The shop refuses to accept a return or honour a guarantee

Find out when you can return a product, how to ask for a repair, replacement or refund, and how to submit a complaint to the National Authority for Consumer Protection (ANPC).

We help you choose the institution and prepare the text. We do not send anything on your behalf.

Check your safety and choose the appropriate procedure

Is the product currently putting people in immediate danger, for example through smoke, fire or electric shock?

  • Yes
  • No

Did you buy it for personal use from a seller acting in the course of their business or professional activities?

  • Yes
  • No
  • I do not know

Is the seller established in Romania?

  • Yes
  • No
  • I do not know

What is the main problem?

  • I have changed my mind and want to return the product
  • The product does not conform to the contract or does not work properly
  • The guarantee promised in the certificate or advertising is not being honoured
  • I want to submit a complaint so that the refusal can be checked

Is it a distance contract or an off-premises contract?

  • Yes
  • No, it was concluded in the shop
  • I cannot tell
  • Stop using the product if you can do so safely, move away and call 112 when there is an immediate danger. Do not test the product, photograph it close up or transport it to prepare the complaint.
  • Purchases for business or professional purposes and sales between private individuals are subject to different rules. Check your contractual rights and the applicable procedure; this distinction does not mean that you have no rights.
  • Check the invoice, order, contract and information about the seller. An individual may sell in the course of their business or professional activities. Do not automatically assume that the platform operator is the seller.
  • Check the applicable law and the procedure for a trader from another country. If you are resident in Romania, the European Consumer Centre may offer help with the amicable settlement of certain disputes with traders from the European Union, Norway or Iceland, subject to its conditions.
  • Inform the seller in writing about the lack of conformity. Check the date the contract was concluded, the delivery date, the date the lack of conformity was first identified and the remedy you can request. For services and standalone digital content, check the separate rules.
  • Identify the guarantor, the period and the benefit promised. Use the ‘Request to honour the commercial guarantee’ template only for an undertaking that falls within this category, without giving up your statutory rights against the seller.
  • Prepare the standard complaint with the trader’s details, the facts, the evidence and the outcome you seek. The complaint does not replace notification of withdrawal and does not extend the time limit for it.
  • Check the 14 or 30-day period, the delivery arrangements, the information provided and the exceptions. If you have the right of withdrawal, send a clear statement of withdrawal within the time limit and keep proof.
  • If you change your mind after concluding a contract in a shop, there is no general statutory right to return the product within 14 days. Check the returns policy agreed in the contract. For a non-conforming product, use the separate rights under the legal guarantee.
  • Check when and how the contract was concluded. Simply collecting the product from the shop does not rule out a distance contract, and merely making an online reservation does not prove that you concluded such a contract.

112 emergency service

Emergency telephone number. Do not use it as a registry for a petition submitted under Government Ordinance No. 27/2002.

112

The single emergency telephone number available in Romania. It is not intended for submitting an administrative petition.

Tell the operator the location, landmarks and nature of the emergency, and answer their questions. Do not fill in the petition form first.

At all times, 24 hours a day, 7 days a week.

Identify the location and responsibilities for the situation reported

Who is responsible for what

Here you can find contact details for local or county institutions and, where applicable, for a national institution marked ‘National alternative’. Use the explanations in the guide to choose the right recipient for your problem. You send the report; the Foundation does not send anything on your behalf.

Address the notification to the seller with whom you concluded the contract. Check the withdrawal period and the applicable exceptions. Under Article 11 of Government Emergency Ordinance No. 34/2014, you can use an unequivocal statement; the trader’s form is not the only permitted format.

  • Seller under the contract

For a contract concluded in a shop, there is no general right to withdraw within 14 days simply because you have changed your mind. If returns were promised in the contract, ask for the terms supported by evidence to be applied. The template for exercising the statutory right of withdrawal does not apply automatically.

  • Seller under the contract

Ask the seller for the remedy permitted by Government Emergency Ordinance No. 140/2021. Sending the product to a repair workshop does not remove the seller’s statutory liability. Ask for proof that you handed over the item and a time limit agreed in writing for repair or replacement.

