I have not received my salary

Learn how to request payment of salary arrears, when to report the situation to the Territorial Labour Inspectorate (ITM) and how to apply to the tribunal for payment of your entitlements.

We help you choose the institution and prepare the text. We do not send anything on your behalf.

Check your safety and choose the appropriate procedure

Is there an immediate danger, violence or a medical emergency now?

  • Yes
  • No
  • I cannot assess this

Under what arrangements did you carry out the work?

  • Under an individual employment contract, including if I do not have a copy
  • Without a written contract or in a situation I cannot clarify
  • In a civil service post, through self-employment or abroad

Has the opening of insolvency proceedings or proceedings for an arrangement with creditors (concordat preventiv) concerning your employer been confirmed?

  • Yes
  • No
  • I do not know

What problem do you want to resolve?

  • Non-payment, partial payment or late payment of the monthly salary
  • Challenging an employer’s decision
  • Other entitlements relating to overtime, allowances or leave

What do you want to prepare?

  • A request for payment to the employer
  • A report to the Territorial Labour Inspectorate (ITM) asking it to check the situation
  • A claim to the tribunal for payment
  • Information of public interest about an institution’s activities
  • Reporting threats, violence or other criminal acts
  • Get to safety and call 112. Answer the operator’s questions. Do not delay requesting intervention to answer the guide’s questions or complete the letters.
  • Move away from the source of danger. If someone is in immediate danger or needs emergency medical help, call 112. Non-payment of salary is not, in itself, a reason to call the emergency service.
  • You can prepare a report to the Territorial Labour Inspectorate (ITM). Describe the work and the remuneration agreed. The absence of a written contract does not automatically mean you cannot claim payment, but the court claim must be adapted to your situation.
  • Check the procedure that applies to your civil service relationship (raport de serviciu), services contract or work abroad. The court claim template and the time limit calculator for salaries due under an individual employment contract do not automatically apply.
  • Check how to recover your salary through the proceedings that have been opened. Identify, as applicable, the appointed administrator of an arrangement with creditors (administrator concordatar), court-appointed administrator (administrator judiciar) or court-appointed liquidator (lichidator judiciar). Ask the appointed person for information about the unpaid salary recognised in the proceedings and the time limits for challenging an omission or an incorrect amount. Ask the territorial employment agency for information about payment from the Guarantee Fund for the Payment of Salary Claims. Conditions may differ for amounts due before and after the proceedings are opened.
  • A decision to change your salary, impose a sanction or terminate your contract may have a separate, shorter time limit for challenge. Do not use the three-year time limit for salaries as the time limit for challenging that decision. Immediately check the document and the date it was served on you or you became aware of it.
  • You can report the situation to the inspectorate for checks. Check the due dates and calculation of amounts for overtime, allowances or leave entitlements separately. For court proceedings, adapt the claim to the entitlements you are seeking; the simple template concerns monthly salary arrears.
  • Prepare the request for payment and keep proof of delivery. The request is not a general condition for bringing proceedings before the tribunal and does not automatically stop the limitation period from running.
  • Prepare the petition to the Territorial Labour Inspectorate (ITM). The inspectorate can carry out checks and order the measures provided for by law; to recover the money through court proceedings, you must apply separately to the tribunal.
  • Prepare the claim for salaries that remain unpaid. You can file the claim yourself, without a lawyer. Do not wait for the inspectorate’s response if the limitation period is nearing expiry. If your salary has already been paid in full and you are seeking damages alone, the claim must be adapted.
  • For information of public interest about an institution’s activities, open the guide to requests made under Law No. 544/2001. Documents concerning your own salary are requested from the employer or in the relevant procedure.
  • Reporting a criminal matter is separate from the petition for an inspection and the salary payment claim. If you are safe, contact the police or the competent prosecutor’s office and check how to submit the report. Non-payment of salary does not, in itself, mean that a criminal offence has been committed.
Read the guide to Law No. 544/2001

112 emergency service

Emergency telephone number. Do not use it as a registry for a petition submitted under Government Ordinance No. 27/2002.

112

The single emergency telephone number available in Romania. It is not intended for submitting an administrative petition.

Tell the operator the location, landmarks and nature of the emergency, and answer their questions. Do not fill in the petition form first.

At all times, 24 hours a day, 7 days a week.

Identify the location and responsibilities for the situation reported

Who is responsible for what

Here you can find contact details for local or county institutions and, where applicable, for a national institution marked ‘National alternative’. Use the explanations in the guide to choose the right recipient for your problem. You send the report; the Foundation does not send anything on your behalf.

Address the request to the employer identified in your contract. Under Article 166 of the Labour Code, salary must be paid at least once a month, on the date set by the applicable documents. Ask for payment of the arrears and an explanation of the calculation. If you learn that insolvency proceedings or proceedings for an arrangement with creditors (concordat preventiv) have been opened, check the special recovery procedure.

