Unsafe playgrounds or street furniture

Prepare a report about the situation you observed.

We help you choose the institution and prepare the text. We do not send anything on your behalf.

Check your safety and choose the appropriate procedure

Is there an immediate danger to people or the environment now?

  • Yes
  • No
  • I cannot assess this

Has anyone been injured or directly threatened?

  • Yes
  • No

What do you want to achieve?

  • Checking and remedying the situation
  • Existing documents or information
  • Challenging a penalty or an act you have received
  • Reporting a possible criminal offence

Is the incident happening now?

  • Yes
  • No
  • First, get to safety and request the necessary intervention. If there is an immediate danger, call 112. Do not fill in the form instead of requesting intervention.
  • Move away from the source of risk. Do not touch suspicious waste or containers. Use the verified contact details for intervention; not every violation justifies a call to 112.
  • Request medical care or intervention, depending on the situation. The criminal procedure is separate from a petition for preventive measures. You can return to this petition once you are safe.
  • Open the FEW guide to accessing public information. Keep the request for documents separate from the request for intervention.
  • Do not automatically use a petition as a substitute for challenging an act or a penalty. Check the special procedure and the applicable time limit.
  • Follow the criminal procedure and check the formal requirements for submission. The time limit calculator for petitions made under Government Ordinance No. 27/2002 does not apply to the criminal procedure.
  • Report the situation using the verified contact details for intervention and, where useful, prepare the written report separately.
  • Continue by identifying the authority and preparing the text.

112 emergency service

Emergency telephone number. Do not use it as a registry for a petition submitted under Government Ordinance No. 27/2002.

112

The single emergency telephone number available in Romania. It is not intended for submitting an administrative petition.

Tell the operator the location, landmarks and nature of the emergency, and answer their questions. Do not fill in the petition form first.

At all times, 24 hours a day, 7 days a week.

Identify the location and responsibilities for the situation reported

Who is responsible for what

Here you can find contact details for local or county institutions and, where applicable, for a national institution marked ‘National alternative’. Use the explanations in the guide to choose the right recipient for your problem. You send the report; the Foundation does not send anything on your behalf.

Ask for checks on how the property is administered and on measures relating to local assets or services. Identify the administrator and who is responsible for maintaining the property concerned.

  • Mayor’s office

Contact the mayor’s office to clarify the status of the site and identify the competent authority. This choice does not confirm that it owns the property.

  • Mayor’s office

Ask for the competent recipient to be identified using the landmarks. Do not assume that the mayor’s office must repair property administered by someone else.

  • Mayor’s office

Notify the identified administrator about measures within its responsibilities. Use the administrative template only if the recipient falls within the categories specified in Article 2 of Government Ordinance No. 27/2002; for other private administrators, make a direct request.

  • Administrator of the site

Inspections may also cover equipment in publicly administered playgrounds. Describe the site’s intended use and its users; the authority determines whether the rules apply, including where the status of a shared private space is unclear.

  • National Authority for Consumer Protection (ANPC) – territorial office

Ask for the equipment’s classification to be determined and for checks on compliance with technical safety obligations. Operation by human strength or weight does not automatically exclude inspection. The authority determines which requirements apply to the specific equipment.

  • State Inspectorate for the Control of Boilers, Pressure Vessels and Lifting Equipment (ISCIR)

The checks concern the safety conditions at the playground, within the authority’s remit. For problems concerning only the playground’s surface, fencing or path, do not automatically include the State Inspectorate for the Control of Boilers, Pressure Vessels and Lifting Equipment (ISCIR) among the recipients.

  • National Authority for Consumer Protection (ANPC) – territorial office

The checks concern a service offered to consumers and the products used to provide it. A contract with a company solely for maintenance does not prove that the company also operates the service offered to users.

  • National Authority for Consumer Protection (ANPC) – territorial office

Mayor’s office

Check the competent institution’s contact details on its official page.

