance of the public peace happening now, call the Romanian Police or the competent local police, if there are local police. Use a telephone number confirmed by official sources. State the address, the source of the noise if you know it, and what is happening at that moment.
  • For industrial noise, use the contact details of the territorial office of the National Environmental Guard (GNM), confirmed by official sources. Calling the public relations number and sending an email do not guarantee immediate intervention. If the public peace is also being disturbed at that moment, you can notify the Romanian Police using local contact details confirmed by official sources and describing the specific facts.
  • Do not confront the people involved, enter properties or construction sites, or approach machinery to identify the source.
  • After the call, prepare a written report if you want checks and a response under Government Ordinance No. 27/2002. Do not assume that the call has been registered as a petition.

Registered petition

  • Enter the petitioner’s identification details and the address for the response. Describe separately the known source, the place where you hear the noise, the dates and times, and the repeated nature of the noise.
  • For disturbance of the public peace, use the ‘Noise – checking for disturbance of the public peace’ template. A report addressed to the Romanian Police for this purpose is an administrative petition.
  • Article 2, point 26 of Law No. 61/1991 concerns the periods 22:00–08:00 and 13:00–14:00, in the places and circumstances specified by law. Article 2, point 25 of the same law is not limited to these periods. Not all ordinary noise automatically constitutes an administrative offence (contravenție).
  • For the effects of an activity on homes, you can ask the public health directorate (DSP) to check compliance with health standards. For environmental obligations relating to an industrial activity, contact the National Environmental Guard (GNM). Use the ‘Noise – assessment and reduction measures’ template, with the version appropriate to the recipient.
  • Health standards specify indicators, locations and periods for noise measurements. Ask for the assessment conditions to be determined; do not assume that the measurement periods specified in the health standards are identical to the quiet hours under Law No. 61/1991.
  • For another identified source, use the ‘Mayor’s office – identifying the competent authority’ version of the ‘Noise – assessment and reduction measures’ template. You do not have to identify the competent authority yourself.
  • If several authorities are displayed, choose the recipient for the specific issue you are reporting. Send a separate petition to another authority only for matters within its remit.
  • Ask for the registration number and date, the findings of the checks, the measures ordered and the legal basis for the outcome. If the matter is outside the authority’s remit, ask for the petition to be forwarded to the competent authority and request notification.
  • For copies of permits, inspection reports or the results of measurements already carried out, use the guide to requests under Law No. 544/2001 separately. A petition does not replace a criminal complaint or a challenge to a sanction.

If necessary, report the situation using the verified contact details for intervention. Send the written report separately to document the problem and request a response. State in the report that you have already reported the situation.

Prepare the report

Prepare the text. Provide only the necessary details. Check and edit the resulting text.

First answer the safety questions and identify the responsibilities.

Evidence and photographs

  • Keep a chronological record of the episodes: the date, approximate start and end times, breaks and recurrence. State when you heard the noise yourself.
  • Describe the type of noise, the place where it can be heard and the source you have direct knowledge of. Separate observations from assumptions.
  • You can keep short, relevant recordings made from a place where you are lawfully present, without monitoring private conversations or intrusively filming someone else’s home. Do not publish the personal data of the people involved.
  • Keep the original files. If you send extracts or copies from which you have removed data unrelated to the report, say so.
  • A phone app can provide indicative information. If you send the values displayed by the app, specify the device and the conditions in which you obtained them; do not present them as the results of official measurements or as conclusive proof that a limit value has been exceeded.
  • If you have them, give the numbers and dates of previous reports and attach the responses received. You do not need the results of an acoustic measurement before describing the facts in a petition.

Keep the originals in a safe place. Send only relevant images with your report. For publication, create copies with unnecessary data and identifying features removed.

A copy from which you have removed the photograph’s technical data, such as the date and location recorded by the device, does not replace the original. Nor do these data, taken alone, provide conclusive proof of when or where the photograph was taken.

Include faces, vehicle registration numbers and witnesses’ identities only when they are relevant to the recipient and the purpose of sending the material. Publication on a website serves a different purpose from private submission to an authority.

Mistakes to avoid

  • Assuming that noise is allowed without limits outside the periods 22:00–08:00 and 13:00–14:00.
  • Confusing quiet hours with the periods and conditions used to assess noise under health standards.
  • Presenting a phone app as an official sound level meter or claiming that a statutory limit value has been exceeded without an appropriate assessment.
  • Assuming that every locality has local police or that every authority has a laboratory for acoustic measurements.
  • Automatically asking the National Environmental Guard (GNM) to resolve any dispute between neighbours.
  • Confronting the people involved or entering a property or a construction site to obtain evidence.
  • Attributing the noise to a person without direct observations or publishing intrusive recordings.
  • Requesting a fine to be imposed automatically or treating a petition as a criminal complaint or as a means of challenging a sanction.

Keep proof and track the time limit

Keep the text actually sent, the evidence actually attached, confirmation of dispatch, confirmation of receipt or registration and any notification of forwarding or extension.

Sending the email, receiving the registration number and receiving the response are three separate events.

Indicative response dates

Indicative dates. Check the registration date with the competent authority and the advance notification of any extension. The calculator does not determine time limits for court or criminal proceedings.

When calculating a time limit in days, do not count the day it starts or the day on which it expires. If the final day is a non-working day, the time limit is extended to the next working day. The calendar covers 2024–2035 and includes Orthodox holidays with variable dates; check any additional days off observed by the institution separately.

Response: 30 days from registration
Possible extension: 45 days in total from the same registration – does not apply automatically
Forwarding: 5 days – a separate time limit

Next steps

  • Keep the petition, the annexes actually sent, the confirmation of submission and the registration number and date at each authority.
  • If the matter is outside its remit, the authority forwards the petition within 5 days of registration and notifies you. After forwarding, the response time limit runs from registration with the competent authority, under Article 6¹ and Article 8(2) of Government Ordinance No. 27/2002.
  • The standard response time limit is 30 days from registration. Article 9 of Government Ordinance No. 27/2002 allows an extension of up to 15 days for more detailed enquiries, with prior notification of the petitioner; for the energy and natural gas sector, there is a special rule allowing up to 30 additional days. Do not choose the special rule solely because the noise comes from an electrical appliance.
  • Use the response time limit calculator once you know the registration date from which the time limit is calculated: under Article 2.553 of the Civil Code, the first and last day are not counted; if the last day is a non-working day, Article 2.554 of the Civil Code applies. The response time limit is not a general time limit for stopping the noise or implementing all measures.
  • If the noise continues, describe the new episodes and relate them to the measures communicated. If you send the same public authority or institution several petitions about the same problem, they are combined and you receive a single response covering them all. After the response has been sent, a new petition with the same content, received from you or from a public authority or institution to which it was incorrectly addressed, is closed without further action, under Article 10 of Government Ordinance No. 27/2002.
  • If you do not receive a response within the statutory time limit, continue with the ‘I have not received a response to my petition’ guide. For information or copies of documents of public interest, submit a request under Law No. 544/2001. To report a possible criminal offence, contact the police or the prosecutor’s office, following the conditions and time limits in the Code of Criminal Procedure. To challenge an administrative act, check the procedure and time limits under Law No. 554/2004 or the applicable special remedy; for an official record of an administrative offence, check the complaint procedure for challenging it (plângere contravențională) under Government Ordinance No. 2/2001. An ordinary petition does not replace these procedures.
I have not received a response to my petition