  • Seller under the contract

Address the request to the guarantor identified in the certificate or advertising. If the guarantor is different from the seller, also inform the seller about the lack of conformity, because Article 15(12) of Government Emergency Ordinance No. 140/2021 links the time limit for repair or replacement to the seller being informed.

  • Seller or producer providing the commercial guarantee
  • Seller under the contract

You can ask the National Authority for Consumer Protection (ANPC) to check the situation. Under the law, the authority may also order remedial action, replacement or a refund, without any guarantee of a favourable outcome. For an individual response, submit the standard complaint.

  • National Authority for Consumer Protection (ANPC) – territorial office

Seller under the contract

Check the competent institution’s contact details on its official page.

Identify the seller’s name and details from the receipt, invoice, order confirmation or contract. If you use an online platform, check who sells the product and the published information about how obligations are shared in the transaction. Use the seller’s contact address or official procedure and keep proof of sending the message.

Seller or producer providing the commercial guarantee

Check the competent institution’s contact details on its official page.

Look for the guarantor’s name and address in the guarantee certificate and the relevant advertising. The guarantor may be the seller or the producer. Follow the procedure specified for the guarantee and also inform the seller of the lack of conformity if the seller is not the guarantor. If the additional protection offered at the time of purchase is, in fact, insurance, check the terms of the insurance contract separately.

National Authority for Consumer Protection (ANPC) – territorial office

Check the competent institution’s contact details on its official page.

Identify the territorial office responsible for the reported location and use its verified contact details. If these are unavailable, use the verified national contact details of the National Authority for Consumer Protection (ANPC). To have the report registered and follow up on the response, choose the standard report; a quick notification may guide inspections, but does not replace it.

Official access point for the electronic services of the National Authority for Consumer Protection (ANPC). Choose the ‘Reclamații Consumatori’ (Consumer complaints) category and the standard report, which receives a registration number and is handled under the consumer complaints procedure. The authority describes the quick notification as a possible basis for inspections and checks on specific topics, without the procedure for handling a complaint; do not use it in place of the standard report if you want to follow up on registration and the response. If the form does not allow you to describe the actual situation, use another method of submitting a complaint officially indicated by the authority.

Rapid response

  • If the product causes smoke, fire, electric shock or another immediate danger, move away and ask for the necessary assistance. Do not continue using or testing the product to obtain evidence.
  • Identify the seller from the invoice, receipt, order or contract. The seller may be different from the online platform operator, the producer or the person who carries out repairs.
  • If you want to withdraw from a distance contract and the statutory conditions are met, send a clear statement of withdrawal immediately and keep proof. Do not wait for an authority to handle the complaint.
  • For contracts concluded through an online interface, the trader must provide the withdrawal function specified in Article 11¹ of Government Emergency Ordinance No. 34/2014. If it is missing or does not work, send an unequivocal statement of withdrawal by another means and keep evidence of the problem.
  • If the product is non-conforming, inform the seller in writing and record the delivery date and the date the lack of conformity was first identified separately. For a lack of conformity identified shortly after delivery, within no more than 30 calendar days, the law provides for replacement.
  • Keep proof that you handed over the product and a description of its condition. For a dangerous product, ask for safe collection instructions; do not transport or send it without a risk assessment.