  • Employer

You can report the situation to the Territorial Labour Inspectorate (ITM), asking it to check whether your rights are being respected, under Articles 6 and 19 of Law No. 108/1999. State your employer’s registered office and where you worked. If the institution you contact is not competent, the petition is forwarded to the competent institution under Article 6¹ of Government Ordinance No. 27/2002. The inspection does not replace the claim for payment to the tribunal.

  • Territorial Labour Inspectorate (ITM)

To obtain an order requiring your employer to pay salary arrears, you can apply to the tribunal for the area of your domicile, residence or place of work, under Article 269 of the Labour Code. You do not need to wait for the petition to the inspectorate to be handled. Check the three-year time limit for each amount due; if an employer’s decision must also be challenged, check the time limit for that challenge separately.

  • Tribunal with jurisdiction over the employment dispute

Employer

Check the competent institution’s contact details on its official page.

Identify the employer from the individual employment contract, addenda or employment documents. Use the name and domicile of the individual or the name and registered office of the organisation that employed you, together with their official correspondence details. Your line manager’s name does not always identify the employer. If your contractual situation is unclear, describe it to the Territorial Labour Inspectorate (ITM).

Choose how to proceed

Rapid response

  • If there is violence, threats creating an immediate danger or a medical emergency, get to safety and call 112. Preparing documents can wait.
  • Check the payment date in your individual employment contract, the applicable collective labour agreement or the internal rules. Do not assume that all salaries must be paid on the same day of the month.
  • For each month, note the salary due, the date set for payment, the amount received and the outstanding difference. Do not subtract the net amount received in your account from the gross salary stated in your contract.
  • If three years will soon have passed since an amount fell due, or you have received a decision reducing your salary, imposing a sanction on you or terminating your contract, seek help immediately to check the applicable time limit.

The written document

  • The salary payment templates are for employees and former employees with an individual employment contract. Staff employed by a public institution under employment contracts must be distinguished from civil servants, who have civil service relationships (raporturi de serviciu).
  • Choose the right document: a request for payment to the employer, a petition for an inspection to the Territorial Labour Inspectorate (ITM) or a statement of claim to the tribunal.
  • For non-payment of salary, identify the inspectorate for the county where your employer has its registered office. If you work in another county, also state your workplace address in the report. If you cannot identify the inspectorate, use the verified contact details of the Labour Inspection Office (IM).
  • In your petition to the inspectorate, enter your surname, given name and address for the response. Ask to be informed of the registration number and date, the findings of the checks and the legal basis for the outcome.
  • For payment of salary arrears, you can apply to the tribunal for the area of your domicile, residence or place of work, under Article 269 of the Labour Code. You can file the claim yourself, without a lawyer, complying with the content requirements of the Code of Civil Procedure.
  • The claim concerning the employment dispute is exempt from judicial stamp duty. There may be other legal costs. If you cannot afford them, you can apply for legal aid (ajutor public judiciar), under Government Emergency Ordinance No. 51/2008.
  • The tribunal claim template concerns monthly salary arrears. For overtime, allowances, compensation for untaken leave, interest, adjustment of amounts or other damages, check the documents and adapt the claim to the entitlements you are seeking.
  • If insolvency proceedings or proceedings for an arrangement with creditors (concordat preventiv) have been opened, check separately how you can recover your salary, in consultation with the appointed administrator of an arrangement with creditors (administrator concordatar), court-appointed administrator (administrator judiciar) or court-appointed liquidator (lichidator judiciar), as applicable, and the territorial employment agency. Payment from the Guarantee Fund for the Payment of Salary Claims is subject to certain conditions and limits, and specific documents are required.

Prepare the document

Prepare the text. Provide only the necessary details. Check and edit the resulting text.

Sign the claim. The name printed by the generator does not replace a signature. You can submit the claim at the registry, by post or courier, or by the accepted electronic method. Article 199(1) of the Code of Civil Procedure also allows a signed claim to be scanned and submitted by email. For paper submissions, prepare one copy for the court and one for each party on whom the claim must be served, with the necessary annexes. Certify the copies as true copies of the originals under Article 150 of the Code of Civil Procedure, and keep the originals.

Evidence and photographs

  • The individual employment contract and addenda, if you have them. The absence of your copy does not, on its own, prove that no contract exists.
  • The document establishing the salary and its due date: the individual employment contract, the applicable collective labour agreement or the internal rules.
  • A breakdown for each month showing the amounts due, due dates, payments received and differences claimed. Calculate the differences using gross amounts or net amounts consistently.
  • Relevant bank statements or other proof of payments. Keep the originals and limit the copies you send to the necessary information.
  • Timesheets, schedules, messages about the work performed and correspondence about salary payment, lawfully obtained and retained.
  • Previous requests, proof of their delivery, the employer’s responses and any acknowledgements of the debt.
  • Evidence of loss, if you are making a separate claim for damages. Even though the burden of proof rests with the employer, you must explain what you are claiming and for which periods.

Keep the originals in a safe place. Send only relevant images with your report. For publication, create copies with unnecessary data and identifying features removed.

A copy from which you have removed the photograph’s technical data, such as the date and location recorded by the device, does not replace the original. Nor do these data, taken alone, provide conclusive proof of when or where the photograph was taken.