Identify the mayor’s office responsible for the location and subject of the report and use its registry address or official petition form. In București, check whether responsibility lies with the municipality or sector authorities. If you do not know the responsible institution or administrator, ask for the recipient to be identified and, where applicable, for the petition to be forwarded to the competent authority.

Prepare the text without the recipient’s email address

Administrator of the site

Check the competent institution’s contact details on its official page.

Look for the administrator’s name on the information board, on the institution’s official page or in the public instrument governing administration, if available. Distinguish the administrator of the site from the equipment holder and the maintenance company. For a private administrator, use the contact details it has officially published, and check separately whether Government Ordinance No. 27/2002 applies to it. If you have not identified the administrator, ask for it to be identified, specifying the location and landmarks.

Prepare the text without the recipient’s email address

National Authority for Consumer Protection (ANPC) – territorial office

Check the competent institution’s contact details on its official page.

Identify the territorial office responsible for the reported location and use its verified contact details. If these are unavailable, use the verified national contact details of the National Authority for Consumer Protection (ANPC). To have the report registered and follow up on the response, choose the standard report; a quick notification may guide inspections, but does not replace it.

Prepare the text without the recipient’s email address

National alternative

National Authority for Consumer Protection

It checks compliance with consumer protection rules and the safety of products and services, including recreational equipment, within its statutory remit. For a playground, describe the equipment and the danger observed and use the contact details of the competent territorial office or the verified national contact details.

https://eservicii.anpc.ro/ (opens in a new tab)

Official access point for the electronic services of the National Authority for Consumer Protection (ANPC). Choose the ‘Reclamații Consumatori’ (Consumer complaints) category and the standard report, which receives a registration number and is handled under the consumer complaints procedure. The authority describes the quick notification as a possible basis for inspections and checks on specific topics, without the procedure for handling a complaint; do not use it in place of the standard report if you want to follow up on registration and the response. If the form does not allow you to describe the actual situation, use another method of submitting a complaint officially indicated by the authority.

Check the official form to see which fields are mandatory and which file types and sizes you can attach.

State Inspectorate for the Control of Boilers, Pressure Vessels and Lifting Equipment (ISCIR)

Check the competent institution’s contact details on its official page.

Identify the responsible territorial inspectorate in the official ‘Inspecții Teritoriale’ (Territorial inspectorates) section, checking which counties it covers. If you cannot identify it, use the institution’s verified national contact details and describe the exact location. Do not confuse this institution with the State Inspectorate for Construction (ISC).

National alternative

State Inspectorate for the Control of Boilers, Pressure Vessels and Lifting Equipment (ISCIR)

It checks compliance with safety requirements for installations and equipment subject to its legal regime, including recreational equipment covered by that regime. Specify the equipment type and site so that the competent territorial inspectorate can be identified.

iscir@iscir.ro

Choose how to proceed: rapid response, a registered petition or both.

Rapid response

  • Use the guide for spaces intended for public or shared use, including spaces with paid access or private administration. A temporary closure does not change the space’s usual intended use.
  • If a serious accident has occurred or there is an immediate danger requiring intervention, get to safety and call 112.
  • Stop using the dangerous item and keep children in your care away from it. From a safe place, you can warn people approaching it.
  • Notify the administrator or responsible staff using verified contact details. Describe the item precisely and ask for it to be checked promptly and for the necessary measures to mark it with warnings or restrict its use.
  • Do not test the object’s strength, dismantle it, move components or touch cables or parts that could fall.
  • If you cannot identify the administrator, contact the authority recommended for inspection or clarification of the situation, based on your answers to the guide’s questions. Do not assume that an online form or a general email address can handle emergencies.