The written document

  • The rights below concern purchases for personal use from a seller acting in the course of their business or professional activities. An individual can be a trader; their legal form is not the only criterion. Transactions between private individuals and purchases for business or professional purposes require a separate assessment.
  • Use the templates based on Romanian law after checking whether it applies. For a trader from another country, check the applicable law and the support available before invoking time limits under Romanian law as binding on them.
  • Distinguish withdrawal from a contract because you have changed your mind from rights in the event of a lack of conformity. For distance or off-premises contracts, the withdrawal period is generally 14 days. For unsolicited visits by the trader to your home and excursions organised by a trader with the purpose or effect of promoting or selling goods to consumers, the period is 30 days.
  • For goods, the withdrawal period generally starts on the date you receive them. For goods in a single order delivered separately, the relevant date is the date you receive the last item; for an item delivered in lots or pieces, the date you receive the last lot or piece; for regular deliveries over a specified period, the date you receive the first item.
  • Check the exceptions in Article 16 of Government Emergency Ordinance No. 34/2014. These include personalised goods, perishable goods and sealed goods that cannot be returned for health protection or hygiene reasons and that have been unsealed by the consumer. For unsolicited visits and excursions organised under the conditions laid down by law, some exceptions do not apply, including those concerning personalisation and the goods specified in Article 16(1)(e) of Government Emergency Ordinance No. 34/2014.
  • Opening ordinary packaging does not automatically mean that an exception to the right of withdrawal applies. Handling the product beyond what is necessary to check it may lead to a reduction in its value, as provided by law, without an automatic restocking fee. An exception to the right of withdrawal does not remove your rights in the event of a lack of conformity.
  • If you did not receive the information required by law about the right of withdrawal, check the extension provided for in Article 10 of Government Emergency Ordinance No. 34/2014. If the information was provided later, record the date you received it and take this into account when calculating the time limit.
  • After withdrawal, send the item within the separate 14-day time limit, unless the trader has offered to collect it. The refund has its own 14-day time limit from the date the trader is informed, with the statutory possibility of withholding it until the item or proof of dispatch is received. A new 14-day time limit does not automatically begin when the item reaches the shop.
  • On withdrawal, you may have to bear the direct cost of returning the item if you received information about this cost and the trader did not agree to bear it. The refund includes delivery costs refundable under the law, excluding the extra cost of a more expensive delivery option expressly chosen. For partial withdrawal, identify the goods and amounts concerned.
  • For a contract concluded in a shop, there is no general right to return the product within 14 days simply because you have changed your mind. If the shop has committed in the contract to accept returns, ask it to honour the terms you can provide evidence of. An online reservation followed by conclusion of the contract in a shop is not automatically a distance contract.
  • The legal guarantee concerns conformity with the description, the characteristics promised, the agreed purpose and normal use. The seller is normally liable for a lack of conformity that existed on delivery and was identified within two years. For second-hand goods, a shorter period may be agreed, but it must be at least one year.
  • A lack of conformity identified in the first year is presumed to have existed on delivery, subject to the exceptions provided by law. This one-year period is not the general duration of the guarantee. The absence of a commercial guarantee certificate does not remove the legal guarantee.
  • Ask the seller for repair or replacement, as you choose and within the statutory limits. Repair or replacement must be carried out free of charge, without any significant inconvenience and within a reasonable time limit, agreed in writing, of no more than 15 calendar days from the date the seller is informed. Make the item available to the seller safely.
  • A proportionate price reduction or termination of the contract can be requested in the circumstances specified in Article 11(4) of Government Emergency Ordinance No. 140/2021, including where remedial action has been refused or has failed, or where the lack of conformity is sufficiently serious. There is no general rule requiring three repairs. You cannot obtain termination of the contract for a minor lack of conformity; the seller must prove that it is minor.
  • When the contract is terminated for lack of conformity, the seller bears the cost of the return and the refund is made when the item or proof of return is received. The 14-day time limit specific to withdrawal following a change of mind is not added.
  • The commercial guarantee binds the guarantor in accordance with the certificate and the relevant advertising. A commercial guarantee of durability has its own rules on extension after repair and on starting a new period after replacement. Insurance sold as an ‘extended guarantee’ must be assessed separately.
  • For goods with digital elements, where digital content or digital services are supplied continuously, there are special liability periods of two years, five years or a contractual period longer than five years, under Article 9(3)–(4) of Government Emergency Ordinance No. 140/2021. For standalone digital content, services and older contracts, the separate rules need to be checked.
  • If you submit a complaint to the National Authority for Consumer Protection (ANPC), describe the facts and identify the trader complained about, the request you sent to them and the response received. Contacting the trader directly is useful, but you are not generally required to wait 30 days for the shop’s response before submitting a complaint.
  • In the official portal, open the ‘Reclamații Consumatori’ (‘Consumer complaints’) category, sign in and choose the standard complaint. Enter the details required, attach the relevant documents and keep the registration number and date. Check communications in ‘Cererile Mele’ (‘My requests’).

Request concerning a non-conforming product – legal guarantee

Request

For a consumer asking the seller for a remedy in relation to a non-conforming item under Government Emergency Ordinance No. 140/2021. Check the contract date and the rules applicable to the item. For a price reduction or termination of the contract, you must describe the situation specified by law that justifies the remedy.