Include faces, vehicle registration numbers and witnesses’ identities only when they are relevant to the recipient and the purpose of sending the material. Publication on a website serves a different purpose from private submission to an authority.

Mistakes to avoid

  • Waiting for the inspectorate’s response until the limitation period for salary arrears expires.
  • Confusing a fine or inspection measures with the actual recovery of the money.
  • Signing a document stating that you have received money you have not received.
  • Assuming that accepting a partial payment means waiving the rest of your salary.
  • Applying the three-year time limit to a challenge against a decision imposing a sanction, dismissing you or changing your salary without checking the separate time limit for the challenge.
  • Assuming that a simple request, petition or discussion with the employer automatically interrupts the limitation period.
  • Sending the same letter and all the annexes to the employer, the inspectorate and the court at the same time.
  • Using the standard court claim template without checking whether insolvency proceedings or proceedings for an arrangement with creditors (concordat preventiv) have already been opened.

Time limits for your submission

The time limit for responding to a petition and the time limit for a claim for payment to the tribunal are different. Keep track of them separately.

Limitation period for each outstanding salary payment

3 years

The date on which each salary entitlement was due for payment.

Articles 2.552 and 2.554 of the Civil Code: the period expires on the corresponding day of the final year; if there is no corresponding day, on the last day of the month. If the last day is a non-working day, the statutory extension applies. For filing a procedural document, also check Articles 182–183 of the Code of Civil Procedure.

Calculate separately for each due date. Do not convert three years into 1,095 days. Do not apply this time limit to a challenge against an employer’s decision. The effects of an acknowledgement of debt and of other grounds for suspension or interruption must be checked in each case; reporting the matter to the inspectorate does not mean that the period automatically starts running again.

Forwarding the petition to the competent institution

5 calendar days

Registration of the petition with the institution initially contacted, which is not competent to handle it.

Articles 2.553 and 2.554 of the Civil Code: the registration day and the expiry day are not counted; if the last day is a non-working day, expiry moves to the next working day.

This applies to the administrative petition, not to sending the notification to the employer or to choosing the court. The institution must inform you that it has forwarded the petition.

Response to the petition requesting an inspection

30 calendar days

Registration of the petition with the competent institution.

Articles 2.553 and 2.554 of the Civil Code; the starting day and the expiry day are excluded, and the rule for a non-working last day applies.

This is the time limit for providing a response, not for recovering your salary. After forwarding, use the registration date at the competent institution.

Maximum response time limit for the petition after a lawful extension

45 calendar days

The registration date at the competent institution, from which the standard time limit also runs.

Article 9 of Government Ordinance No. 27/2002 and Articles 2.553–2.554 of the Civil Code. For the maximum extension, calculate a single period of 45 days, without successively adding two periods that each exclude the first and last day separately.

The time limit may be extended by no more than 15 days, provided the institution notifies you beforehand. Do not apply the extension automatically. If the notification specifies a shorter extension, use the actual length; the total period cannot exceed 45 days.

Condition for bringing proceedings after a valid formal notice of default (punere în întârziere)

6 months

The date on which the debtor was formally placed in default (punere în întârziere), established on the basis of a valid notification and proof of its delivery.

Article 2.540 and Articles 2.552 and 2.554 of the Civil Code.

Use this time limit only after checking the legal effect of the notification. Article 2.540 of the Civil Code makes interruption of the limitation period conditional on bringing proceedings within six months. This time limit is not a guaranteed extension of the original limitation period and does not mean that a new three-year period automatically starts running. Continue to monitor the time limit calculated from each due date. Do not assume that a notification sent after the limitation period has expired automatically removes the effects of limitation.

Use this time limit as a guide and check whether it applies to your situation.

Appeal against the tribunal’s judgment in the employment dispute

10 calendar days

Service of the tribunal’s judgment.

Article 271(2¹) of the Labour Code and Article 181(1), point 2, and paragraph (2), and Articles 182–183 of the Code of Civil Procedure.

Calculate the time limit from the date of service of the judgment, not from receipt of the inspectorate’s response. Check the judgment and the remedy indicated. The calculator does not determine the total length of the proceedings.

Next steps

  • Keep the documents actually sent and proof of delivery to each recipient.
  • Track the inspectorate’s response and the time limit for filing the payment claim with the tribunal separately. Submitting a new petition does not automatically restart the limitation period.
  • If the inspectorate does not respond within the time limit, you can use the ‘I have not received a response to my petition’ guide, without delaying the check of the limitation period for salary entitlements.
  • If you receive a payment after filing the court claim, inform the court and update the amount you are still claiming.
  • Read the court’s correspondence and comply with the requirements stated. The time limit for an appeal against the tribunal’s judgment in the employment dispute is 10 days from service.
  • If you obtain an enforceable judgment and the employer does not pay, speak to a judicial enforcement officer about enforcement.
  • If you face reprisals, keep the evidence and check separately which measures you can challenge. The protection provided by law does not guarantee that the employer will not work out who reported the matter to the inspectorate.
I have not received a response to my petition