Registered petition

  • Describe the damaged item, the visible defect and how it could cause injury. You do not have to determine which technical standard has been breached, the exact cause of the defect or the installation’s legal category.
  • Use the ‘Play areas and street furniture – checks and inspection’ template and choose the version appropriate for the recipient. The National Authority for Consumer Protection (ANPC) checks protection and safety matters within its remit; the State Inspectorate for the Control of Boilers, Pressure Vessels and Lifting Equipment (ISCIR) checks technical matters according to the equipment’s classification.
  • A publicly administered playground that is free to use may be inspected by the consumer protection authority. Government Decision No. 435/2010 includes local public authorities among the holders of equipment made available to users.
  • Equipment operated by human weight or physical strength is not automatically excluded from inspection by the State Inspectorate for the Control of Boilers, Pressure Vessels and Lifting Equipment (ISCIR). Ask for the classification and applicable obligations to be determined, without assuming that all equipment requires the same type of authorisation.
  • For a bench, bin, railing or other ordinary street furniture, first contact the administrator and, for local assets or clarification of who administers them, the mayor’s office. The consumer protection authority may be relevant if the object is used as part of a service for consumers; do not include the State Inspectorate for the Control of Boilers, Pressure Vessels and Lifting Equipment (ISCIR) among the recipients merely because the furniture is damaged.
  • Use the ‘Play areas and street furniture – safety and remedial action’ template for the mayor’s office, another authority or an administrator falling within the categories specified in Article 2 of Government Ordinance No. 27/2002. Ask for the necessary protective measures, identification of who is responsible and repair, replacement or removal of the item following checks.
  • For an ordinary private administrator or an association administering a shared space, make a direct request for checks and remedial action. Check the recipient’s legal status separately; the time limits and forwarding rules under Government Ordinance No. 27/2002 do not automatically apply to it.
  • If the administrator is unknown, give the location, the details on the information board and any other available landmarks. Do not make reporting the risk conditional on obtaining a maintenance contract, technical certificate or till receipt (bon fiscal). Attach relevant documents if you have them.
  • When contacting the National Authority for Consumer Protection (ANPC), choose the standard report, which receives a registration number and is handled under the consumer complaints procedure. The authority presents quick notification as a possible basis for inspections and checks on particular issues, without the handling procedure that applies to a complaint; do not use it instead of a standard report if you want to follow up on registration and the response. If the form does not allow you to describe the actual situation, use another way of submitting a complaint officially specified by the authority.
  • For copies of permits, contracts or existing documents concerning checks carried out, make a separate request under Law No. 544/2001. Challenging a penalty and reporting a possible criminal offence follow separate procedures.
  • Equipment used exclusively within a household is outside the scope of this guide. For problems with a product bought for domestic use, check the procedure appropriate to your relationship with the seller or producer.
  • Choose recipients according to your specific requests. Ask to be given the registration number and date, the measures ordered and the legal basis for the outcome. Displaying several recipients does not mean that the petition is automatically sent to all of them.

If necessary, report the situation using the verified contact details for intervention. Send the written report separately to document the problem and request a response. State in the report that you have already reported the situation.

Prepare the report

Prepare the text. Provide only the necessary details. Check and edit the resulting text.

First answer the safety questions and identify the responsibilities.

Evidence and photographs

  • An overview photograph showing the site and the position of the dangerous item, taken from a safe place.
  • Photographs of the visible defect, without testing, moving or dismantling the object, or taking measurements that put you at risk.
  • The address, the name of the park or space, a nearby entrance and other landmarks; optionally, the coordinates.
  • The date and time of observation. State whether the item was being used, marked with warnings or cordoned off and whether the situation recurred.
  • The equipment’s name or code, the manufacturer’s name or other information on the label, only if legible from a safe place.
  • A photograph of the sign with the details of the administrator, equipment holder or operator, if you can take it from a safe place. Do not assume that the maintenance company is also the administrator.
  • For a commercial service, a description of the service and the documents you hold, such as a ticket or proof of communication with the operator.
  • Earlier correspondence, registration numbers and measures announced. For an accident, keep the relevant documents you lawfully hold separately.
  • Avoid taking unnecessary photographs of children, injured people and other identifiable individuals. Send only relevant materials and keep the originals.