Seller
Enter the seller’s name as shown in the transaction documents, even if a repair workshop or the producer carries out the repair.
Consumer’s name and contact details
Enter the details needed to identify the buyer and the contract. Do not enter the personal numeric code in the generator.
Product and purchase
State the product, the number and date of the receipt, invoice or order, and the price paid. If relevant, also state the product’s serial number.
Delivery and identification of the lack of conformity
Record the delivery date, the date the lack of conformity was first identified and the date the seller was first informed separately. For replacement following a lack of conformity identified in the first 30 days after delivery, the date on which the lack of conformity was identified matters.
Lack of conformity
Describe the specific problem and how the product is used. Do not carry out dangerous tests to complete this field.

For submission on paper, sign the complaint. For online submission, follow the official portal’s requirements and keep the registration number and date. The form does not send the complaint.

Evidence and photographs

  • The receipt, invoice, order confirmation, contract or other proof of purchase and payment.
  • The seller’s name, address and details from the transaction documents; for online platforms, information about the actual seller.
  • Proof of delivery and, if there are separate deliveries, the date of each one.
  • The product description, offer and advertising relevant at the time of purchase.
  • The withdrawal and return conditions provided, including the date of any information provided later.
  • The notification of withdrawal and proof of sending it; proof of informing the trader, where the date differs.
  • Proof of dispatch and handover of the product, identifying the item.
  • Photographs or recordings made safely that show the lack of conformity without recreating a dangerous situation.
  • The request for remedial action, the date the seller was informed, the time limit agreed in writing and the documents relating to previous repairs.
  • The commercial guarantee certificate and advertising relating to it, if you rely on such an undertaking.
  • The refusal received and all relevant correspondence, without passwords, access codes or payment details that are not needed.

Keep the originals in a safe place. Send only relevant images with your report. For publication, create copies with unnecessary data and identifying features removed.

A copy from which you have removed the photograph’s technical data, such as the date and location recorded by the device, does not replace the original. Nor do these data, taken alone, provide conclusive proof of when or where the photograph was taken.

Include faces, vehicle registration numbers and witnesses’ identities only when they are relevant to the recipient and the purpose of sending the material. Publication on a website serves a different purpose from private submission to an authority.

Mistakes to avoid

  • Assuming that any product bought from a physical shop can be returned within 14 days simply because you have changed your mind.
  • Confusing an online reservation with the conclusion of a distance contract.
  • Sending the request only to the platform operator, without identifying the seller.
  • Waiting for the shop’s approval or an authority’s response until the withdrawal time limit expires.
  • Refusing the parcel without a clear statement of withdrawal.
  • Automatically applying the health protection or hygiene exception to the right of withdrawal to any item whose packaging has been opened.
  • Confusing the legal guarantee with the commercial guarantee certificate or an insurance policy.
  • Accepting the idea that only the producer or repair workshop is responsible for the legal guarantee.
  • Assuming that three repairs must be carried out before a price reduction or termination of the contract.
  • Using the same start date for the time limit for notifying withdrawal, the time limit for dispatching the item and the time limit for a refund.
  • Sending the full card number, the security code or a copy of your identity document without a justified need.

Time limits for your submission

Notification of withdrawal – standard period

14 calendar days

Receipt of the item by the consumer or by a third party designated by the consumer, other than the carrier; for special delivery arrangements, the date determined under Article 9(2)(b) of Government Emergency Ordinance No. 34/2014.

Article 24 of Government Emergency Ordinance No. 34/2014: the day of the event is not counted; the final day is included, with the corresponding extension if it is a non-working day.

For goods from a single order delivered separately, the relevant date is the date of receipt of the last item; for deliveries in lots, the date of receipt of the last lot or last piece; for regular deliveries over a specified period, the date of receipt of the first item. Check the exceptions. The notification must be sent within the time limit.

Notification of withdrawal – unsolicited visit or sales excursion

30 calendar days

The date of receipt of the item, determined under Article 9(2)(b) of Government Emergency Ordinance No. 34/2014.

Article 24 of Government Emergency Ordinance No. 34/2014: only the day of the event is excluded; if the final day is a non-working day, the corresponding extension applies.

Only for contracts concluded in the special situations provided for in Article 9(1) of Government Emergency Ordinance No. 34/2014. Also check the derogation from certain exceptions provided for in Article 16(2) of the same emergency ordinance.

Withdrawal where the legally required information about this right has not been provided

12 months

The end of the initial withdrawal period of 14 or 30 days.

Article 10(1) and Article 24(3) of Government Emergency Ordinance No. 34/2014, supplemented, for periods in months, by Article 2.552 of the Civil Code.

This time limit applies only if the legally required information about the right of withdrawal has not been provided. If you received it later, check Article 10(2) of Government Emergency Ordinance No. 34/2014 separately.

Withdrawal following later provision of information – 14 days

14 calendar days

Receipt of the information about withdrawal, if it was provided under the conditions in Article 10(2) of Government Emergency Ordinance No. 34/2014.

Article 24 of Government Emergency Ordinance No. 34/2014; only the day on which the information was received is excluded.

The legal condition concerns provision of the information within 12 months of the date determined under Article 9(2) of Government Emergency Ordinance No. 34/2014, not within 12 months of the end of the initial withdrawal period.

Withdrawal following later provision of information – special 30-day case

30 calendar days

Receipt of the information about withdrawal in the special case and under the conditions in Article 10(2) of Government Emergency Ordinance No. 34/2014.

Article 24 of Government Emergency Ordinance No. 34/2014; only the day on which the information was received is excluded.

This time limit applies only if the initial withdrawal period was 30 days. It does not automatically apply to all purchases.

Dispatching the item after withdrawal

14 calendar days

The consumer’s communication of the decision to withdraw.

Article 14(1) and Article 24 of Government Emergency Ordinance No. 34/2014; the day of the event is excluded.

The item must be dispatched within the time limit, without undue delay. Check the applicable rule if the trader has offered to collect it.

Refund after withdrawal

14 calendar days

Informing the trader of the decision to withdraw.

Article 13 and Article 24 of Government Emergency Ordinance No. 34/2014; the day of the event is excluded.

If the trader has not offered to collect the item, they may withhold the refund until they receive the item or proof of dispatch, whichever happens first. Receipt of the item does not start a new 14-day time limit.

Standard period of liability for lack of conformity

2 years

Delivery of the item.

Article 9(1)–(2) of Government Emergency Ordinance No. 140/2021 and Articles 2.551–2.554 of the Civil Code, with the rule for years in Article 2.552.

Liability concerns a lack of conformity that existed at delivery and was identified within this period. After repair, the period is extended by the actual period during which the item was not working, as provided for in Article 12(6) of Government Emergency Ordinance No. 140/2021; after replacement, a new period starts to run from the date of replacement. This is not a universal time limit for every complaint or court case.

Minimum reduced period for a second-hand item

1 year

Delivery of the second-hand item.

Article 9(5) of Government Emergency Ordinance No. 140/2021 and Article 2.552 of the Civil Code.

This is the minimum period that can be agreed, not the period that automatically applies to all second-hand goods. Use the period actually agreed for the calculation; if you do not have confirmation of a reduction, do not automatically apply the one-year period.

Use this time limit as a guide and check whether it applies to your situation.

Presumption that the lack of conformity existed at delivery

1 year

Delivery of the item.

Article 10(1)–(2) of Government Emergency Ordinance No. 140/2021 and Article 2.552 of the Civil Code.

It can be proved that the lack of conformity did not exist at delivery. The rule has exceptions relating to the nature of the item or the lack of conformity. For the continuous supply of digital content or digital services, there is a separate rule in Article 10(3) of Government Emergency Ordinance No. 140/2021.

Lack of conformity identified shortly after delivery – right to replacement

30 calendar days

Delivery of the item.

Article 11(7) of Government Emergency Ordinance No. 140/2021, supplemented by Article 2.551, Article 2.553 and Article 2.554 of the Civil Code.

The date on which the lack of conformity was identified is relevant, not just the date of the request. The first and last days are calculated under the general rule, which differs from the rule in Article 24 of Government Emergency Ordinance No. 34/2014. Inform the seller immediately.