Keep the originals in a safe place. Send only relevant images with your report. For publication, create copies with unnecessary data and identifying features removed.

A copy from which you have removed the photograph’s technical data, such as the date and location recorded by the device, does not replace the original. Nor do these data, taken alone, provide conclusive proof of when or where the photograph was taken.

Include faces, vehicle registration numbers and witnesses’ identities only when they are relevant to the recipient and the purpose of sending the material. Publication on a website serves a different purpose from private submission to an authority.

Mistakes to avoid

  • Personally testing the strength of a swing, slide, fence, cover or damaged bench.
  • Letting a child use the equipment to demonstrate the defect.
  • Approaching cables, detached parts or unstable items to take photographs.
  • Assuming that every object in a park belongs to the mayor’s office or that the company carrying out maintenance is automatically the administrator.
  • Automatically sending every report concerning property in the public domain (domeniul public) to the consumer protection authority, without identifying the subject of the report and the relevant remit.
  • Ruling out inspection by the consumer protection authority merely because the playground is public or access is free.
  • Automatically ruling out inspection by the State Inspectorate for the Control of Boilers, Pressure Vessels and Lifting Equipment (ISCIR) for manually operated equipment, or confusing an inspection with carrying out a repair.
  • Applying the administrative response time limit to a request addressed to a private administrator that does not fall within the categories specified in Government Ordinance No. 27/2002.
  • Confusing the response time limit for a petition with a universal time limit for completing a repair.
  • Unnecessarily publishing or sending images of children and injured people.

Keep proof and track the time limit

Keep the text actually sent, the evidence actually attached, confirmation of dispatch, confirmation of receipt or registration and any notification of forwarding or extension.

Sending the email, receiving the registration number and receiving the response are three separate events.

When calculating a time limit in days, do not count the day it starts or the day on which it expires. If the final day is a non-working day, the time limit is extended to the next working day. The calendar covers 2024–2035 and includes Orthodox holidays with variable dates; check any additional days off observed by the institution separately.

Response: 30 days from registration
Possible extension: 45 days in total from the same registration – does not apply automatically
Forwarding: 5 days – a separate time limit

Next steps

  • Keep the text and annexes actually sent, proof of submission and correspondence with the administrator.
  • Note the registration number and date at each authority. Follow up separately on the direct request to a private administrator and the administrative petitions.
  • If the petition is incorrectly addressed, the authority forwards it to the competent authority within 5 days of registration and notifies you, under Article 6¹ of Government Ordinance No. 27/2002.
  • For a petition, keep track of the response time limit of 30 days from registration and any extension of up to 15 days, with prior notification, under Articles 8–9 of Government Ordinance No. 27/2002. After forwarding, the time limit runs from registration with the competent authority.
  • Calculate the time limit without counting the first and last days, under Article 2.553 of the Civil Code. If the last day is a non-working day, apply Article 2.554 of the Civil Code. The petition response time limit calculator does not apply to a direct request to a private administrator or to special procedures.
  • Check whether the response states the outcome of the inspection, the safety measures, who is responsible for remedial action and the time limit set for implementation. The response time limit does not mean that the repair must be completed within the same period.
  • If the risk persists or new facts arise, describe the current situation and refer to the earlier petition. Do not approach the repaired item to check its strength yourself.
  • If you do not receive a response within the time limit, continue with the ‘I have not received a response to my petition’ guide. If you send several petitions about the same issue to the same public authority or institution, they are combined and you receive a single response covering all of them. Once the response has been sent, a further petition with the same content, received from you or from a public authority or institution to which it was incorrectly addressed, is closed without further action under Article 10 of Government Ordinance No. 27/2002.
  • For an injured person, medical care, any claims for compensation for the harm suffered and reporting a possible criminal offence require separate steps. If an immediate danger arises, follow the emergency intervention steps again.
I have not received a response to my petition