Repair or replacement under the legal guarantee

15 calendar days

The consumer informing the seller of the lack of conformity.

Article 12(1)(b) of Government Emergency Ordinance No. 140/2021, supplemented by Article 2.551, Article 2.553 and Article 2.554 of the Civil Code.

Also keep track of any shorter reasonable time limit agreed in writing. The statutory time limit does not automatically start to run when the repair workshop examines the product. Make the item available to the seller.

Repair or replacement under the commercial guarantee

15 calendar days

Informing the seller of the lack of conformity, under Article 15(12) of Government Emergency Ordinance No. 140/2021.

Article 15(12) of Government Emergency Ordinance No. 140/2021, supplemented by Article 2.551, Article 2.553 and Article 2.554 of the Civil Code.

If the guarantor is a different person from the seller, note the date the guarantor was informed and the date the seller was informed separately. This time limit is not the total duration of the commercial guarantee and does not automatically apply to an insurance policy.

Liability for lack of conformity of digital content or a digital service, where either is supplied continuously – goods with an average service life of more than five years

5 years

Delivery of the item with digital elements.

Article 9(3) of Government Emergency Ordinance No. 140/2021 and Article 2.552 of the Civil Code.

Only where digital content or a digital service is supplied continuously, under the conditions laid down by law. For products with an average service life of up to five years, the corresponding statutory period is two years. If the continuous supply provided for in the contract exceeds five years, the period specified in the contract applies, under Article 9(4) of Government Emergency Ordinance No. 140/2021.

Use this time limit as a guide and check whether it applies to your situation.

Response to the complaint registered by the responsible authority

30 calendar days

Registration of the complaint with the responsible authority.

Article 8 of Government Ordinance No. 27/2002, supplemented by Article 2.551, Article 2.553 and Article 2.554 of the Civil Code.

This time limit applies to the standard administrative complaint, not to the request to the shop, the European Consumer Centre procedure or the alternative dispute resolution procedure.

Extension of the response time limit

15 calendar days

The initial response time limit that is lawfully extended.

Article 9 of Government Ordinance No. 27/2002 and the rules in Article 2.551, Article 2.553 and Article 2.554 of the Civil Code.

At most 15 days, with prior notification to the petitioner. Calculate the total time limit from the complaint’s registration date; do not automatically add an extra day between the initial period and the extension period.

Use this time limit as a guide and check whether it applies to your situation.

Forwarding a misdirected complaint

5 calendar days

Registration of the complaint with the authority to which it was incorrectly addressed.

Article 6¹ of Government Ordinance No. 27/2002, supplemented by Article 2.551, Article 2.553 and Article 2.554 of the Civil Code.

The petitioner is notified. The response time limit starts to run when the complaint is registered with the responsible authority.

Next steps

  • Keep the text actually sent, the annexes and proof of sending and receipt.
  • After repair, note the period during which the item was not working, from informing the seller to handover of the item in working order. After replacement, note the new start date of the liability period under the legal guarantee.
  • If the response to the complaint registered by the National Authority for Consumer Protection (ANPC) is delayed, check the time limit applicable to petitions and continue with the guide ‘I have not received a response to my petition’.
  • For alternative dispute resolution, check the separate procedure described at https://www.anpc.ro/sal. This requires an attempt to resolve the matter directly with the trader and has its own admissibility conditions; it is not the standard administrative complaint.
  • If you reside in Romania and the seller is from another European Union country, Norway or Iceland, you can check whether the European Consumer Centre Romania can help you reach an amicable settlement of the dispute. Consult https://eccromania.ro/despre-noi/competenta_eccro/ and the official form. The Centre has its own conditions and does not intervene alongside all other procedures.
  • For traders from other countries, or if it is unclear which law applies, seek guidance before automatically using the templates based on Romanian law.
  • For damages and for a dispute that remains unresolved, check whether you can bring a claim before the court with jurisdiction. The guide provides guidance for this stage, without a claim template that is valid for every situation.
  • After the standard two-year period expires, you may have rights relating to latent defects (vicii ascunse), under the conditions laid down by law. Do not assume that expiry of the period shown by the time limit calculator means that you no longer have any rights.
